The regular meeting of the' Lino Lakes Planning and Zoning Board was called
411to order at 7:30 P.M., March 18, 1981 by Chairman Bathke. Members present;
Swistoski, Doocy, Klaus, Flannery, Johnson. Absent; Prokop.
On considering the minutes, Change 9th paragraph to read "Mr. Doocy voted No"
Mr. Johnson questioned the special use permit of Mr. Glenn Rehbein's - was
this for HI or LI? Mr. Schumacher said Mr. Rehbein's land was zoned
commercial and his operation was a permissable use. There was no zoning
designation of either HI or LI - just the use.
Mr. Prokop arrived.
Mr. Doocy moved to approve the minutes as corrected. Seconded by Mrs. Klaus.
Motion carried.
Council Actions
Mr. Schumacher presented each member with a copy of the Judge's findings in
connection with the quads.
Mr. Bill Short
Mr. Short presented the amendment chapter to the Comprehensive Plan and
explained the necessity for this Chapter. He informed the Board that this
had been presented to the Council at their last meeting. Mr. Short outlined
•the areas that are discussed in this chapter, the forestation, soils,
enviornment and archeological. Mr. Short outlined the polices that will
ensure the necessary protection of the items outlined in this chapter.
There were no further questions from the Board. Mr. Short was thanked for
his time and information.
Mr. Bathke welcomed the new members to the Board and asked that the Board
stick to the agenda since it is a full agenda.
REZONE - CALVIN ROLSTAD.
Mr. Rolstad said he has a 32 acre parcel of land located on Holly Drive and
is asking for a zoning of R -2 in an R -1 area.
The Board pointed out that this area is designated as an R -1 Zone in the
Comprehensive' and this would constitute spot zoning. There was discussion
of the surrounding area and the impact this would have in relationship to
the development in that area.
Mr. Bathke asked for a roll call vote on this; Doocy - against spot zoning;
Swistoski - abstain; Prokop - ?; Kraus - ?; Flannery - ?; Johnson - ?;
Mr. Bathke pointed out that this is the probable way they would recommend
this to the Council. (Clerk's note: the part I could understand left the
• impression that this would be recommended for denial)
SCHILLING - INDUSTRIAL PARK REZONE.
This is for the rezoning of the remaining portion of the Lino Industrial
Park and has preliminary approval. Mr. Schumacher pointed out the portion
that alreadyo.,abeen rezoned.

Mr. Schilling said they had not asked for rezoning on the entire area before
"'was because they wanted to develop in stages.
Mr. Schumacher pointed out that is in conformance with the Comprehensive Plan.l
Mr. Johnson moved to recommend to the Council that this land be rezone to
LI. Seconded by Mr. Swistoski ( ?). Motion carried unanimously.
STEVE LeV,SS i1R
Mr. LeVessuer was asking for a building permit to enlarge a building on the
property he owns at the end of Lois Lane. Since this is in a residential
area and is a commercial building, the building inspector had refused to
issue a permit for this work. It was pointed out that this lot and building
has always been used as commercial.
The portion of the Ordinance that covers this particular situation was read
and discussed.
Mr. Bathke suggested this area be rezoned and Mr. LeVessuer asked what time
frame is he looking at - he would like to get started on this as soon as
possible.
Mr. Johnson asked if this could be handled under a special use permit? It
was generally felt that this should be handled by a rezoning. Mr. Levessuer
was advised to obtain an application form for the rezone and follow the
• procedure.
GLENN REHBEIN - VARIANCE.
This is concerned with lots located in Equity Estates, Lots 28 & 29 to be
split. There was discussion as to why this land was to be split and why the
lots were to be divided as shown. This would require a variance to Ord. #78.
Mr. Prokop moved to recommend to the Council this variance be denied. Second-

PLA FEASIBILITY -` T.J.J.T. -✓ 5A-°z1P',--''
This plat deals with lands located at the end of 62nd Street and is for
informational purposes only. The general consensus of the Planning and
Zoning Board was that this is a feasible plat and the developers will need
to contact Rice Creek Watershed Board on the drainage. This will need to be
presented as a preliminary plat for Planning and Zoning consideration and
approval before Rice Creek Watershed will consider.
FRANK MINAR - VARIANCE
This is for the splitting of a lot on County Road J,containing 20 acres, for
the purpoase of constructing a home on the second portion. There was dis-
cussion on the applicability of the moratorium on splitting lands by metes
411 and bounds to this particular request. The lot to be split off contains 5 acres.
Mr. Johnson moved to recommend to the Council approval of this variance.
Seconded by Mr. Prokop ( ?). There was discussion of the necessity of payment
for Park purposes, with Mr. Minar disagreeing with the proposal.

EUGENE PEIL - SPECIAL USE PERMIT
This is for a commercial building in a non - sewered area. Mr. Peil presented
plans for the constuction on a building in Carole's Estates II.
Mr. Short presented his comments on this proposed construction. The Board
had questions as to the type of business that would be operating out of that
location. Mr. ? moved to recommend to the Council this Special Use Permit
be approved with the stiuplation that Mr. Short's recommendations be followed.
Seconded by ? . Motion carried unanimously.
LINDY - SPECIAL USE PERMIT - KENNEL LICENSE
This application is for a kennel Lim -s-e in a residential area. Mr. Lindy
lives on East Shadow Lake Drive, has four dogs in violation of the City
Ordinance which states a person may only have two dogs. Mr. Bathke noted
that he had a letter from the Police Department with a list of the complaints
filed against the animals owned by Mr. Lindy.
The Ordinance governing this matter was felt to be inadequate and there was
a suggestion that the Council amend this Ordinance.
Clerk's Note: The tapes are completely inaudiable and the following was
compiled on consulting with the City Administrator.
A motion was made and passed to recommend to the Council this Kennel License
be granted.
HAWKINS - FEASIBILITY PLAT.
This land is located on either side of Otter Lake Road at the junction of
County Road J. Mr. Hawkins had presented for informational purposes only.
The Planning and Zoning Board had no problems with this with the exception
of informing Mr. Hawkins that he would have to comply with the Shore Lands
Management Act and that all lots should be sized to comform to City Ordinance.
JULEEN - SIGN PERMIT
A motion was made and passed recommending approval of this sign permit with
the stipulation that Mr. Juleen present a sketch of this sign.
HELIN - KUETHER- SPECIAL USE PERMIT
There were several areas of concern with this proposal; 1)lack of bathrooms;
2) parking; 3) ingress and egress; 3) hours of operation;4) anticipated
number of patrons; and 5)adjacent land use. This will be returned to PIZ.
PUDWILL - LIEBERAM - VARIANCE.
Motion was made and passed to recommend approval of this variance with the
stipulation that the plans and specifications for the home be presented to
the building inspector and a permit be issued by March 23, 1981.
