Park Board Meeting - December 4, 2000
Minutes
The December 4, 2000 City of Lino Lakes Park Board meeting was
called to order at 7:17pm, by Chair Lindy.
Roll call was taken, members present were Pam Taschuk, Paul
Montain, George Lindy, and Chris Welsand, Joe Boyle, Pat Huelman,
and Bill Kusterman.
Also present were Rick DeGardner, Public Services Director,
Sandie Wood, Office Manager.
APPROVAL OF NOVEMBER 6, 2000 MINUTES:
Paul Montain made a motion, seconded by Pam Taschuk, to approve
the November 6, 2000 minutes. The minutes were approved.
SETTING THE AGENDA:

season is scheduled to egin on December 16. Four shelters will
be supervised this season and two will be unsupervised.
Interviews are currently being conducted for attendant positions.
Chris asked how many residents participated in the Open
Volleyball program last week. Sandie advised 21 residents
participated in the program.
PARKS DEPARTMENT UPDATE:
Rick reviewed a memo from Mike Hoffman, Parks Supervisor, which
summarizes the maintenance highlights for November 2000. He
noted that installation of new out of play and players bench
fencing, bottom half of backstop, and ag -lime infield was
expanded at City Hall west softball field. Due to snow and cold
weather staff was unable to complete the over - seeding and

installation of players benches. This project will be completed
in early spring.
Rick stated staff replaced rink corners at Sunrise Park north
rink and Birch Park rink. Dasher boards were also added to the
ends and corner at these two rinks.
Rick noted that the hauling of fill and grading of the south
portion of Marshan Park also was completed.

• Park Development for Quail Ridge

Dear members of the Lino Lakes Park and Recreation Board:
We strongly urge you to complete planning AND construction of the Quail Ridge neighborhood park this year
(2001). This park would provide service not only for our neighborhood, but also for the neighborhoods along
Pheasant Run and Blackduck Drive that run to the north of Birch Street. The first houses in the Quail Ridge
neighborhood were started nearly EIGHT years ago. The northside neighborhoods of Blackduck Drive /Pheasant
Run were established even earlier. All of these residents have been without a park for long enough!
Currently, the nearest parks to these neighborhoods (which are Birch Park and Brandywood) require children and
their parents to both cross Birch Street and walk along its shoulder. This is a very hazardous situation for a number
of reasons. Cars moving along Birch Street at the posted speed limits are traveling at 50/55 mph; we all realize that
sometimes drivers are cruising even faster. Because of a small hill on Birch Street that is located just east of our
neighborhood, it is possible to begin crossing the road with no cars in sight and then to nearly be struck by one of
these drivers. (We are speaking from experience.) The recent "re- painting" of Birch Street means that pedestrians
are forced to walk not only on the shoulder, but also in defined turn lanes, further exacerbating pedestrian safety
issues.
Completion of the Quail Ridge Neighborhood Park must address the issue of safe access, be it by the originally
planned bridge(s) and trail (preferable) or an alternate trail access which does not require placing any children in
harm's way on Birch Street.
We are aware that a small (but vocal) minority in our neighborhood are opposed to reinstating the bridge and
connecting the trail. However, these individuals bought their lots and built their homes KNOWING that a park and
its associated access were in the plan. Indeed, the bridge itself was in place prior to these individuals closing on
their properties! Their initial opposition to the planned park included the following: 1) loss of trees behind their
homes; 2) potential for vandalism; and 3) bridge safety. With respect to loss of trees, the Park and Rec Board came
back with a park plan which incorporated a picnic area on the land parcel closest to these homeowners thus limiting
the number of trees to be lost. Regarding potential vandalism: Usage of the park by families would REDUCE the
potential for vandalism by making it difficult for vandals to accurately predict when the park and associated trail
might be in use. Lastly, the safety of the bridge(s) to access our park is paramount to ALL of us concerned --
residents and planners alike. The previous unsafe bridge has been dismantled and hauled away. We are confident
that a safe bridge can be designed, built and maintained.
There are MANY young children in our neighborhood of 30 -some houses (over 60 children under the age of 12).
And remember, this park would also service a LARGE population of residents along Blackduck Drive and Pheasant
Run north of Birch who also do not have a park. This park could be a place of community that bridges these
neighborhoods in our city.
Please be champions for our children and provide them the opportunity for a fun, safe place to play! Thank you for

SUBJECT: Review Preliminary Plat for Behm's Farm Park Addition
In July, 1999 the City Council authorized the sale of 2.55 acres of park land in exchange for
development of the remaining park area referred to as Behm's Park. This preliminary plat is for
nine single - family residential homes.
Since land dedication is not practical, staff is recommending cash dedication for the Behm's
Farm Park Addition as follows. Assuming land value of $27,000 per acre X 2.55 acres
$68,850.00. The current Park Dedication Ordinance indicates 10 percent of land dedication or
cash equivalent. Therefore, park dedication would total $6,885.00. Perhaps the park dedication
for this addition should be designated for the development of Behm's Park.

SUBJECT: Review Clearwater Creek Master Plan
Earlier this year the city obtained 5.5 acres of parkland in the Clearwater Creek Third Addition
for a neighborhood park. A meeting was held on November 6 to allow area residents an
opportunity to provide input on what amenities they would like to be considered for Clearwater
Creek Park. A follow -up meeting was held on December 4 to look at and comment on some
better defined scaled master plans.
Enclosed is the final draft of the master plan. Preliminary cost estimates are also included.
I am interested in hearing any comments or suggestions from Park Board Member related to this
plan. Jeff Schoenbauer, from Brauer and Associates, will be presenting the final master plan to
the City Council on Monday, January 8, 2001, at 6:30pm, in the Council Chambers.

SUBJECT: Consider Submitting Outdoor Recreation Grant Application for Development of
Clearwater Creek Park
The Minnesota Department of Natural Resources (The DNR) operates several financial
assistance programs. The purpose of the Outdoor Recreation Grant Program is to increase and
enhance outdoor recreation facilities. Eligible projects are for park acquisition and/or
development/re- development including picnic shelters, playgrounds, athletic facilities, trails,
boat accesses, fishing piers, swimming beaches, campgrounds, and others. This program is for
cities, counties and townships. The highest priority projects are for acquisition, development and
re- development of outdoor recreation facilities.
The Outdoor Recreation Grant Program is a very competitive program with hundreds of grant
applications submitted annually. Projects selected to receive a grant receive assistance of up to
50 percent of total eligible costs. These costs must be incurred and paid for before
reimbursement can be made. Therefore, if a grant application was submitted and subsequently
awarded, the City of Lino Lakes would need to commit 50 percent of the total project cost. This
would need to come from either the General Fund or Park Dedication funds.
If the Park Board is supportive of submitting an Outdoor Grant Application, I would discuss this
with the City Council at an upcoming Work Session.

• The party wagon was rented out just about every weekend during the summer. On several
occasions, the party wagon was rented out on both Saturday and Sunday. There were also

• This past year, the department saw a large increase in the number of registrations with our credit
card procedure. It is estimated that the increase was as large as 50% with people utilizing phone
in registration with credit card as the most popular registration choice. The department
established the credit card procedure four years ago and has been a popular payment option.

After three consecutive mild winters, it looks like we are finally going to get a real winter. The
cold temps of December have allowed us to put down a lot of water. Warming houses officially
opened on Tuesday, December 18.
Maintenance activities for December included the following:
• Daily rink maintenance — (sweeping, snow blowing edges, shoveling, flooding).
• Assisted Public Works with snow plowing of streets and parking lots.
• Trail plowing.
• Attended MTGF (MN Turf and Grounds Found.) Convention and Trade Show.
• Repaired or replaced benches at all shelter locations.
• Cleaning and maintenance of warming houses.
• Painting of interior at Sunrise Shelter.
A special thank you goes out to Esther Neu and her girl scout troop. They painted the
interior walls, doors, trim and benches then painted skating and winter scene
murals on the walls. It really looks great! Check it out.
• Ordered trees and shrubs for spring park plantings.
• Conducted employee performance reviews.
• Worked with irrigation contractor to develop designs for Marshan and Clearwater Creek Park
areas.

SUBJECT: Black Duck Drive Trail
After almost three years of discussion, it appears that a public trail at the end of Black Duck
Drive will finally become a reality.
The city has reached tentative agreements with the two owners at the end of Black Duck Drive
and the Reshanau Park Estates Homeowners Association (RPEHA) to provide a 15' wide trail
corridor. This trail will provide direct access to the Rice Creek Chain of Lakes Regional Park
Reserve and will connect to the existing county trail system. This trail will also permit area
residents to walk around Reshanau Lake.
This item is on the January 3, 2001 City Council Work Session. Assuming the Mayor and
Council Members are comfortable with the tentative agreements, I hope to have the trail installed
early this summer. The estimated project cost is $75,000.
The City Council has already designated funding sources for this project. I am in discussions
with the DNR to utilize the $30,000 Cooperative Trail Linkage Grant Award the city received in
1999. The designated funds for this project are indicated in the Park Dedication Fund Summary.

BACKGROUND
Qwest Wireless LLC has submitted a request for the City to rezone City Hall Park.
Qwest proposes to construct a 135 -foot high tower for antennae for wireless telephone
service. Such towers are not allowed in the Rural zoning district. City Hall Park
currently is zoned Rural. Towers are allowed in a PSP Public Semi- Public district.
Qwest has requested rezoning City Hall Park to PSP.
The Federal Communications Act of 1996 requires that t regulations "shall not
prohibit or have the effect of prohibiting the provisio �� '`erso wireless services."
The City must provide locations where a wirele pro an e facilities to provide
service. This does not mean the City must allo A , e , herever a wireless company

ANALYSIS

Federal Law: Section 704 of the Telecommunications Act of 1996 addresses
local zoning authority and provision of personal wireless services. Personal wireless
services includes mobile phones and pagers. The following summary is just that —a
summary.
The Act states that local zoning authority is preserved. However:
The regulation of the placement, construction, and modification of personal
wireless service facilities by any State or local government or instrumentality
thereof —shall not unreasonably discriminate among providers of functionally
equivalent services; and shall not prohibit or have the effect of prohibiting the
provision of personal wireless services.

In other words, the City must allow wireless providers to provide service. If there is a
gap in their coverage, the City must provide sites for filling the gap. The City cannot
allow one company to provide service while preventing a competitor from doing so.
Zoning: City Ordinance No. 01 -98 includes the requirements for towers in the
City. That same ordinance also made numerous amendments to the zoning ordinance to
describe which zoning districts will allow new towers, which allow antennas on existing
structures. New towers are allowed only in PSP and GI districts. Other districts allow
antennas on existing structures such as buildings and water towers, but do not allow new
towers. Also, there are some differences between requirements for wireless service
towers and towers for radio and television.
All new wireless communication towers must be monopoles. In addition, an applicant
for a new tower must demonstrate that the location of the new tower is necessary to
provide wireless coverage and that there is no existing structure that can accommodate
the antenna.

In the PSP and GI zones, a new er requires an administrative permit. This type of
permit was created by Ordinance No. 01 -98. It does not require a public hearing or
review and approval by the P & Z or the City Council. (The public hearing tonight is
required for the rezoning.) However, the rezoning hearing provides a good venue to
discuss the tower application, which is driving the rezoning request.
Tower Location and Description: The proposed location is in City Hall Park at
the corner of Main St. and Rondeau Road. The tower would be constructed next to the
hockey rink and the Public Works buildings. It will be designed to accommodate
antennas for two additional wireless providers, for a total of three.
The proposed tower will be 135 ft. high. The tower is approximately four feet in
diameter at the base and tapers to about two feet at the top. Several equipment cabinets
will be installed next to the pole. These cabinets will be about nine feet long and six feet
tall.

Several field lights now on a wooden pole would be relocated onto the Qwest tower. The
entire installation of tower and cabinets will be placed on concrete pavers that will cover
approximately 16'x 18'.
Necessity of New Tower vs. Utilizing Existing Structures: As stated above, an
applicant for a new tower must demonstrate that the location of the new tower is
necessary to provide wireless coverage and that there is no existing structure that can
accommodate the antenna. There are no water towers or existing towers in the northern
part of Lino Lakes. Qwest has explained that it needs a facility in the northern portion of
the City to provide service. The tower location study conducted by staff indicates no
nearby structures. The City's consulting engineer on this application has received more
information on Qwest's service needs and is analyzing this information. We will offer a
more extensive analysis for the P & Z at the meeting.
Assuming no existing structure will accommodate Qwest's service provision needs, the
City must consider what is the best site for a new facility. The proposed site is owned by
the City. The City will gain lease income from Qwest. The site serves as the Public
Works headquarters. A tower on this site will be less intrusive than on other sites in the
north part of Lino Lakes.

The zoning ordinance requires the Planning and Zoning Board to consider possible

Comprehensive Plan.
2. The proposed use is or will be compatible with present and future land uses of the
area.
3. The proposed use conforms with all performance standards contained herein.

overburden the City's service capacity.
5. Traffic generation by the proposed use is within capabilities of streets serving the
property.
Staff recommends finding that the project complies with the above factors. An ordinance

RE: Rezoning and administrative review application for a Personal
Communication Service (PCS) facility with a 135' monopole to be located on
City property at City Hall Park.
Qwest Wireless L.L.C. will be persuing a rezoning of City Hall Park located at 1189
Main Street, Lino Lakes. MN and an administrative permit for a communication tower.
BACKGROUND
To fulfill its mandate from the FCC, Qwest Wireless has developed a grid of antenna
throughout the service area. These facilities must be spaced, depending on certain
technical and geographical variables, at intervals approximately three to five miles from
each other and at a height of approximately one hundred and fifty feet to one hundred and
eighty -five feet. Rural areas have a lower user density; therefore towers can be further
apart and provide a larger coverage area.
The objective of the system is to provide wireless services to all Twin City area
communities. Since Qwest Wireless intends to utilize PCS as an affordable Wireless
Local Loop service, coverage at the neighborhood level is essential (unlike Cellular,
which typically focuses on mobile service). Our services are currently voice, but will
likely expand into data transmission within the next five years.
Given the size and magnitude of use of the Qwest Wireless system. there must be several
antenna facilities located in Anoka County for Qwest Wireless to provide service
throughout the community. As each additional facility is constructed, its location and
height become relatively fixed. This makes it essential to ensure that any newly proposed
facilities are at the proper heights and locations to allow them to "connect" and provide
seamless coverage between the existing sites. Because of this, the amount of

flexibility in the acceptable heights and locations of the remaining proposed facilities is
reduced. With these parameters in mind, we have identified the property located at 1 189
Main Street that meets the engineering requirements for the proposed site.
LOCATION SELECTED FOR PROPOSED US WEST PCS FACILITY
The proposed facility will include antenna configuration at the top of a 135 -ft. monopole.
The monopole will be galvanized in color and constructed to carry two additional
wireless carriers. The cabinets that house the electronics for the monopole at the base of
the facility will be no longer than 9 ft and no higher than 6 ft. The proposed facility does
not generate noticeable heat, noise, vibration, traffic, pollution, or waste.
Site construction and installation will not create a safety hazard or damage adjacent
properties in any manner. The size and location of the parcel of land on which the site
will be located more than adequately safeguards against hazards or possible damage to
neighboring property. Maintenance of the facility consists of routine checks by a
qualified engineer and occasional snowplowing. This imposes no additional risk to
adjacent landowners. Appropriate landscaping will minimize the visual effects of the
tower. In addition, upon cessation of use, the owner of the tower will have the
responsibility to remove the tower and the related facilities.
Finally, the proposed site meets the goals of the City's Comprehensive plan by:
facilitating wireless telecommunication, locating on a preferred land use area, minimizing
adverse visual effects, avoiding property damage, creating a structure where future
telecommunication companies may locate, operating in a manner that imposes no
additional health risks, and preserving the quality of living in the community. Qwest
will not create any additional public cost or service requirements. In addition, the
monopole will be tri- locatable (two additional
users, three total).
