HomeMy WebLinkAbout09/16/1981 P&Z Minutes; �� Planning and Zoning ;' ""° September 16? 1981 The regular meeting of the Lino Lakes Planning and Zoning Commission was I called to order at 7:47 P.M. by Chairman Doocy. Members present; Swistoski, Klaus, Prokop. Absent: Johnson. On considering the minutes of the Auguat 19, 1981 meeting, Mrs. Klaus moved to approve as written. Seconded by Mr. Swistoski. Motion carried unanimously. Mr. Schumacher was unable to attend this meeting. Mr, Doocy asked if the members had any questions on the Council meeting of August 24th and there were none. VARIANCE - ALCOCK ESTATES This variance is for the splitting of a parcel of land without frontage. This parcel is to be added to 'an existing parcel of land that has existing buildings at the present time. A drawing of his plans was presented to the Commission. Mr. Doocy noted that in April a variance had been approved for Mr. Alcock to split his land into three parcels. This has not been recorded. Mr. Doocy said it is necessary to set aside the original variance in order to approve the variance requested at this meeting. Mr. Doocy said it would be necessary for Mr. Alcock to agree to set aside the first variance in order to approve this one and Mr. Alcock agreed to this action. r. Prokop moved to recommend to the City Council that the variance to the Alcock Estates granted May 26, 1981 by the Council be recinded at the personal request of Mrs. Flora Alcock, personal Representative for the Estate. Seconded by Mrs. Klaus. Motion carried unanimously. Mr. Alcock does not have a certificate of survey - said he didn't want to go to the expense if this request is not approved. Mr. Doocy suggeteted dating the map presented at this hearing with this date - Sept. 16, 1981 - and refer to the parcel in question as "Parcel D ". Mrs. Klaus moved to recommend to the Council approval of the variance for Parcel D for the Alcock Estates, dated 8/26/81 to sell this parcel of land with the stipulation that a Certificate of Survey according to the map dated Sept. 16, 1981. The Certificate of Survey be presented within the next 30 days. • Seconded by Mr. Swistoski. Motion carried unanimously. VARIANCE - RONALD BROWN Mr. Brown is requested a variance for a setback for the construction of a garage and to put his driveway exit onto Main Street. Mr. Brown had contacted the Anoka County Highway Department and they had no objections to this proposal. Mr. Brown reported that the Highway Department said this is a more acceptable route for the driveway than the 'S' shape to exit onto Elbe St. There was some discussion on problems the driveway could create if, and when, Wain Street is reconstructed. Mr. Brown explained that the driveway would be ide enough to avoid any such problems. If the garage is constructed within 16' of the right -of -way, and the street is upgraded, there will' still be a 10' wide ditch area, thus he would still have a distance of 26' to his garage. Planning and Zoning Septepber 16' 1981 Page Two Mr. Swistoski moved to recommend approval of the variance of 9/11/81 per the 410 County Engineer's memo dated 9/1/81, contingent upon the approval of Anoka County Board. Seconded by Mr. Prokop. Motion carried unanimosly. PRELIMINARY PLAT - RESHANAU SHORES Mr. Doocy asked why the resubdivision and Mr. Gotwald said this was for the time when sewers are installed in that area. The lots then may be subdivided in this manner. Mr. Gotwald pointed out this is the highest land along the lake and the street is 12' above the water level. The lowest elevation is 886. This plat meets all requirements,even the Lake Shore Management Act, which does not affect this area at this time. Mr. Kluegel said his main concern is that there are correct setbacks from the lake, for both the residence and septic systems. Mr. Prokop expressed a concern with Lots 1.2.3.4.5. - he felt that the minimum footage for drainfields and basement levels should be set on those lots. Mr. Gotwald said there would be no problems with that stipulation. The points that were set forth in Mr. Short's letter were gone over and dis- cussed with Mr. Gotwald supplying the answers where there were questions. The general consensus of the Commission was that all questions in this report had been answered. r. Prokop moved to recommend to the Council that, if the ER zoning in the Draft Comprehensive Plans conforms to the current Metro suggested zoning of 1 acre lot sizes with on site water and sewer and if the date of this preliminary platting of Aug. 1981 can be considered as prior to Ord. #84, approval of this plat with the stipulations 1) that no basements be less than 886' elevation; 2) septic tanks and drainfields be on the roadside of Lots 1, 2.3.4.85, Block 1, 3)drainfields and septic tanks not less than 3' above the normal lake level of 880' (this to avoid restrictive soils permit) 4) that appropriate fill be placed in and around the building sites to meet the build- ing inspector's requirements; 5) that the Park Board review the previously agreed area wide park land dedication to ascertain if there are any problems in that area; 6) that outlot A on the preliminary plat not be subdivided at the present time until City sewer is avaiable - Outlot B left as a wild life refuge. Seconded by Mr. Swistoski. Motion carried unanimously. A recess was called at this point in the meeting. The meeting was reconvened. APPLICATIONS FOR SPECIAL USE PERMIT AND VARIANCES These are new forms developed by Mike Johnson. Mr. Doocy presented these to the Commission for their consideration. WEINER Doocy noted that this request for the construction of a pole building had een considered at the August meeting. Mr. Weiner had called Mr. Doocy late this afternoon and Mr. Doocy said he had not made any promises but asked Mr. Weiner if he would like to present his materials. Planning and Zoning Se.pte.mbtr 16, 1981 Page Three 410Mr. Weiner presented his revised plans for the construction of a residential type garage to replace the pole type building he had requested. He reported that the difference in cost was $6000.00. pole There was discussion on the reasons why this /building should be allowed. Mr. Weiner pointed out this is near the riding arena, the bus barns, trailer court, etc. This is basically a commercial area at the present. Mr. Weiner is a carpenter and the use of the building is for the storage of equipment, not to be used for the conducting of a business. There was discussion on the need for some sort of screening if this building is allowed. Mr. Weiner reported that his next door neighbor had offered to split the costs for a privacy fence, or plant tress or whatever to block the crossing over into Mr. Weiner's yard. Mrs. Klaus moved to recommend to the Council approval of this Special Use permit for Mr. Weiner for the construction of a pole building on his property at 6356 Hodgson Road to be used for storage only, some type of screening be installed on the property,(vegation screening such as tall hedges or trees). Seconded by Mr. Prokop. Mr. Swistoski asked that the screening be completed by June of 1981. Mrs. Klaus and Mr. Prokop accepted the amendment. Motion carried unanimously. NATHE - USE OF HOME r. Nathe reported that he had moved his house on Co. Rd. J to the rear of the lot and would like to make a multiple dwelling out of the home since it is much too large for one person. The contractor reported that the home is 36'x50' and before it was moved it had no basement. The home was moved and been and made into a split entry. The house had been moved to the rear of this lot in order for the front part of the lot to be used as a parking lot for the 49 Club. This home will have sanitary sewer in conjunction with this Club. Mr. Nathe is proposing to turn this home into two -one bedroom units. On consulting the location of this building, the general consensus of the Commission was that this property has a commercial zoning at the present time. The general consensus of the Commission was that basically, they, as a Board, had no objections to this use, but felt the action would be ruled by what the existing zoning is on the land. Mr. Prokop suggested that Mr. Nathe check with the Council for a ruling on whether he needs to rezone. Mr. Prokop moved to adjourn. Seconded by Mrs. Klaus. Aye. 10:17 P.M. 1
