HomeMy WebLinkAbout08/19/1981 P&Z MinutesPlanning and Zoning August 19, 1981 The regular meeting of the Lino Lakes Planning and Zoning Commission was called to order by Chairman Doocy at g;30 P.M. Members present; Swistoski, Klaus, Prokop. Absent; Johnson. MINUTES - July 22, 1981 Mr. Prokop , page three, 'Southeast' should be changed to 'Southwest" Mr. Prokop moved to approve as corrected, Seconded by Mrs. Klaus. Motion carried unanimously. Mr. Schumacher's Report Mr. Schumacher said there is one item that this Board should be aware of - this is Ordinance #84, passed by the Council at their last meeting. This sets a moratorium on all platting outside the sewer area districts until the Comprehensive Plan is approved. There was discussion on the relationship of this Ordinance to Ordinance #78. One puts a moratorium on dividing large pacels of lands by metes and bounds - Ordinance #84 puts a moratorium on platting of lands into lots and blocks until the Comprehensive Plan is finalized. Mr. Doocy had a question on whether the City is requiring Class 5 or Limestone for dust free surfaces - Mr. Schumacher felt this is a Council decision and the limestone provides a more stable base. Mr. Schumacher answered the Commission's concerns on the follow up of Special Use Permits - any stipulations imposed on a Special Use Permit is given to the Building Inspector to make sure the stipulations are adhered to as ordered. VARIANCE - ANDREW CARDINAL Mr. Cardinal is requesting a variance to Ord. #78 to split a parcel of land from his farm to give to his daughter to build a house. This parcel is being split from a 40 acre parcel. The certificate of survey as presented at this meeting is for 22 acres, but Mr. Cardinal indicated that this would be a waste of good farm land since one acre is all that is needed to provide space for a single family dwelling. He asked that this variance be considered in that light. Mr. Schumacher pointed out that under the Comprehensive Plan this area is classified as Rural and the size of the lot is not important - the density is the important factor. He felt that with the acreage repre- sented by Mr. Cardinal, he did not feel there was any problems in allowing the split of one acre. Mr. Doocy asked Mr. Cardinal if he would agree that he would do absolutel no more subdividing and Mr. Cardinal said, Absolutely. He will not sell any more of his land. Mr. Prokop moved to recommend approval of this variance with the follow- ing change 1) that the parcel to be split be reduced to one acre, 2) that a correct survey be presented before the next Council meeting. Seconded by Mrs. Klaus. Motion carried unanimously. Planning and Zoning August 19, 1981 Page Two VARIANCE - HANSEN This a request for a variance to Ordinance #78 for the transfer of a strip of land 30' wide in order to add to his existing lot. This is necessary due to the location of a tree that Mr. Hansen does not want to remove. This is in the area of the driveway. Mrs. Klaus moved to recommend approval of this variance for the transfer of title of this parcel of land. Seconded by Mr. Prokop. Motion carried unanimously. PRELIMINARY PLAT - GOTWALD This preliminary plat is located on 7th Avenue and contains 11 - 1 acre lots and is called Reshaneau Shores. After reviewing the plat and Mr. Short's comments the Planning and Zoning members requested the following items; 1) obtain an outside Engineer's review due to present conflict of interest, 2) Mr. Kluegel to review on site septic system proposal; 3) conform to the first 8 comments of Mr. Short's letter 4) suggestion of larger lots due to high water table with development on only one side of existing street. Mr. Prokop moved table consideration of this plat until the above requests have been satisfied. Seconded by Mr. Swostoski. Motion carried unanimously. SPECIAL USE PERMIT- WIENER This is a request to construct a metal building for storaage. Mr. Wiener wants._to store carpentry equipment and is located at 6356 Hodgson Road. There is an existing residential unit on this lot. Mr. Prokop had a couple of concerns. Mr. Doocy asked Mr. Wiener if he had seen a copy of Mr. Short's comments - Mr. Wiener had not. He was given a copy and time to read. The points as set forth by Mr. Short were discussed. Mr. Short had the following concerns;1) this type of use requires a LI zoning; 2) inconsistent with Comprehensive. Plan; 3) would require rezoning; 4) Lot is too small; 5) the building appears to be too large; 6) industrial setbacks not met. There is also a concern with the drainage in relationship to the ditch crossing the lot. Mr. Swistoski moved that Mr. Wiener consider both PCZ and Mr. Short's recommendation and this matter be tabled until the next meeting. Seconded by Mrs. Klaus. Motion carried unanimously. VARIANCE - HAL LEIBEL This is a request to split one lot into two - the lots are located on Mound Trail and is a variance to Ord. #78. Mr. Leibel purchased a home that was in the Chain of Lakes Park and wants to move that home onto this portion of the lot being split. Planning and Zoning August 19, 1981 Page Three There was discussion on the frontage of these lots, the manner of this being on a septic system -(can sewer be obtained from Centerville ?), of perhaps allowing this lot to be a part of Centerville - -- Mr. Prokop moved to recommend this application for a variance be granted pending a completion by Mr. Leibel of the following three items, 1) triangle parcel, labeled A on plat map, be added to existing property, 2),a new certificate of survey for lot splits be obtained showing 150' frontage along Mound Trail 3) obtain approval of Centerville for the lot split of Parcel A and that the remainder of the property which fronts on Mound Trail be given a variance for residential purposes because of the land containing less than 150' frontage. Seconded by Mr. Swistoski. Motion carried unanimously. FEASIBILITY REVIEW - McCOLLAR This is for the development of 40 acres of land bordering the North side of 64th Street, East of Otter Lake Road. At the present time there is no street servicing this land as 64th Street ends at Mr. Scherer's property. It was pointed out that the developer would have to install the street as presently platted. There was also discussion of the classification of this land in the Comprehensive Plan, which designates this as 1 unit per 10 acres. The many aspects of developing this property was discussed with Mr. McCollar. Mr. McCollar thanked the PSZ for their information. REZONE APPLICATION - CHARLES GRAMITH Mr. Doocy explained that this item is not on the agenda. Mr.__0.rami'hh's informtion had not been received at City Hall before the agenda had been prepared. Mr. Doocy pointed out that this matter had been considered at a previous meeting. Mr. Gramith is asking to rezone this parcel of land for the construction of a duplex. The Planning and Zoning Board had concerns with the location of the new wells being drilled in the area of the old drainfields and the fact that there have been problems with septic systems in that area. Mr. Gramith said he had no intentions of putting a well in the drain - field area. Mrs. Klaus moved to recommend this matter be tabled for information from the City Engineer, Building Inspector, Anoka County Health Depart - ment as to the location of the well. Seconded by Mr. Swistoski. Motion carried unanimously. NEW BUSINESS Metropolitan Council Plan Review Planning and Zoning August 19, 1981 Page Four Mr. Schumacher felt the comments from Metro are favorable and that there should be few, if any, problems when this is considered by the Physical Development Committee on August 20, 1981. However, Mr. Schumacher said he did want to discuss some of the changes. Those changes are 1) revised boundaries of land classifications and eliminated one classifications and set the size of the lots for these various areas. OLD BUSINESS Platting Check List - Mr. Doocy said he would like to see a heading stating what is needed for Planning and Zoning and what is needed for Council. There should also be a separation as to what is needed for re- zoning, variances or special use permits. Mr. Doocy felt if the applicants know what is needed, then they realize that if the information is not available, then their request will not be considered. Mr. Swistoski reported on his observations of kids climbing onto and into the equipment parked behind the storage shed - he felt there should be some safety measures taken to insure that children are not locked in the trailer that is parked there. He also questioned a bicycle /walking path along Main Street to the Lino Lakes Regional Park - are there plans? This had been discussed at a Council meeting but no action at this time. Mr. Prokop questioned the paving of the Street in Shenandoah III and was told this has been done. Mr. Prokop moved to adjourn. Seconded by Mrs. Klaus. Aye. (tape did not include time)
