Chuck Seykora: "I am an attorney from Coon Rapids. I am here representing the Whitcomb's, who are the owners of this particular piece of property. The Whitcomb's felt a little uncomfortable, in speaking in a public forum. so they asked that I present their views for you today. Naturally, they are supporting the plan that is proposed by Hokanson Development. They feel that it is a fair plan, and what they are offering to do. ...The Whitcomb's do have 125 acres. As you can see from the wetland delineations that came down, over 55 acres of that property is essentially not developable property. All the property on the west side has so much wetlands that you are not going to develop it into a plat." 5/4/94 Transcribed Park Board Minutes from Audio CassetteTapes: Marty Asleson (Park Board Director in 1994): "In trying to provide access to Birch Park , a boardwalk is being recommended from the development. It is all wetland between the park and the development. There is 250 feet of wetlands and a creek to cross. The (county) ditch is a vertical wall ditch. It's very deep in spots, about 4 -5 feet. It is a flowing ditch and in the wintertime, freezes on top, and still flows. It is a very hazardous situation. The park area is attractive for children and adults. They will want to go there, and cross people's backyards to get there, with or without the bridge in place. We have to provide an access." Kirk Corson (representative for Hokanson Development of Trappers' Crossing): "The area north of the development is not owned by us. We will need permission of the people (Whitcomb's) who own that land to cross it. This will have an impact on it. If you put an easement on it, the owner will be liable, if someone is injured. The 200 -plus feet of boardwalk will cost about $75/ft. — for a total of $20,000 to $25,000 to cross over. We are dedicating over $75,000. The hydrologist will recommend IllOtwo large box culverts, similar to what was done under Birch Street, to handle the capacity of the 100 - year flood. We are trying to work with the Park Board so that we have a safe access to the park. We want to know where the children are going to play. That is what they are recommending. They can walk right down across the boardwalk., and go into the park. We are talking about a little strip of maybe less than an acre." From 1994 — 1998: No city activity was initiated on purchasing the land and building the trail, due to the low volume of homes in Trappers' Crossing. May 1998: Due to the steep slope of trail corridor from Trappers' Crossing, the staff looks at alternative trail locations. February 1999: The staff determines there is not a suitable alternate trail location. March 1999: The staff sends a letter to Mrs. Whitcomb expressing the city's desire to acquire the strip of land to the park. May 1999: The staff is notified that all correspondence should be routed through the Whitcomb's family attorney, Chuck Seykora. January 2000: Anoka County Assessor indicates the value of the land is $500 per acre. A proposal is sent to the Whitcomb attorney to purchase 2 acres for $6,000 - -- significantly higher than the assessor's $1,000 value. November 2000: The city reaches a verbal agreement with the Whitcomb's to purchase 2 acres of land for $6,000. April 2001: Mr. Whitcomb informs the staff that they are no longer interested in selling the property to the city. June 2001: Park Board directs the staff to request the city attorney contact the Whitcomb's attorney regarding the acquisition of this essential trail connection. June 2001: Whitcomb's attorney informs the city attorney that the Whitcomb's decided to hold the property for a few years to make a determination whether to sell the 20 acres of land. July 2, 2001: Park Board directs the staff to determine estimated costs to condemn the property. July 30, 2001: The staff informs the Park Board that estimated legal fees for a commission hearing are $15,000. If the award is appealed, and assigned to a jury trial, the legal fees could double. Staff is directed to put this ,• item on the October 2001 Park Board agenda. Sue Walseth 3 • Summary: • In 1994, Hokanson Development refused to set aside any land from their 72 -acre residential parcel for a children's park, because it was too valuable. Instead, there were two alternatives: (1) provide a trail access to Birch Park, located north of Trappers' Crossing (2) use the facilities at a proposed athletic complex to be built on the corner of Holly Drive West and County Road J. o In the subsequent 7 years, the athletic complex plans have been relocated to Birch Street and Centerville Road Access to Birch Park is now the only park option available. • IS • When the lots were marketed for sale in both Trappers' Crossing and Gemini Estates, realtors bragged about children's accessibility to Birch Park It is not the residents' fault that the Whitcomb's now will not sell. The residents were promised a park — and the developers donated money for that specific purpose, in good faith — so the city will have to do whatever it takes (such as initiating a condemnation process) to provide a park. • Park dedication fees and trail access expenses: • In the 5/4/94, Park Board "minutes" (pages # 2 & 3), Hokanson Development was assessed $76,680.44 for its park dedication fee. In the 2/19/99 development agreement (attachment B), Gemini Estates was assessed $15,400 for its park dedication fee. This totals $92,080 from these two developments alone — and more developments are planned in this area. • In the 5/2/94 Park Board "minutes" (page # 2), it stated that it would cost approximately $25,000 to develop the trail to Birch Park In November 2000, the city would have paid the Whitcomb's $6,000 for the 2 acres of land. The 7/30/01 Park Board "minutes" stated that it would cost $15,000 to condemn the parcel for the trail -- $30,000, if it is contested. Expenses would total $46,000 out of the $92,080 park dedication money — using not even half of the developers' money dedicated to a park in our area. • The "minutes" state that legal fees would amount to $15,000 -- $30,000 if appealed. In the history of Lino Lakes using condemnation to acquire property, how many times have residents contested it? If it is not a common practice, then chances are that the legal fees in this case will be $15,000. • In the 7/2/2001 Park Board "minutes" it was determined that the city needed an acre or less for the park access. If the property was appraised at $500 an acre by Anoka County, then if the city uses condemnation to acquire it, they should pay $500 or less for that lacre or less of land needed — not $6,000, which was their prior offer. It is my opinion that since the Whitcomb's refused the generous $6,000, that amount should be withdrawn. • In the 7/2/01 Park Board "minutes "(page 7) `Bill" asked about "infringing on the property owners rights to make other residents happy." • The property owners' rights are not being infringed upon. At the 5/4/94 Park Board meeting, Ms. Jeanne C., daughter and legal spokesperson for the Whitcomb's stated that her parents would provide access to Birch Park, to accommodate the approval of the Trappers' Crossing, and practically begged the city to buy that strip of land and more. Motion was made to purchase the required property from the Whitcomb's (page # 3). • The Whitcomb's were very willing in 1994 to sell the needed land strip for park access, during the numerous city discussions, regarding the city's approval of Trappers' Crossing. Now it seems that after they received their money from the developer for their 72 acres — and Trappers' Crossing is nearing completion, they change their mind. With hindsight, it appears that they said whatever they needed to, to persuade the city to have Trappers' Crossing approved, so they close their land deal. Sue Walseth 4 • With hindsight, the city should have purchased the land in 1994, when the Whitcomb's were "pushing" the city to buy their land. Now because of extended city delays, the Whitcomb's have reversed their decision. • Regarding the 7/30/01, Park Board meeting "minutes" (page 5) - - -it stated that " staff did not feel comfortable in identifying possible land value impact on the remaining property." • The land needed for the park access is wetland, and not buildable. Hokanson Development intentionally didn't include that portion, as part of his land purchase in 1994 — in fact the border on the northwest portion of Trappers' Crossing (where this park access is located) is intentionally cut off diagonally to eliminate the worthless wetland there. • This park access is land - locked and will never have access to any road. Because of this parcel's location and topography, there is no negative impact on the other 20 acres, which is part of the same extensive wetland. The majority of the 20 acres is wetland. It is not in MUSA and zoned rural. The park access is part of a triangular wetland peninsula that sticks out from the main 20 acres. • The Whitcomb's no longer live in Lino Lakes, and have NEVER used this portion of their property for anything, because it was too wet for farming and too swampy for cattle grazing — in all the years they have owned it. This property was not adjoined to their prior homestead on Holly Drive. Lino Lakes has been willing to condemn other properties in Lino Lakes that are direct parts of residents' homesteads, so why is there hesitation in this case? • I have lived on Holly Drive for the past 17 years. In all these years, experiencing different weather conditions, involving excessively wet or dry winters and summers — I have never ever seen as much water in that 20 -acre parcel as was present this spring — it was literally a lake where you could canoe between the trees. I believe it has been due to the water runoff from all the residential developments along the County Ditch from the Birch Street area and Trappers' Crossing and Gemini Estates. This higher water table makes the 20 -acre parcel even less attractive for development. • In regards to a resident survey being required, regarding the park access: When Trappers' Crossing was platted in 1994, there was always a trail access drawn between homes on the north cul -de -sac of Trappers' Crossing. So before a single home or road was even built in that area, all affected residents should have been legally informed of the trail, when the property was purchased, prior to closing on their homes. Both adjoining property owners to the trail corridor support the trail — along with most of the other occupants in Trappers' Crossing — who signed the park trail petition. • There are valid safety issues concerning the lack of a park: o Presently, if you drive around Trappers' Crossing and Gemini Estates you will see all the children playing in the streets, because there are no parks in the area. o Some children have balanced primitive narrow boards across the wetland area and county ditch, to have a makeshift access to the park. The city has no control over this, because the boards could be removed by the city, but how long before other replacement boards are reinstalled? o Birch Park is so visibly close to both Gemini Estates and Trappers' Crossing. In the winter, the floodlights from the hockey rink, light up all the yards of the properties on that north end of these developments. It can be easily seen — but yet "is so far away, and inaccessible, except by driving a car over a mile on surrounding roads, to reach it. 12`h Avenue and Holly Drive are too narrow and unsafe for riding bikes, because they have Sue Walseth 5 no trails, nor shoulders. And there is no trail along Birch Street from 12th Avenue to D.Erickson 2nd Addition — and Birch Street has heavy traffic. • I have been waiting since 1994, for this park access to become a reality. My kids were still in Centerville School. But so many years have gone by, my kids are now grown up and in college, without having this park access trail available to them. Fortunately we had 5 acres of land for them to romp on. Right now, there are many young children in the area, living on small residential lots.. Please don't procrastinate for years again, so that these Trappers' Crossing children all grow up, without having a park available — and then when it finally built, these children will be too old, and no longer interested in playing in parks. • The city is reluctant to spend $15,000 in a condemnation process so that Trappers' Crossing will have a simple park access to `Birch Park" — yet will spend $20,000 and $125,000 for other subdivisions. Our developments on Holly Drive contributed over $92,000 in park dedication, but we still have no park!!! • A new "skate board" park is being installed at "City Hall Park ", which was planned in 1998. The trail to `Birch Park" from the north cul -de -sac in Trappers' Crossing had been approved in May 1994 — 4 years earlier. The Fall 2001 Lino Lakes Quarterly Newsletter stated that the 'Park Board" committed to purchasing $20,000 in skate board equipment. So where does the "Park Board" get their money? From the pool of park dedication fees contributed by developers — of which our neighborhood donated $92,000 — and can't even get a trail access? • In the same Fall 2001 Lino Lakes Quarterly Newsletter, it stated that Clearwater Creek subdivision, which was approved about a year -plus AFTER Trappers' Crossing - -- was awarded a $125,000 DNR Outdoor Recreation Grant for the development of "Clearwater Creek Park." The article stated that the city must match $125,000 in order to receive this grant. It stated that this $125,000 will consist of funds from the "General Fund" and again the "Park Dedication Fund" and a possible future bond referendum. • • • Park Board Meeting - July 30, 2001 Minutes The July 30, 2001 City of Lino Lakes Park Board meeting was called to order at 6:30pm, by Acting Chair Taschuk. Rick advised the rails are 18" off the ground. The park will be considered a Tier 1 facility because nothing will be more than three feet off the ground. DISCUSS DNR GRANT AWARD ($125,000) FOR DEVELOPMENT OF CLEARWATER CREEK PARK: Rick advised the City of Lino Lakes has been awarded a Department of Natural Resources Outdoor Recreation Grant for the development of Clearwater Creek Park. The $125,000 grant award will be used to develop various amenities in Clearwater Creek Park. PARKS DEPARTMENT UPDATE: 4 Park Board Meeting - July 30, 2001 Minutes Rick reviewed a memo from Mike Hoffman, Parks Supervisor, which summarizes the maintenance highlights for July 2001. Rick noted July activities included irrigation system maintenance and repair that mainly entailed cleaning or replacing heads and resetting heads to proper grade. The irrigation has been installed at Marshan Park and staff hopes to seed in mid - August. Rick noted City staff poured three concrete pads and installed two benches at Clearwater Creek Trail and one at City Hall Park playground. There have been some issues I want to make sure the Park Board is aware of. At the September 10 City Council meeting, the resident located west of City Hall Park expressed concern regarding the noise generated by users of the skate park. I indicated that the city had been planning on installing a wooden fence along the western edge of the skate park to help minimize the noise. We subsequently installed the 80'x6' high privacy fence as well as several Norway Pines and shade trees around the skate park area. The area around the pad has also been seeded. The adjoining property owner also feels the skate park is an attractive nuisance and is just a passing fad. I expressed my disagreement of his assessments. We have experienced some vandalism at City Hall Park. Last week two slides were damaged and need to be replaced. An article in the Quad also identified issued issues with the skate park in Centerville. To date, I am aware of one serious injury. The police department has been very helpful in patrolling the area. Officers have encountered several situations of juveniles not conducting themselves appropriately (i.e. climbing on warming house roof, riding bikes on ramps, etc.). Staff is continuing to monitor the new skate park. I will keep the Park Board Members informed of any new developments. Mr. Vaughan's proposal is to provide the grading and necessary fill. The city would be responsible to pay for legal expenses, a culvert, Class V, bituminous, and engineering necessary to complete this project. Park dedication for all phases of Pheasant Hills amounts to $110,240 plus the three acres of land which is currently identified as Pheasant Hills Park. Estimated costs of existing park and trail improvements including playground, overlook sitting area, and basketball court amount to approximately $50,000. The cost estimate for the Timberwolf Trail connection is $45,000. Future park and trail improvements include the bridge and trail directly north of the playground equipment. The estimated future park improvements amount to $40,000. I feel this trail connection would provide a tremendous benefit to residents in the Pheasant Hills Development. I certainly support working with Mr. Vaughan to acquire a trail easement and allow him to perform the grading work. The city would then have to commit to funds to complete the trail segment which may include park dedication funds, general fund dollars, or future bond referendum. Timberwolf Trail The trail segment from Timberwolf Trail to the Regional Park Trail has been encountered a few obstacles. Staff is attempting to resolve the issues to permit grading activity to begin yet this fall. Clearwater Creek Development There are two trail segment that have been damaged due to construction traffic. The adjoining property owners and developer have been sent letters indicating the city's position that the damaged trail segments must be replaced yet this fall. Centennial Middle School Trail A few weeks ago there was an incident in which two bicyclists collided near the extreme western portion of the trail. Staff has since installed cautionary signs indicating the limited visibility near that particular trail area. RD:sw sw /parkbrd/meeting information/9 -01 Trails Update.doc Popular playground activity - Drip, Drip, Drop Lino Lakes Parks and Recreation Department Program Highlights - September Park Board Update YOUTH Summer Playground Program: 266 children were registered full -time in the Summer Playground Program this year and 138 children participated in the program through our $3 daily rate option. Options: 57 youth participated in the Options program this summer which ended on August 17. We received many positive comments from parents and staff about the summer and many hope to return next summer. Sensational Summer Adventures Day Camps: Our collaborative day camps with Anoka County went very well this year. Sixteen 6th and 7th graders participated in our High Adventures camp and 34 - 1st through 3rd graders participated in our Adventures camp. The camps consisted of field trips to a variety of educational and recreational sites. We plan on offering both camps again next summer with the possible addition of a camp for 4th and 5th graders. Youth Instructional: Our fall programs will be starting soon. We are currently accepting registrations for Dance, Floor Hockey Mini Camp, Soccer Mini Camp and Toss, Kick and Catch. A few classes have filled already and many are close to being filled. 1111Fall Soccer: Fall soccer is a big kick with our participants. This year we have approximately 625 participants on 46 teams. The number of participants in this program has stabilized. Tackle Football: Approximately 350 children are participating in this new program. This is up from 219 players last season when the program was operated by a local association. CLUBS "WAFD" Trips: Two field trips are planned for the MEA break. "Fall Harvest Fun" (a trip to Afton Apple Orchard for apple and pumpkin picking) and "Science Museum." ADULT Fall Softball: The season concluded in September. 26 teams participated in this five -week season. The combined total of adult softball teams for summer and fall was 74. This is fewer teams than in the past. 2000 "Fall Harvest Fun" 3- Player Basketball: 6 teams are currently participating in this program. This is lower than past years, but still strong. SPECIAL EVENTS Family Turkey Shoot: This year's event will be held on Saturday, November 17. We are currently "hunting" for volunteers. When last I wrote we were experiencing an extremely hot, dry July. Today as I drove in to work the temperature on the bank sign read 36° F. Fall has definitely arrived. Maintenance activity during August and September have included: • Mowing of Parks and Athletic Fields With the return of cooler temperatures and wet weather our grass has been growing like crazy. With most of our seasonal staff back to school keeping up with the mowing has been a challenge. • Ballfield Preparation Fall softball will conclude this week. • Fall Soccer Program This program is in full swing. Maintenance activities for the soccer program have consisted of: • Layout and painting of nine fields. • Delivering and anchoring goals to each field location. • Weekly line mow -ins and line repainting when needed. • Fall Football Program Maintenance for September has included layout and painting of two fields, weekly line mow -ins, and repainting as needed. • Lino Park Warming House The interior and exterior of the building have been painted. The exterior trim will be completed this fall. • Rice Lake Elementary Field #2 Improvements to the players bench area have been completed including concrete pads and aluminum player's benches with backs. • Marshan Park Seeding The south half of Marshan Park is now green and appears to be filling in nicely. Work performed on this project has included the following: • Two chemical applications (Roundup) to kill existing vegetation. • Tilling of entire south half of park. • Installed drain tile in trouble spots. • Final seed bed preparation (dragging and leveling). • Brillion seeded south half, slit seeded north half with Athletic Pro II seed mix (750 lbs. total). • Hand seeded native prairie area between trail and townhomes to the east. • Applied two applications of 13 -13 -13 since germination. • Programmed and adjusted irrigation system as needed. As you can see a lot of work goes into the seeding of a new park area. We anticipate cutting the south half for the first time later this week. We also hope to spray for broadleaf weeds later this fall, time and weather permitting. • • City Hall Skate Park Work for the project has included: • Installation of 60'x80' bituminous pad (contracted). • Assembly of skate park equipment. • Installation of 80'x6' high privacy fence along west edge of pad. • Site preparation and seeding of area around pad. • Planting of 6 Norway Pine and 11 shade trees around skate park area. • Hazard tree removal from Sunrise Park (contracted). • Country Lakes Park Removed old sign and prepped site for new sign and landscaping. • Trails Flail mowing and brush trimming of trail edges. He noted Summer Playgrounds will begin on June 18. Preschool Playtime registration has reached capacity - both classes are full. • • The Options Program is close to filling. The maximum is 60 participants and registration is currently at 58. Softball registration is consistent with past years. Rick noted the Summer Activities Guide was mailed out to residents the last week of May. Also, Kite Day was held last Saturday. PARKS DEPARTMENT UPDATE: Rick reviewed a memo from Mike Hoffman, Parks Supervisor, which summarizes the maintenance highlights for May 2001. Activities have included daily ballfield preparation and soccer field maintenance. A Girl Scout project included an entrance sign at Sunrise Park and the exterior painting of the Sunrise Park warminghouse. Rick added there has been extensive park tree planting and the Department purchased a JD4100 Tractor for the primary ballfield groomer. Pam asked if the City maintains the fields at Centennial Middle School. Rick advised the City does maintain the soccer fields at Centennial Middle School. The new school is proposed to the east and north of the Middle School. NEW BUSINESS: None OLD BUSINESS: Trapper's Crossing Trail Update - Rick advised the City has attempted to secure a trail connection from the Trapper's Crossing Development to Birch Park for several years. In November 2000, the City reached an agreement with the Whitcombs to purchase two acres of land for $6,000. After several unsuccessful attempts to schedule a closing date, staff was notified that the Whitcomb's have decided not to sell the two acres of land to the City. Mr. Whitcomb indicates that if and when they decide to sell their land, they will sell the entire 20 -acre parcel as one piece. It appears that the important trail connection to Birch Park will not happen in the near future unless the Park Board and City 4 • • Park Board Meeting - June 4, 2001 Minutes Council feel it is necessary to begin condemnation proceedings. The Park Board will be notified if the Whitcombs decide to sell their property. Paul asked if Rick had spoke with Mr. Whitcomb. Rick advised the Whitcomb's attorney had left a message indicating Mr. Whitcomb is not interested in selling any property at this time. Chair Lindy stated the two acres the City was looking at are at the edge of their property and is wetland. The purchase will not land lock their existing wetland. He stated that sometimes condemnation is the only way the City can proceed. He stated he does not believe that two acres is critical to their property. Chris inquired about the type of trail that would be used to access the park. Rick advised a combination of boardwalk and bituminous. The Park Board has designated $15,000 for the project and another $40,000 for the trail. Pat stated condemnation may get the ball rolling for more discussions. It is possible to even cut the purchase to one acre for adequate access. Rick stated the City was open to just an easement for access. The Whitcomb's indicated they wanted to sell two acres. It is possible to reduce the request to one acre. Their remaining land would not be land locked. Paul stated he sees the urgency for the trail but he is not comfortable with condemnation due to the Whitcomb's being long time property owners within the City and their age and health. He indicated he would be more open to condemnation when their daughters own the land. Chair Lindy stated the condemnation does not have to be a confrontational procedure. He stated the issue should be discussed further. Chris asked if it is possible to discuss the purchase of only one acre or an easement with the property owners. Chair Lindy stated the issue is that the Whitcomb's are trying to sell the full 20 acres of useless land. Bill added it might make sense to increase the purchase offer because the condemnation process is expensive also. 5 • • Park Board Meeting - June 4, 2001 Minutes Paul stated money is not the issue. The property owners see the property more valuable if it remains a 20 -acre parcel. He suggested there may be other options such as the City Attorney writing a letter to their attorney. The Park Board directed Rick to discuss with the City Attorney the possibility of sending a letter to the Whitcomb's attorney regarding the three options: City doing nothing, pursuing the purchase as proposed, or condemnation. Review Park Dedication Fund Balance - Rick referred to an update Park Dedication Fund Summary noting the following items: * Received $61,840 from Trapper's Crossing Second and Third Additions. • Total undesignated funds are $89,330 ($164,330 - $75,000). Bond Referendum Update - Rick advised that several documents pertaining to a potential referendum were reviewed and discussed at the April 2, 2001, Park Board meeting. Items included were Resolution 97 - 30, Council support to referendum, the referendum process overview, various Park Board meeting minutes, Spring, 1998 article in City Newsletter, program statement /cost analysis, estimated annual tax impact analysis, and check list for a successful referendum. The City Council discussed a potential bond referendum during the May 16, 2001, Goal Setting meeting. There was some interest to consider a possible bond referendum next spring. Staff and City Council will continue to consider a potential referendum next year, a commitment of General Fund dollars for a special election, informational materials, and consultants would need to be included in next year's budget. Rick stated he will keep the Park Board informed as discussions related to a possible bond referendum continue. Chair Lindy asked when the upcoming budget meetings will be held. Rick advised the meetings are currently on hold due to the legislature. Chair Lindy stated the Council needs to be aware of the time that it takes to prepare a referendum. Rick stated he believes the Council is receptive to a referendum. The question is when to • pursue it and the challenge will be determining how much of a referendum the City will pursue. 6 • Park Board Meeting - July 2, 2001 Minutes Acting Chair Huelman suggested the park tour include the skate park if progress has been made with the project. OLD BUSINESS: Birch Park Trail Update - Rick advised at the June 4, 2001 Park oard meeting, Park Board members directed staff to discuss with the City Attorney the possibility of contacting the Whitcomb's attorney regarding the procuring a trail connection from Trappers Crossing Development to Birch Park. As requested, City Attorney Mr. Hawkins contacted Mr. Seykora. Mr. Seykora indicated the Whitcomb's originally planned to sell the 20 acres of land to a developer for a good price. However, the Whitcomb's decided not to execute the agreement due to tax and capital gains implications. The Whitcomb's have decided to hold the property for a few years to make a determination whether to sell it. The Whitcomb's are concerned about carving out some land for a trail connection since it may have an adverse affect on the potential development of the remaining land. Therefore, the Whitcomb's are not receptive to selling property to the City at the present time. • It appears the City is faced with two options. First, the City can wait until the parcel of land is sold to a developer and subsequently receive the necessary strip of land to fulfill park dedication requirements. Secondly, the City can pursue condemnation proceedings. A layout of the entire property would need to be done to determine if any land condemnation would affect the remaining parcel. This may result in the City compensating the Whitcomb's for an amount significantly higher that the value of the land. • Paul inquired about what the City Attorney meant by significant costs. Rick stated that because the Whitcomb's intend to sell the entire 20 acres to a developer, the cost for the strip of land may include more than just the land value because it breaks up the 20 acres. Acting Chair Huelman suggested the City get an easement from them and then the developer would get credit for that meeting the park dedication requirements. Rick stated the Whitcomb's also have concerns about an easement because of the effect it may have on the remaining property. Chris inquired about the process and cost of condemnation. Rick stated condemnation takes 120 days after the City Council's approval. The cost of the process varies. 6 • Park Board Meeting - July 2, 2001 Minutes Paul noted that once the land is condemned, it can be built on and no time is lost. The only remaining question is the value of the land. He suggested the possibility of developing another park for the property owners to the south. Rick stated the Comprehensive Plan shows that are in the Phase 2 or Phase 3 Growth Stage. Chris clarified that the City does have funds set aside for the development of the trail. Paul requested staff investigate the costs of condemnation and the City Engineer look at the impact on the remaining property. Acting Chair Huelman stated the City only needs an acre or less and the City Engineer should look at the assessment of that one acre. Rick stated City staff's opinions may be very different from that of an expert. Bill asked if there is any way to gauge the feelings of the residents in this area relating to condemnation. Rick indicated a survey would have to be sent out. Bill expressed concern about infringing on the right of the • property owner to make other residents happy. • Paul noted staff may find the cost of condemnation is prohibitive. Paul Montain made a motion, seconded by Bill Kusterman, for staff to investigate the cost of condemnation and the impact on the remaining property. Motion carried. Spirit Hills Update - Rick advised the City Council approved the preliminary plat of the Spirit Hills Development at the June 11, 2001 City Council meeting. The park dedication will consist of 100 percent cash. Therefore, the park dedication will consist of 51 lots at $1,665 = $84,915. Paul inquired about a County trail continuation from Centerville into Lino Lakes to Minneapolis. Rick advised he has not heard about any progress relating to a County trail connection through the City. Paul stated he was told that the trail is definitely going to connect with Lino Lakes and into Minneapolis. 7 • • Park Board Meeting - July 30, 2001 Minutes summarizes the maintenance highlights for July 2001. Rick noted July activities included irrigation system maintenance and repair that mainly entailed cleaning or replacing heads and resetting heads to proper grade. The irrigation has been installed at Marshan Park and staff hopes to seed in mid - August. Rick noted City staff poured three concrete pads and installed two benches at Clearwater Creek Trail and one at City Hall Park playground. NEW BUSINESS: Community Service Award - Rick indicated a memo was previously distributed regarding the Community Service Awards. The Administration Director is asking for a volunteer from each City Board to determine the award recipients. Acting Chair Taschuk stated she was on the committee last year. One meeting was held and the committee reviewed the nominations and determined the recipients. She indicated she would be on the committee again this year. Bill stated he would like to volunteer to be on the Community Service Award Committee. It the was the consensus of the Park Board to have Bill Kusterman represent the Park Board on the Community Service Award Committee. OLD BUSINESS: Review Possible Condemnation Costs for Birch Park Trail - Rick stated that after extensive discussion at the July 2 Park Board meeting, City staff was directed to investigate the cost of condemnation and the impact on the remaining property. Discussions with the City Attorney indicate approximate legal fees for a commission hearing of $15,000. If the award is appealed and subsequently assigned a jury trial, legal fees could double to approximately $30,000. Obviously, this is in addition to any cash awards to the existing property owners. Staff was also directed to determine the impact on the remaining property. Since this is somewhat subjective process and the commissioners are much more versed in determining land values, staff does not feel comfortable identifying a possible land value impact on the remaining property. Bill asked if the City has received bids for the Pheasant Hills Trail. Rick stated the specs will be ready for bid in two weeks. 5 • • • Park Board Meeting - July 30, 2001 Minutes Paul reviewed the background of the issues relating to the Birch Park trail. He stated the City is in a real dilemma and the Park Board needs to discuss this issue further. Acting Chair Taschuk asked if this issue can be put on a future Park Board meeting agenda. Rick advised he will put the Birch Park Trail issue on the October 2001 Park Board meeting agenda. This award is designed to recognize individuals who have made a significant contribution to the community. Dr. Lindy, a Lino Lakes resident for 24 years, has served as a member of the Park Board since 1980 and has served as chairman for the past 12 years. During this time Dr. Lindy has provided hundreds of hours of his time through many many meetings guiding the city through one of the finest park and recreation programs in the northern suburbs. In addition, through Dr. Lindy's leadership and foresight, he helped put in place a trail system that will serve Lino Lakes citizens for years to come. Planning and developing is only one part of Dr. Lindy's efforts. He has also worked with an eye on the future to make sure future space will be available for public parks and recreation use as Lino Lakes grows. Not all citizens are willing to serve as tirelessly as Dr. Lindy has in an unselfish way for the benefit of all the citizens who live in Lino Lakes today and in the future. RD:sw sw /parkbrd/meeting information/ Dr. George Lindy, Community Service Award Recipient • Park Board Meeting — September 4, 2001 Minutes The September 4, 2001 City of Lino Lakes Park Board meeting was park tour and BBQ. Members present were Pam Taschuk, Paul Montain, Pat Huelman, Bill Kusterman and Michael O'Connor. Members absent were Chris Welsand and George Lindy. Also present were Rick DeGardner, Public Services Director and Sandie Wood, Public Services Office Manager. Members met at Paul Montain's home at 5:30pm and went on a tour of City Hall Park (skate park), Marshan Park, Sunrise Park, and the Trappers Crossing area where a trail would like to be put through to Birch Park. Members had questions pertaining to the usage of the skate park, the turf at Marshan Park, and the property by Trappers Crossing. Rick responded to all the questions. Members really enjoyed the tour. They feel it is very informative to visit the parks and see the improvements that have been made. After the tour, everyone met for a BBQ at Paul Montain's home.
