HomeMy WebLinkAbout10/15/1980 P&Z MinutesOctober 15, 1980 Planning and Zoning Board The regular meeting of the Lino Lakes Planning and Zoning Board was called IIIto order at 7:45 P.M. Members present; Reinert, Doocy, Heath, Bathke. Absent: Johnson, Schwankl, Prokop. The first item on the agenda was approval of the September 17, 1980 minutes. Mr. Doocy moved to approve the minutes as presented. Seconded by Mr. Bathke. Motion carried unanimously. Mr. Schumacher reported on the actions of the Council in reference to the request of Mr. Aldridge for a special use permit for the construction of a retail plumbing shop in Carole Estates II. Mr. Aldridge had been asked by the Planning and Zoning to look for land in an area already zoned LI. Mr. Aldridge had failed to find any such property. The current ordinance does allow plumbing shops in a commercial district. The Council had requested the Plannin and Zoning to either approve this request or deny. The file on this action was discussed. The request for the Planning and Zoning Board to consider the request for a special use permit to allow a commercial building. The first it6,.j on the agenda was a request for a speical use permit from Mr. Ferry Malley. Mr. Malley lives in Lakeview Woodlands plat on Knoll Drive. His request is for a 40x64 pole building to be used for the use of working with his antique car hobby. This would enable him to have the cars at his home. This building would be used for a shop and storage. Mr. Malley pointed out that the building would not be visable from the street. Mr. Malley was asked if this was to be a metal building and he said, at the present time, Yes. IIIMr. Heath pointed out that the ordinance restricts a metal building to 150 square feet and the State restrict a detached building to 1000 square feet. He felt this City must abide by those restrictions. There is a house on one side of his lot and he has not discussed this with them. The other lot is empty at this time. There was some discussion of the possible use of the lands surrounding this property. Mr. Schumacher pointed out that the State Building Code states that any build- ing over 1000 square feet must be clasified as commercial. If a variance is granted, this would,in theory,be equivalent to a rezoning of this land. Mr. Malley was asked if he felt he needed a building this large. Mr. Malley said he hadn't really computed the needed footage, but he wanted it large enough to contain all his cars and parts. Mr. Heath said he would like to see the neighbors consulted and he was con- cerned with the restrictions of the State Building Code. Mr. Heath was also concerned over setting a precedent in allowing such a building in a residential area. He felt if one building such as this is allowed, there will be rash of requests for this same type of construction. Mr. Schumacher pointed out the reasons why this ordinance had been adopted - the existance of these building.4eliminates the commercial part -time businesses 410 creeping into the residential areas. Mr. Malley was asked if he would consider constructing a smaller building and he said he would consider this but would prefer this size. Planning and Zoning October 15, 1980 Mr. Bathke moved to recommend denial of this request. Seconded by Mr. Heath. 411 Motion carried unanimously Mr. Singer had also requested a variance, but this variance request has been cancelled per Mr. Singer. Mr. Schilling had requested a special use permit but he is not present at this point in time. Mr. Richard Matzke had requested a variance but he is not pressent. Mr. Aldridge was present to discuss his application for a special use permit. Mr. Schumacher pointed out that the Ordinance has been amended to allow retail plumbing shops such as Mr. Aldridge's in a commercial zone. This is a com- bination shop with some plumbing service being offered. Mr. Aldridge presented his site plans. It was pointed out that the first three lots have already been purchased for commercial useage. Mr. Schumacher said the parking is sufficient, the drainage has been provided, there is to be no exterior storage. Mr. Heath moved to recommend approval of this special use permit. Seconded by Mr. Bathke. Motion carried unanimously. Mr. Matzke was now present and his application for a variance was considered. IIIThis is for the construction of a storage building nearer the street than his home. This is necessitated by the location of his home and the growth of trees on the land. This building is to be a garage with the same type of siding as the home. Mr. Heath said he is familar with this and felt this is the best location for this garage. Mr. Bathke moved to recommend approval of this variance request. Seconded by Mr. Doocy. Motion carried unanimously. The special use permit application of Mr. Schilling was discussed. Mr. Bathke felt the information provided was inadequate. Mr. Schumacher said this is a preliminary proposal. Mr. Schilling arrived. A recess was 'called at this point in the meeting. The meeting was reconvened and Mr. Reinert requested the information from Mr. Schumacher on this application. Mr. Schumacher reported this is a five unit office building proposed to be constructed in Wollan's Estates in the commercially zoned area. Mr. Short had reviewed this and he recommended an additional 12 parkling spaces. This does not create a problem since there is plenty of room. The side yard set- back will have to be adjusted. There was a suggestion that perhaps it would be a good idea to leave room in the front of the building for a service street that could run to Main Street in the future. It was also suggested that all parking exit to Diane Street. This plat has been approved by RCWB and should have no problem with the drainage. Planning and Zoning October 15, 1980 Mr. Schumacher pointed out that this is within a plat that has just been approved and some of the items were provided within that plat. There was some discussion on the type of planting that should be done in relationship to the landscaping. This is required by the ordinance. Mr. Bathke moved to recommend approval of this special use permit with the stipulations that the buidling be moved, 8 additional parking spaces, and moved the building so the exit is on a 90° basis from Diane Street. Seconded by Mr. Doocy. Motion carried unanimously. Under new business, the Centerville Comprehensive Plan review. Mr. Short had submitted a letter with his review of this plan. The Planning and Zoning Board members took time out to read Mr. Short's letter. Mr. Schumacher asked if there were any negative statements that should be brought to the attention of the Council. Mr. Reinert pointed out the comment that the money from the sale of LaMotte Park should go toward the development of Centerville's new proposed park. Mr. Schumacher said the Council had discussed this at the last meeting. Mr. Heath felt that since the same person assisted in the preparation of both Comprehensive Plans, there should not be any areas of conflict. Mr. Reinert questioned item 6 - Mr. Schumacher said this has not been dis- cussed by the Council, but felt this could be an area of dissension. Mr. Bathke moved to recommend concurrance with Mr. Short's comments on the Centerville Comprehensive Plan with the exception of Item 6 on the last page, which says, "that Lino Lakes should continue to consider Centerville as a neighborhood service area for Eastern Lino Lakes and Lino Lakes should cooper- ate and encourage commercial and other intense land use to develop in Centerville's sewered area." Mr. Bathke felt this could be in conflict with the Lino Lakes plans for industrial development. Seconded by Mr. Heath. Motion carried unanimously. Mr. Heath moved to ajourn. Seconded by Mr. Bathke.
