The regular meeting of the Lino Lakes Planning and Zoning Board was called
to order at 7:30 P.M., April 14, 1982 by Chairman Johnson with all members
present. It was noted that Mr. Schumacher would not be present at this
meeting. Mr. Kluegel, Building Official, was also present.
Mr. Prokop moved to approve the minutes of March 10, 1982 as presented.
Seconded by Mr. Goldade, Motion carried unanimously.
Mr. Kluegel presented the Council action on the last meeting noting that a
copy of the Moratorium Ordinance was provided for each member. This
ordinance will become effective May 12, 1982.
Mr. Kluegel also reported that Mr. Nathe had requested his rezoning request
be tabled, therefore, no Council action had been taken.
VARIANCE - MIERS
Mr. Miers is requesting a variance for the split of a parcel of land of less
that 22 acres from the land he now owns located on Old Birch Street. He
plans to either moved a home onto the lot or construct a new home at that
location. He said he was undecided at this point. The home located at
the Apitz Garage is for sale to be moved and he has made an offer. However,
if that home is moved onto the lot, he will construct a double attached
garage. Otherwise, he will construct a new home with the same garage.
After some discussion, Mr. McLeam moved to recommend to the Council approval
of this request. Seconded by Mr. Prokop. Mr. Johnson emphasized that this
is a buildable lot. Motion carried unanimously.
VARIANCE - FARVIEW SIGN CO.
Mr. Nugent was present to reproesent that company explaining that in the
process of applying for a sign permit, two locations had been submitted,
a permit had been issued, but for the wrong location. This is the site
the sign had been erected. MR. Kluegel had red - tagged the construction
and the Attorney had advised them they had two optiions, 1) move the sign,
or 2) apply for a variance for the present location.
There was discussion as to the reason why this sign had been constructed
at the wrong location, why construction was not stopped when red - tagged
and if the sign on the silo had been painted out.
Mr. Nugent said when the permit was received, the location was not question-
ed, even though it was different, they took this to be the decision of the
Council. -The Construction was completed because it costs no more to move
the sign, either way.
After some discussion, Mr. Juleen moved to recommend to the Council approval
of this variance due to the monatary hardship in moving the sign. Seconded
by Mr. McLean. Motion carried with Mr. Prokop and Mr. Doocy voting, No.

Mr. Peterson pointed out that he has no monetary interest in those lots -
he is only here to assist this Board, if possible.

Mr. Peterson noted that the utilities were put in a couple of years ago
according to a filed plat. The Corps of Engineers became involved as well
as the DNR and the RCWB. These agencies placed very restrictive conditions
on these lots for construction. The lots then went forfeit and were to be
offered for sale to the City first and then at a Sherrif's auction but,
instead, they went to the State of Minnesota and have never been offered
for sale.
Mr. Peterson felt the City could force a Sherrif's sale on these lots. He
suggested that with the amount of assessments against the lots together with
the added expense of filling, it would make R1 construction prohibitive.
At a meeting last year, Mr. Peterson felt that DNR and RCWB were in a give
& take position by the Corps of Engineer was not.
Mr. McLean asked Mr. Peterson what he thought it would take to break this
loose? Mr. Peterson said he wasn't knowledgable with the legal requirements
but felt a Sherrif's ale could be forced since the City was never offered
the option of purchasing the lots. He also felt that if someone came in
with a feasible plan for development of these lots, that something could
be worked out.
Mr. McLeam moved to recommend to the City Council that the City Administrator
determine the City's legal position in reference to the property and to
either obtaining ownership from the State or force a Sherrif's sale.
Seconded by Mr. Doocy. Motion carried unanimously.
Mr. Peterson offered to assist the Board in anyway that he can and he
pointed out that he has no interest in that land.
VARIANCE - GLENN REHBEIN
This variance is for the construction of home of less than the required
square footage in Shenandoah II. Mr. Karth presented his report and the
reasons for the request.
Mr. McLean pointed out that this had been allowed in Shenandoah III on an
experimental basis. 15% of the lots were designated to have smaller than
required homes. At the completion of this experiment, a report was to be
made back to the Council as to the impact of these smaller homes on the
Community and, in his mind. this request is premature since that study has
not been done.
Mr. Karth pointed out that there are figures available in the material he
had provided. Mr. McLean said this report does not constitute a study. He
wanted to know what the sizes were - who is purchasing the homes - how many
constructed garages - have they been added to, etc.
Mr. Karth pointed out the part of the report that sets forth this information.
Also, this report included the average income of the Metro agrea, cost of
a homw and mothly payments.
Mr. Karth pointed out that the homes they are proposing are 136 square feet
less than the required minimum - noting that the cost of this house dictates
that there must be an income of at least the average income.

Mr. Doocy asked if when homes are sold, is it completed, or are the buyers
allowed to do some of their own work? Mr. Karth said they have the option
of completing any portion that they are qualified to doe. He said, even
though the options are available, very few take advantageoof the options,
basically, because both parties are woking and do not have the time.
There was discussion on the various sizes of the homes, the cost, the
monthly payments and the effects of these aspects in relationship to the
ability to purchase a home.
There was also discussion on the status of the present interest rates deal-
ing with the possibility of lower rates and how far they could drop or if
there is a possibility of a drop at all.
Mr. McLean moved to table the request for a variance for a reply to be
presented on the recommendation of the Council for a study on the smaller
homes impact. Seconded by Mr. Prokop. Motion carried unanimously.
A recess was called at this point in the meeting. The meeting reconvened.
OLD BUSINESS
Mr. Kluegel reported that Mr. Szymanski had withdrawn his request for a
variance for the small parcel of land on West Rondeau.
Mrs. Lee Peick had withdrawn her request for a kennel license - she had
got rid of the dogs she had.
Mobile Home Park Fees.- Mr. Marier had requested the Planning and Zoning
to define a 'Hardship' in relationship to issuing a trailer permit. Mr.
Reinert suggested that criteria should be established.
There was some discussion on this with Mr. Kluegel pointing out the require -
as set forth in the new zoning ordinance.
The meeting was turned over to Mr. Bill Short, City Planning Consultant,
to present the work done on the zoning Ordinance in conjunction with the
Comprehensive Plan.
Mr. McLean moved to adjourn.Seconded by Mr. Prokop. Aye.
