The regular meeting of the Lino Lakes Planning and Zoning Commission was called to order at
7:40 p.m. by Chairman Doocy. Members present; Larry Johnson, Jan Klaus, Bob Doocy. Members

MINUTES - SEPTEMBER 16, 1981
Mr. Prokop moved the minutes of the September 16, 1981 Planning and Zoning Board meeting
be accepted as written . Mrs. Klaus seconded the motion. Motion carried unanimously.
MR. SCHUMACHERS REPORT
Mr. Schumacher noted Mr. Weiners Special Use Permit was approved at the October 13, 1981
Council meeting.
Mr. Doocy asked what action had been taken at the last Council on the sewer issue (81 -01,
Lake Drive Sewers). This will be discussed after the regular agenda.
VARIANCE - STEVEN KRUBE
Mr. Krube is asking for a variance to Ordinance #56, Section 4.05 to place a new garage
closer to the street than his house. Mr. Krube said his house is set about 600' off of
Pine Street and is well screened by shrub and other foliage. He noted that the land be-
hind his house drops off considerably and the septic system is located to the other side
of the house.
iiirr. Johnson moved to recommend to the Council the variance for Mr. Krube be approved. Mrs.
laus seconded the motion. Motion carried unanimously.
Mr. Doocy asked Mr. Krube to call the City office to determine at what time he would appear
on the October 26, 1981 Council agenda. He also told Mr. Krube he should appear at the
Council meeting to answer the Council's questions.
PLAT - M & T INVESTMENT COMPANY
Charles Bartholdi appeared before the Board representing M & T Investment Company. Mr.
Marcel LeRoux was also present. Mr. Bartholdi said Mr. LeRoux would like to plat approx-
imately 20 acres just south of 64th Street. The present zoning is agriculture. He is
proposing a total of 13 lots, minimum size being 1 acre. The original plan was to plat
four lots rather than 13 but decided on 13 to have enough money in the area to complete
the roads. However, if the Planning Commission would go along with the four one acre lots
this would be preferable. The reason he is here tonight is to see if this is a feasible plan
in this area and get some feed back from the Planning Commission to see if the project
will fly.

Mr. Doocy said he had some concerns with the turns and twists of the proposed road. Mr.

the street. Mr. Doocy was not sure how this is handled.

Prokop noted Ordinance #78 regarding the moratorum on platting. There was discussion about
a road connecting 64th Street to Rolling Hills Drive through the proposed plat. Mr. Prokop
pointed out this would have too many curves and bends to make it a practical emergency route
between the freeway frontage road and Bald Eagle Boulevard. There could be problems with
young people in this area.
Mr. Doocy noted the Comprehensive Land Use Plan designates this area as Rural, one house
per ten acres.and felt the Comprehensive Plan should be followed. Mr. Johnson suggested
taking two lots of one acre and leaving the balance for future development.
Mr. Prokop said drainage was a concern and would have to be addressed. He further indicated
the road access should be revised.
Mr. Schumasher asked what would happen if he platted two lots and sold off the balance of
the property to a totally different person and that person comes in and wants to divide this
balance? We can tell him the two lots density has already been used up but he would prob-
ably take the City to court. This will be an administrative problem.
PRELIMINIARY PLAT - ULMERS RICE LAKE ADDITION #4
Mr. Shumacher said that at the time Mr. Ulmer started this proposal the City was in the
process of preparing for sewers along Lake Drive. the sewer situation has not been re-
solved and Mr. Ulmer said he would wait for the resolution.. Mr. Prokop moved that Ulmers
Resubdivision Preliminary plat be tabled until the November 18, 1981 Planning and Zoning
Board meeting at the request of Mr. Ulmer. Mrs. Klaus seconded the motion. Motion carr-

REZONE - MARLIN HANSEN
Mr. Hansen is requesting a rezone to R2 to change his single family home into a duplex at
6460 Otter Lake Road.
Mr. Hansen said he had considered when he originally built the home it could someday be used
for two families although it was built as a single family home. He now would like to rent
out a portion of the home.
Mr. Schumacher indicated that this request would be a spot rezone which is not consistant
with previous Council action. This would be setting a precedence. Also there is the sit-
uation of double septic system on a lake lot and further the ordinance requires a separate
access.
Mr. Schumacher noted that all R2 zoning passed in the past two years has been for buffer
purposes. There had been no spot zoning for R2.
Mr. Prokop moved to recommend denial of the rezone request since the request represents
spot zoning. Mr. Johnson seconded the motion. Motion declared passed.

agenda and Mr. Doocy told him he should be at the Council meeting for questions.

r. Doocy asked if there were any questions or comments regarding the rezone, variance check-
list that was part of the September packet. There were none.
Mr. Johnson moved to waive the "no smoking" rule. Mrs. Klaus seconded the motion. No vote.

Mr. Schumacher brought the Board up to date regarding the proposed sewer for Lake Drive.
NEW BUSINESS
Land Use Planning Workshops were discussed. Mr. Klaus said she would like to go. Mr.
Doocy said he would like to attend as well and asked Mr. Schumacher to contact Mr.
Swistoski see if he wished to attend.
Mrs. Klaus O(oved to recommend to Council that the honorauium be increased from $25.00
to $50.00 %for the Planning and Zoning Commission. Mr. Prokop seconded the motion.
Motion carried with Mr. Johnson voting, No.
Mr. Prokop moved to adjourn at 9:40 p.m. Mr. Johnson seconded the motion. Aye.
