41, The regular meeting of the Lino Lakes Planning and Zoning Board was called
to order at 7:45 P.M. by Chairman Doocy. Members present: Swistoski, Johnson.
Klaus, Prokop.
MINUTES
The minutes of October 22, 1981 was considered. Mr. Prokop noted that he
was present. Page two, Marten Hansen rezone - should read that "Mr. Hansen"
was told this would appear before the City Council; Page three, the request
for an increase in the expenses paid should be 'per quarter' for clarification.
Mrs. Klaus moved to approve the minutes as corrected. Seconded by Mr.
Johnson. Motion carried unanimously.
MR. SCHUMACHER's REPORT ON COUNCIL ACTION
Due to having only three members present at the last Council meeting, no
action could be taken on the rezone request. The variance request for Mr.
Krube was approved.
Mr. Schumacher reported there had been discussion on the Comprehensive Plan
and on the need to hold another public hearing on the Plan. He will keep
the Board aware of the actions of the Council on this matter.
VARIANCE - MR. ZADUTKE
41) Mr. Zadutke had been present but was not present at this time. This matter
was laid aside for the present.
VARIANCE - OLSON
Mr. Olson has a lot on West Shadow Lake Drive and is seeking a variance to
construct a home on that lot.
Mr. Doocy reported that a lot in an unsewered area must contain one acre and
this lot contains only 1/3 acre. Under Ordinance #56, a!lot must contain
at least 600 of the requirement, otherwise, a variance is requried.
Mr. Prokop pointed out this is a low lot and also is on the Lake side and
this area will be carefully monitored.
Mr. Schumacher pointed out that old lots of record are the lots that must
contain 60% of the current requirements in order to be developed. If the lots
do not contain this 60%, then a variance is necessary. This lot is in a
plat that was filer before the Ordinance was passed. The lots were platted
as lots to be sewered but the sewer was never installed. Now, in order to
develop those lots, it must be proven that a septic system can be installed
without causing pollution to the Lake.
Mr. Prokop noted the area to the South that had been considered for platting
just recently. He said he would like to see a contour plan of this area and
41) a plot plan showing where the house, septic system and drain fields are to
be located. Also, the location of the well.
Mr. Johnson felt the City is almost in colusion with the sellers of this
property in that this buyer was unaware of the requirements for development
of the lots.

0 Mr. Schumacher pointed out that the City cannot be responsible for the selling
of lots in this City.
Mr. Doocy asked if the memo of August 21st is made available to all applicants
for variance and Mr. Schumacher said he did not know. Mr. Schumacher pointed
out that when this matter had been brought before the Council, this variance
procedure had been adopted because they had felt this would be the most
efficient manner in which this could be handled.
Mr. Doocy noted the items that should be complied with - the 6 listed on the
back of the application - and to keep in close contact with the Building
Inspector. When the items have been completed, contact the office and he
will be put on the agenda.
Mr. Prokop asked for a contour map showing the elevation and Mr. Olson asked
where he would get something like that? It was generally felt this could
be had from the City Engineer.
MR. Olson asked if he had to get a survey of the lot and Mr. Prokop said,
not necessairly. Mr. Schumacher said a site plan is what is needed showing
the location of the home and all the utilities.
Mr. Prokop moved to table Mr. Olson's application for a variance until such
time as he meets the stipulations in the Building Inspectior of August 21,
1981, also meets the requirements set forth at this meeting. MR. Doocy
added, the recommendations of the Engineer and the Planner and the high water
IIIlevel. Mr. Johnson seconded the motion as amended. Motion carried
unanimously.
Mr. Prokop suggested that the owners of the lots on West Shadow Lake Drive
be sent the letter of August 21, 1981 informing them of the requirements
for construction. Mr. Prokop made this into a motion. Mr. Johnson seconded.
Motion carried unanimously.
Mr. Olson said having people appearing before the Board unprepared, taking
up time - he felt they should be better informed.
Mr. Schumacher pointed out that all the information necessary for the
application of the variance is printed on the back of the application.
Mr. Zadutke was not present. Mr. Schumacher said this person was here and
talked with him briefly noting the items he would need. There was no back
up information for this request.
Mr.Prokop asked if this would be a move in the right direction to allow the
making two lots out of three? There were several items missing before this
request can be considered. Mr. Prokop moved to table this matter and advise
Mr. Zadutke provide the necessary itmes. Seconded by Mr. Johnson. Motion
carried unanimously.
There was discussion on the problems of contamination of the lake with the
development of the lots along West Shadow Lake Drive. The Board was con-
cerned with how these lots could be developed without endangering the lake.
It was generally felt that many of these concerns will fall on the building
inspector.

NEW BUSINESS
411 Mr. Doocy asked that this Board be filled in on the request of Mr. Garske
on the matter of a request to open an Auction Barn at the Lino Body Shop
on Lake Drive.
Mr. Doocy reported this person had asked if he could operate an Auction Barn
out of the garage located at 7702 Lake Drive. This has been researched and
there is no ordinance govering this and, at the present, there is no fee
schedule for a license.
Mr. Schumacher said it is very difficult to control what is sold at a place
such as this.
Mr. Johnson said he had some Ordinances from other cities and if there is
one concerned with this type of operation, it could be used as a model.
The general consensus of the Board was that before this could be dealth with
an ordinance should be written.
ULMER's RICE LAKE ADD. III
This addition had been tabled previously until this meeting. Mr. Doocy
recommend this matter be tabled until it is requested to be put back on the
agenda.
Mrs. Klaus moved to table consideration of Ulmer's Rice Lake Add. III, that
had been tabled from the October 21, 1981 meeting to this meeting. until
there is further information from Mr. Ulmer. Seconded by Mr. Prokop.
Motion carried unanimously.
LAND USE PLANNING WORKSHOP
Mrs. Klaus asked to comment on this workshop that three of the members had
attended. She felt that it was very informative and she wanted the Council
to know that it was appreciated that they could attend a workshop such as
this.
SAFETY SIGNS
Mr. Swistoski asked if anything had been done about the safety signs being
installed aroung the park areas, etc.
Mr. Schumacher reported that the City had just had a sign survey done by the
State and all new signs were being installed.
