.e„,az-et- Planning and Zoning Comission September 17, 1980 The regular meeting of the Lino Lakes Planning and Zoning Commission was called to order at 7:30 P.M., on September 17, 1980, by Chairman Reinert. 411 Members present; Doocy, Johnson, Schwankl. Absent; Bathke, Heath, Prokop. Mr. Doocy moved to approve the minutes of August 20, 1980 as written. Seconded by Mrs. Schwankl. Mr.Reinert objected to a statement on page 8, saying that Mayor Gourley wanted it a part of these minutes that he objected to the manner in which this meeting had been conducted. Mr. Reinert said he felt the meeting had been conducted according to Robert's Rules. He also wondered if this was what Mayor Gourley meant. Mayor Gourley said he had no objections to the way the minutes were written. Mr. Reinert objected to the statement that he had allowed a paid Attorney to speak at the meeting for the homeowners. He said he hoped that he could allow any one to speak at a public meeting. He asked that the statement that he believes in an open meeting and would continue to operate in that manner. 4==. ,9 -- or Mrs. Schwankl said she felt that she was on trial at that meeting she did not feel that it was proper for the Attorney to make accusation to this Board when they had no means of defending themselves. Mr. Reinert said he did not feel that he was being attacked. Mrs. Schwankl said that was exactly how she felt. Motion carried unanimously. Mr. Reinert asked for a report of the Council actions on the recommendations of the Planning and Zoning Commission. Mr. Schumacher presented this report. first item on the agenda was an application for a kennel license by Mr. *The Vernon Swanson for four dogs. Mr. Swanson lives at 6840 Sunset. Mr. Swanson said he uses these dogs for hunting purposes only - he does not plan on breed- ing. He said he has been in that location for 34 years and has had these dogs for that length of time. Mr. Doocy said Mr. Swanson lives only a block from hjm and he will verify what Mr. Swanson is saying. Mr. Doocy moved to approve the Kennel lice- for Mr. Vernon Swanson with the stipulation that no more than four dogs be kept at that location. Seconded by Mr. Johnson. Motion carried unanimously. The next item on the agenda was a request to move a house in Lino Lakes from one location to another by Mr. Barott. This home has been inspected by the Building Inspector and will provide pictures. The Mayor and one Planning and Zoning Board member will inspect this week end. This home is located in the Anoka -County Park property at 518 Aqua Lane. This home is to be moved onto 77th Street. Mr. Kluegel said this is a two story home, 17 years old, and structurally sound. It is being moved next to Mr. Chauncy LeVessuer home on 77th Street. This is an area of a mixture of older and newer homes of various styles. Mr. Doocy moved to approve the moving of this home. Seconded by Mrs. Schwankl. Mr. Reinert asked who inspected this with Mayor Gourley and Mayor Gourley said that he had been unable to contact anyone, so he had inspected this home alone. Iliayor Gourley presented his report to the Planning and Zoning Board. Mayor ourley had one concern - the siding is in poor condition visably. Mr. Barott said he plans to stain this or to rub it down with steel wool to retain the natural wood look - he not sure just what will be done as yet. Motion carried unanimously. Planning and Zoning Commission September 17, 1980 Page Two Attelge A special use permit request submitted by Mr. Aldrich was considered next. 0 Mr. Reinert read comments from the City Planner, Mr. Bill Short stating this is not consistent with the Comprehensive Land Plan. This plumbing type of business needs to have LI zoning and is not permitted in Commercial zoning. Mr. Short suggested this land be used as planned in the Compreh nsive Plan. Mr. Reinert felt that there was a number of things that need to be taken care of before consideration of this request. — -- Mr. Schumacher pointed out that many of these things have already been cleared. The drainage has been approved by the RCWB in the platting process. There is also sufficient parking provided. The access has been presented to the County Engineer and the access is located where the County Engineer recommended. Mr. Schumacher felt the major question is the Land Use Plan and the zoning. He felt there is a number of commercial properties in this area at the present time. Mr. Reinert felt that much time and money had been spent on formulating the Comprehensive Plan and he felt it is falling apart before it is even approved. Mr. Schumacher pointed out that the problem exists with the 300' commercial zoning along the highways - some of this land is proposed Res. in the Comprehensive Plan, however the commercial zoning exists at this point in time. This makes it difficult for the Planning and Zoning Commission as well as for the staff to give people the correct information. Mr. Schumacher suggested that perhaps a moratorium until the Comprehensive Plan is adopted. 411Mr. Doocy asked what the orginal plan for this plat was and Mr. Schumacher said the plat was residential with the lots facing Highway #8 in a commercial zone. Mr. Doocy asked if the applicant is the owner of this lot - Mr. Schumacher said he had a purchase agreement contingent upon approval by the City. Mr. Doocy noted that there is an Industrrial Park on Lilac - are persons being informed of this? MT. Schumacher felt it will be much easier to direct these persons once we have a zoning map. Mr. Doocy pointed out this special use permit is necessary under Ord. #56 which states that commercial buildings in an unsewered area must have this permit. This is the Ordinance the City is currently operating under. Mr. Reinert asked Mr. Aldr -iell why he hadn't look at the Industrial Park on Lilac and Mr. Aldrxah felt this location offered a better exposure to his business, which will include a showroom. Mr. Aldrich pointed out that the first few lots North of 77th are sold for commercial use. 4.1-Lo4?(D9€ Mr. Reine t t, j uestioned Mr. x-h about his locating in the Industrial Park and Mr. A-ldrich said he hopes that 95% of his business will be the retail sales, his actually operations as a plumber would be the installation of facets and items such as that. Mrs. Schwankl asked if the Board does not have to follow the current ordinance. Mr. Schumacher pointed out this is where the conflict exists. Ilihe general consensus of the Board was that the retail aspect of this proposal s permissable in this area - the Board was concerned with the actual plumbing operation aspect. Mr. Johnson moved to deny this special use permit request based on the comprehensive Plan and that there are no other buildings in the area. He said he is operating out of a residential area at the present time. Mrs. Schwankl moved that since this Board must operate under the current ordinance, she would recommend to the Council approval of this special use permit. Mrs. Schwankl's motion died for lack of a second. Motion carried with Mrs. Schwankl voting, No. /(L6P- =t:-:1<2 It was suggestedthat, if Mr. A1Ldi-c-1V finds appropriate lands, a special meeting would be called to consider this special use permit. The members present agreed to this proposal. A five minute recess was called at this point in the meeting. The meeting was called back to order and the next item on the agenda was the consideration of a special use permit for Lake Area Utility Construction Company. Mr. Reinert said there is material that has just been received this evening. Mr. Doocy moved to table this matter until the applicant is available to dis- cuss this with the Board and to forwa ;di to the company a copy of Mr. Short's letter. Seconded by Mr. Johnson. Motion carried unanimously. Mr. Schumacher presented Mr. Glenn Rehbein's request for a variance for the construction of his proposed garage. Mr. Rehbein is proposing solar heating. The variance for the construction of the garage is necessary due to the direction of the sunlight for winter heating and would be nearer the street than the residence. Mr. Johnson moved to recommend granting this variance. Seconded by Mr. poocy. Motion carried unanimously. Mr. Reinert said this Board has had some trying situations and he felt each IIIerson is an individual and each person /,as /is own opinion. He felt that he as as dedicated as any one, and he asked that a statement be in the minutes to the affect that/' person who sits on this Board can respect the opinion of another individual even though he doesn't agree with that opinion, because f,,does. He felt the community is growing and is in a transition period and there will be more conflicts. Mr. Schumacher said this is true - there had been a mis- take in the numbering. Mr. Schumacher noted that one of his priorities for next year is to get the ordinance codified.
