ADJOURN • • Agenda Item 5A Environmental Board Meeting Date: July 31, 2002 Topic: Behm's Century Farms /6th through 10th Addition /Preliminary Plat Review Background: The Environmental Board has reviewed this area in the past. Behm's Century Farms 6th through 10th Additions is one of the areas excluded from the Residential moratorium. Mr. Gary Udhe submitted a Preliminary Plat for review on July 15, 2001. Behm's Development is located in Section 7, with Lilac Street on the South, 4th Ave on the East, Sunset Ave on the West, and Main Street on The North of this Section. Attachment 1 Analysis: Attachment 2 shows the MLCCS and AES Ecological land descriptions for this area. Superimposed on the MLCCS is the lime green area showing a 3f, or Mesic Forest classification. The MICCS shows an Oak Forest dry subtype. In the field a few years ago, Steve Apflebaum described this area as a Mesic Oak Savanna. Mr. John Johnson has indicated the areas observed during this field trip as the areas in white with the lime green boarders. Another significant area observed at the time was the wet meadow area on the NW side. At that time, we had a lengthy discussion about restoration opportunities associated with development. There have been no unique wetland species found on this site. For the most part, the soils are hydric in the proposed phases of Behm's. Mr. Johnson has completed extensive analysis of the soils /water relationships in this area and will be there to report his findings. The development site is agriculturally ditched and flows to CD 10, and ultimately to Marshan Lake. Wetland delineations are depicted in blue on Attachment 4. Park, Greenways and Trails have not yet been defined. Rick DeGardner, John Johnson and I, intend to get together to discuss. Rick needs at least 4 acres of contiguous open space for active park needs. How this can be worked into the greenway issue will be discussed at the meeting. Please refer to the Attachment 3 for general greenway concept. The Area shown as Outlot B on Attachment 4, is an area that is a mosaic of wet and dry landforms. Mr. Johnson has indicated that the Rice Creek Watershed has agreed that about 50% of this is wetland. Tree preservation has not been resolved. There are many trees on the site. The Oak Savanna areas should be looked at for preservation as well as any woodland areas that can be matched into a grade plan for preservation. Options: Open for Comment Recommendation: 1. Detail a Tree Preservation Plan. Focus on Oak Savanna Areas and general Landscape /grade plan that preserves as much as possible of the remaining trees. 2. Preserve wet meadow area. 3. Buffer important resources /Native plantings in buffer areas and created pond and infiltration area. Signage indicating areas protected. 4. Control covenants or device to prevent destruction of buffers. 5. Maintenance schedule for buffer areas. 6. Sequencing plan that would protect all soil, wet and buffer, and tree areas during construction. 7. Detail a plan that sequesters parkland and greenway /trails. Rd. 23, Preliminary Plat Review /Re- Submittal Background: JADT submitted proposal earlier and this plan was re- submitted after staff input. Please see Attachment 1 for Original Submittal. The Environmental Board did look at the site without a specific plan proposal in 1998. Please see Attachment 2. Although the Memo on Sept 24, 1998 is Titled "McDonalds ", it is obvious that the Board was reviewing the entire JADT site. Analysis: In 1998, the City negotiated a tree for tree replacement agreement on this site. The Tree Inventory for this site indicated 454 significant trees on the JADT site. There were many smaller trees, particularly Oak trees on the McDonalds site. Today there are 23 or 24 significant trees left. See Attachment 1 (yellow line around trees). The new plan calls for the removal of the group of trees in front of the "V" shaped building. There are four or five trees left here. We have received no significant tree /soils /protection or sequencing plan. There appears to be no possibility of joint parking between Target/Kohl's and JADT. This is unfortunate because the JADT site appears to be very small for the facilities that are designed in the plan. A Landscape Plan is submitted. The landscape plan as it stands needs some revision. Trees lined on Apollo drive should be changed to Oaks, so they are similar to the McDonalds site. Crimson King Maples and Schwedler Maples should be changed to oaks. Adjacent to the Freeway, Colorado Blue Spruce should be changed to White spruce, and Scotch pines to Austrian (salt tolerance). The dwarf cranberries should be changed to Highbush cranberries if screening is an issue. Ground seeding in drainage, buffer and swale areas should use the same seed schedule as Target/Kohl's (Attachment 5). There is no irrigation in the plan. This needs to be submitted for areas of all plantings other than native planting areas. It is strongly advised the Developer hire a competent landscape company to install all Native areas and maintain them for the first 3 to 5 years. It is hard to tell what the "V" shaped building has in front of it for surfacing. This should be a pervious type paving if possible. It appears there are yellow twig dogwoods planted in this front area. I suggest that several tree - planting grates be installed here. Burr or Swamp white oaks should be placed here. The Surface Water /Mitigation Plan was previously approved by RCWD. Since we required sequencing and protection of the resources (soils, water infiltration areas, and trees) from Spirit Hills, McDonalds and Target, we should ask the same from JADT (attachment 4). A BMP plan was also submitted from Target (Attachment 3). JADT should duplicate this or work jointly with Target/Kohl's. Options: 1. Approve 2. Recommend Denial 3. That consideration is given for the establishment of berms between the woodland to the east and the road for the purpose of slowing water runoff and increasing infiltration. 5._ That woodland areas circled on attached map be considered for preservation purposes. 6._That consideration is given to the over -all grade plan and the possibility of eliminating the storm pipe from the bituminous area on the west side of the building, and that consideration be given to surface draining water from the site through berm/woodland area. 7.—That consideration be given to minimizing advertising, sign light spillage and that options be explored for low impact to areas outside the business district. 8. —That a surface water management plan be developed for the entire business district to maximize infiltration capabilities on the site. Management Practices Housekeeping Practices These are used primarily in urban areas to keep impervious areas clean and are most effective when applied on a continuous basis either year round or seasonally depending on the nature of the problem. These controls are likely to reduce pollutants by 25 -50 %. Individual practices include: • Street Sweeping • Street Maintenance • Collection System Maintenance Catch basin cleaning • Storm sewer flushing • Litter Control • Chemical Ap • Iication reduction • Deicing materials • Pesticides and fertilizers • Safe Chemical storage improvement ,11/4y/kt-t- Construction, Monitoring, Operation and Maintenance Plan For Infiltration Basins in the Spirit Hills Development, Lino Lakes. The overall objective for this maintenance plan is to ensure the longevity of the Infiltration basins designed as part of the stormwater management plan. Introduction Infiltration basins are designed to retain and infiltrate the stormwater runoff generated for a given design rainfall event. The success of an infiltration practice is dependent upon a number of things: naturally permeable soils and subsurface material, sufficient depth to the water table and /or a restricting layer such as bedrock or a hardpan layer, proper construction, proper operation and maintenance and pretreatment of stormwater to prevent clogging of the soils. In addition, a review of the soil borings of this development shows that there is sufficient depth to the water table to prevent a water table mound from forming underneath the infiltration ponds and affecting roads and other infrastructure. As a result, the following issues are addressed in this Operation & Maintenance Plan to ensure the short and the long -term performance of the infiltration ponds: • Ensure Proper Construction of Infiltration Basins /Ponds • Minimize Sediment Loading to the Infiltration Basins /Ponds • Develop a Monitoring Plan • Short - Term Maintenance Requirements • Long Term Maintenance Requirements Construction of Infiltration Basins /Ponds Proper construction is extremely important in ensuring the successful operation of an infiltration practice. The following recommendations regarding the excavation, timing of construction, equipment requirements, and landscaping plan will be incorporated in the final plans and specifications. • Excavation of Materials in Infiltration Basins/Ponds Page 1 • Initial grading and excavation of materials in the infiltration basins /ponds must not exceed 2 -3 feet above the final grade. • During the construction process, stormwater infiltration basins /ponds may not be backfilled with any material unless authorized by the engineer in writing. ▪ Final grading of the infiltration basins /ponds requires excavation of the remaining 2- 3 feet of overlying material down to the naturally occurring permeable subsurface material. This shall be done with a low ground pressure D4 dozer (LPG), low ground pressure D5 dozer or 864 traxcavator (rubber Tracks). Soil compaction • Minimize compaction of underlying soils by not traveling over the infiltration basins /ponds and surrounding buffer areas with heavy equipment except to the minimal extent necessary to grade and construct the infiltration basins /ponds. • Grading of the final 2 -3 feet of overlaying material should be done with light earth- moving equipment to minimize compaction to the soils. See above for the recommended equipment. • Once the final grade has been established, the infiltration areas shall be treated as a septic area. No other heavy earth moving equipment shall be allowed to traverse these areas. If the silt fence has been disturbed, the silt fence around the ponds and infiltration areas will be replaced. Using Infiltration Areas for Sediment Removal during Construction • Each infiltration basins inlet shall have a temporary sediment forebay. The main purpose of this is to offer some sediment deposition areas for the larger particle sizes. This is an attempt to reduce the deterioration, plugging and surface clogging of the basins infiltration capacity. These proposed forebays are approved for this project. Landscaping of Infiltration Areas • The establishment of native vegetation that can withstand wet/dry cycling and fluctuations in water levels, are salt tolerant and have a deep root systems promotes the infiltration capacity of the underlying soils. The basins, pond benches and mitigation areas shall be seeded with the City of Lino Lake seed specification. It shall be seeded per the City of Lino Lake planting specification. The developer shall allow any specialty seeding contractors to bid on the city seed and planting specification. See the City of Lino Lake's specification - Appendix B. Pretreatment ▪ The inlet forebays shall serve as minor pretreatment areas prior to the water filling the infiltration basins. Other best management practices noted on the final grading plan shall be implemented and maintained. Inspections and recommended actions may be made by the project engineer, City engineer and the Rice Creek Watershed District inspector. • Monitoring Plan Page 2 • Monitoring of infiltration practices is important in evaluating their short and long term performance as well as in the identification of their short and long term maintenance requirements. It is recommended that visual observation of the infiltration ponds be performed by the developer of Spirit Hills on a routine basis. The Developer may hire personnel to do the monitoring if he wishes to do so. The change in standing water depth above the basin floor over time should be checked: • 1. A StrathAyr double ring infiltrometer test shall be done to get an initial infiltration rate. 2. A minimum of six major rainfall events per year to monitor long- term infiltration rates. 3. After each major rainfall event in the first few months of construction to monitor infiltration rates. This visual inspection will provide information on the degree of surface clogging that may occur over the years and will help to identify the short- and long- term maintenance requirements. As a general rule, the ponds should infiltrate the volume of water generated from a 2.5" rainfall event plus the run -off from the Minneapolis -St. Paul median storm of 0.34 "in 72 hours. Limiting the loading time to 72 hours allows for plant growth on the bottom of the basin and prevents the development of anaerobic conditions in the soils. Maintenance Plan The developer shall be responsible for maintaining the stormwater management practices located on the site prior to city acceptance of the project improvements. This shall be at the time of substantial completion. Substantial completion is that state of progress of the work when the work or designated portion thereof is sufficiently complete in accordance with the contract documents, so that the owner can utilize the work for its intended use. The homeowner's association shall be responsible for maintaining the stormwater management practices located on the site after substantial completion or project acceptance, whichever comes sooner, but not before the homeowner's association is a legal entity. Page 3 • Short Term Maintenance Requirements Vegetation Short- term maintenance would require partial re- vegetation in areas where the native vegetation is not able to survive. This should probably be a minimal requirement for the developer as the seeding contractor for the project shall be responsible for the establishment of the vegetation until the city or homeowner's association takes over the project. Due to the native planting seed mixture (MNDOT 25A), which is proposed for the stormwater areas, the developer will be required to contract a landscaper to perform a prescribed mowing or burn once prior to handing the project over to the homeowner's association or the city. The homeowner's association or city shall contract a landscaper to perform a prescribed mowing or burn once every five years. Permission for the prescribed burn shall need to be obtained from the city fire chief or the MN State Fire Marshall. This is a good short and long term maintenance technique to ensure the healthy and continued growth of native species. All risk for the fire is taken by the landscaper using the burning technique. Erosion In the event that the side slopes of the stormwater management basins erode the following short- term maintenance requirements may include: 1. Excavation of sediment where it is accumulating in the basin with Tight earth - moving equipment. 2. Re- grading of the side slopes and bottom of basin (if necessary) with light earth - moving equipment. 3. Re- seeding as originally specified in the vegetation management plan. 4. Installation of an appropriate erosion control blanket to reinforce the side slopes if deemed necessary by an erosion control specialist. Long Term Maintenance Requirements Depending upon the quality of the stormwater being infiltrated and the ability of the buffers to treat the stormwater, the soils in the infiltration ponds may become clogged with fine material over time to the point of infiltrating the runoff generated from a 2.5" rainfall event plus the run- off from the Minneapolis -St. Paul median storm of 0.34 "in 72 hours. Expected long- term maintenance would require minor rehabilitation of the infiltration ponds and infiltration trenches. Page 4 Infiltration Ponds/Basins •The rehabilitation of the infiltration ponds would require the excavation of accumulated fine material with light earth - moving equipment and re- planting with native vegetation. Excavation would occur in the following manner: • 1. Remove the accumulated fine material and topsoil with Tight earth - moving equipment. 2. Excavated material shall be hauled and disposed of off site to prevent the material from re- entering the basin(s). 3. Excavate down to the naturally occurring permeable, sandy material. 4. Following excavation, re- vegetate the bottom of the basins as specified on the final grading plan. or 1. Burn existing vegetation or mow in late fall with a rotary or sickle -style mower 2. Aerate affected sediment basin with an Aerway ground - driven, rolling -tined aerator /cultivator. Minimum of two replications (passes). Minimum of 3.5" tine penetration into the soil. If the infiltration practices are designed properly, are constructed as specified and protected from erosion (buffers, vegetation, etc.) the basins could very well be maintenance free in the long run. In the worst case, the timing of the regularly scheduled maintenance should not be different than any similarly designed swale, ditch or NURP pond in the city. The long term maintenance shall be taken over by the city or the homeowner's association when the project improvements are accepted by the city. Page 5 • Memo To. Mike Grochala From: Marty Asleson CC: John Powell Date: July 11, 2001 Re: 0 & M Plan /Spirit Hills /Additional Comments This is in reference to the Rice Creek Watersheds request for the City of Lino Lakes Approval on the submitted O &M plan for the ponds and infiltration areas for Spirit Hills. I think the plan is good. I would like to see a more definable standard for "compaction" on page 2. In the fine sand soils I would like it to say the soil compaction should not exceed 80% Standard Proctor, or 1.28 gm /cubic centimeter in areas where structural support standards do not have to be used, and as low as possible in adjacent areas to structural compaction areas. I have discussed this with William McCully and he prefers to use existing conditions for soil density measurements. In that case, and assuming there is not a preexisting compaction problem, a measurement should be taken to reflect the preexisting condition (preferably the measurement would be in terms of bulk density). On page 2, the "Landscaping Infiltration Areas" section, should be rewritten to say "seeding schedules will be established by the City of Lino Lakes, and be planted by a qualified landscape contractor as approved by the City. A 3 -5 year maintenance contract with such a company is required ". Lino Lakes Environmental Memo To: Jeff Smyser From: Marty Asleson Date: 07/24/02 Re: McDonald's Site Plan /Building Permit Issuance Pete Klugal has asked me for a review of the McDonalds site plan before the issuance of a building permit. My comments are as follows: • The only reference to tree preservation plan that I see is item 8 in the planting notes section of MFRA corporate drawing no. 022 — 0342. We need to have the save trees and the removal trees from the tree inventory located on the site - grading plan. We need to have the tree protection fences located on this plan. We need to have all planned ground disturbances defined ( such as utility corridors) if they are in proximity to protection areas. We need to have indicated on the plan an established staging, and building - materials storage area(away from protection areas). We need to have an excavation and tree waste storage area located on the plan. We need the name of the project supervisor with a telephone number located on the tree preservation plan. We need to have a definition of how diseases such as oak wilt will be prevented on the site. We need to have a description of tree removal methods I.e. trees will be directionally felled away from save trees. • City approval for the Planned Development Overlay Landscape Design Standards included a one -for one tree replacement for phase I ( McDonald's and Outlots A and C ), and each of the 275 trees identified on the site(excluding Elm and Boxelder) removed be replaced. We would need a schedule for these replacement trees before removal. Replacement trees will consist of overstory trees with a minimum of 3 inches in diameter, or evergreen trees with a minimum height of 8 feet. • The Black Hills Spruce located on the SE corner will pose a visibility problem for traffic in the future. Replace these with red/white oaks. 4 • • Quaking Aspen in islands would be very short lived. A better selection would be green ash in the NW islands and Swamp White Oaks in the prairie area to the South. • Since we have been selecting native materials for flowers as well, I would suggest replacing the daylilies with Black -Eyed Susan, or Purple Coneflower. • The comer of the Lake Drive (NW comer)sodded areas should be rounded off and planted with a low growing wild seed mix out to 6 feet. The same should be done for the native area on the NE side. The low flower mix should be used here with Junegrass and Blue gramma. • One additional white oak should be planted on the SW comer and three white oaks (white or burr) should be planted on the NE comer. Thirty feet of clear zone should be maintained from any trees and the intersection corners. An additional grove type planting should not deter from view corridors on the NW comer. • Although an irrigation schedule is mentioned in the Landscape Plan, I see no irrigation drawn onto the plan. MEMORANDUM July 24, 2002 to: Environmental Board from: Jeff Smyser, City Planner subject: Draft Subdivision Ordinance Agenda Item 6A As you know, city staff, planning consultant, and a citizen task force have been working on a new ordinance to govern the subdivision of property in the city. The Development Regulations Task Force consists of City Councilmember Jeff O'Donnell and six appointed citizens: two members of the Environmental Board, two from the Economic Development Advisory Committee, and two from the Planning & Zoning Board. The task force has completed the draft subdivision ordinance and we now are bringing it to the full boards for discussion. Of interest to the Environmental Board are probably the resource inventories for sketch plans and preliminary plats, tree preservation requirements, and a minimum buffer requirement around wetlands. We will discuss these and other aspects of the draft ordinance at your July 31 meeting. Please remember that the subdivision ordinance governs subdivisions: that is, the division of property. Actions such as commercial site and building plan review, variances, planned developments, and many others are governed by the zoning ordinance. The task force is working on revisions to the zoning ordinance. Project #02 -13 • PART 3 EXECUTION 3.01 EXECUTION FOR TURF GRASS - TYPE I MIXTURE A. Examination: 1. Verify that prepared soil base is ready to receive the work of this Section. 2. If weeds have emerged prior to seeding operation apply Round Up herbicide as per manufacturers instructions and remove. B. Fertilizing: 1. Apply after smooth raking of topsoil. 2. Do not apply fertilizer at same time or with same machine as will be used to apply seed. 3. Mix thoroughly into upper 3 to 4 inches of topsoil. 4. Lightly water to aid the dissipation of fertilizer. C. Seeding: 1. Apply seed at a rate of 6 Ibs per 1000 s.f. evenly in three intersecting directions. Apply 2 lbs. of per pass. Rake in lightly. 2. Do not seed areas in excess of that which can be mulched on same day. 3. Planting Season: May 15 to June 15 and August 15 to September 15. 4. Do not sow immediately following rain, when ground is too dry, or during windy periods. 5. If weeds have emerged prior to seeding apply Round Up to weeds as per manufacturers instructions and remove vegetative matter. 6. Apply seed with a Brillion slit seeder. 7. Immediately following seeding apply straw mulch at a rate of 1.5 tons \acre. Maintain clear of shrubs and trees. Disc anchor mulch. Lightly roll seeded and mulched area to achieve even, uniform surface. Apply water with a fine spray immediately after each area has been mulched. Saturate to 4 inches of soil. 8. If area to be seeded was treated with herbicide, seeding shall occur no less than 14 days after herbicide application. 3.02 EXECUTION FOR NATURAL GRASSES /FORBS - TYPE 11, 111, & IV SEED MIXTURES A. Examination: 1. Verify that prepared soil base is ready to receive the work of this Section. 2. If weeds have emerged prior to seeding operation apply Round Up herbicide as per manufacturers instructions and remove. B. Fertilization: 1. No fertilizer shall be applied. C. Soil Preparation: 1. Notify the Owner before beginning work of your schedule for beginning and completing work. 2. After grading is complete and at least three weeks before installation of seed, chisel plow or rip soil to a minimum depth of 18 ". 3. Immediately following chisel plowing or ripping of soil, disc, harrow, rotovate or otherwise till soil to a minimum depth of 4" to create an even seedbed free of Brauer and Associates, Ltd. Project #02 -13 large lumps of soil and debris. 4. In areas with a slope greater than 10:1, ensure that the disc tracks or furrows run parallel to the contour so as not to encourage rilling. 5. Remove all foreign matter larger than twelve inches in any dimension from the areas to be seeded and /or planted. 6. After completion of soil preparation, the Contractor shall schedule with theLA -E/ Owner a final acceptance inspection of soil preparation. D. Execution: 1. Before beginning seed installation, the Contractor shall layout all seeding zones using flags spaced approximately 20 feet apart. The LA -E /Owner must approve the layout before seed installation begins. 2. Seeds shall have proper stratification and /or scarification to break seed dormancy for spring planting. 3. All legumes shall be inoculated with proper rhizobia at the appropriate time prior to planting. 4. Seeding shall be preferentially conducted as a late fall dormant seeding (after November 1) or in early spring (as soon as the soil is free of frost and in a workable condition but no later than July 15). 5. All seed shall be preferentially installed with a rangeland type seed drill or no -till planter, such as by Truax, or equivalent as approved in writing by the LA -E/ Owner. 6. If soil is too wet or the area too small to install seed as described above, a mechanical broadcast seeder, such as by Cyclone, shall be used. Hand broadcasting of seed may also be employed. Within 24 hours, or as soon as site conditions permit, broadcast seeded areas shall be rolled or cultipacked parallel to the contour. 7. Hydroseeding may only be used if seed is spread in a separate operation and the ground cultipacked before hydromulch is installed. 8. Within seven days of seeding, crimp 2,000 pounds per acre of clean straw for erosion control at a rate of 1.5 tons per acre to achieve a uniform distribution of mulch. The mulch shall then be disc anchored. 9. If area to be seeded was treated with herbicide, seeding shall occur no Tess than 14 days after herbicide application. 10. Install erosion control blanket on all seeded areas that have a slope of 4:1 or greater as indicated in section 02940 - Erosion Control Blanket. 3.03 CLEAN -UP, REMOVAL AND REPAIR A. Clean up: the work area shall be kept free of debris by the Contractor. After seed installation is complete, clean up any remaining materials, debris, trash, etc. Avoid driving over seeded areas to minimize disturbance B. Removal: after work has been completed remove any tools, equipment, empty containers, and all other debris generated by the Contractor. C. Repair: repair any damages caused by the Contractor during completion of the work described in this section. 3.04 INSPECTION After completion of seeding, the Contractor shall schedule with Owner a provisional acceptance inspection of the work. Brauer and Associates, Ltd. Project #02 -13 • 3.05 MAINTENANCE A. Contractor maintenance period for all seeded areas shall be for one month from Date of Substantial Completion. B. The Contractor shall supply all the necessary equipment, materials and labor for proper maintenance each type of turf. C. Maintenance for Turf Grass Areas (Type I): 1. Mow grass at regular intervals to maintain at a maximum height of 2% inches Do not cut more than 1/3 of grass blade at any one mowing. 2. Neatly trim edges and hand clip where necessary. 3. Immediately remove clippings after mowing and trimming. 4. Water to prevent grass and soil from drying out. 5. Roll surface to remove minor depressions or irregularities. 6. Control growth of weeds. Apply herbicides in accordance with manufacturer's instructions. Remedy damage resulting from improper use of herbicides. 7. Immediately reseed areas which show seed germination and growth that is unacceptable to the Owner. Continue reseeding until satisfactory turf is established. 8. Protect seeded areas with warning signs during maintenance period. D. Maintenance for Natural Grass Areas (Types II, III, and IV): 1. The Contractor shall submit a maintenance plan before final acceptance. The Owner may choose to enter into an agreement with the Contractor for maintenance or may choose to maintain the site itself. 2. The maintenance plan must include specifications and schedule for mowing, burning and herbicide application for three years and a perpetual program thereafter. 3. Each time the prairie grass reaches a height 12 to 16 inches the Contractor shall mow the area to a 4 to 5 inch height with a flail type mower. 4. Water to prevent grass and soil from drying out. 5. Roll surface to remove minor depressions or irregularities. 6. Immediately reseed areas which show seed germination and growth that is unacceptable to the Owner. Continue reseeding until satisfactory turf is established. 7. Protect seeded areas with warning signs during maintenance period. 8. Immediately reseed areas which show seed germination and growth that is unacceptable to the Owner. Continue reseeding until satisfactory turf is established. E. The Contractor shall notify the Owner /LA -E when all seeded areas are ready for inspection and final acceptance by the Owner. The Contractor shall provide the Owner with a 48 hour notification to accept maintenance responsibility once final acceptance is approved. 3.06 ACCEPTANCE AND GUARANTEE A. Provisional acceptance: the work shall be considered 90% complete after all seed has been installed and the Contractor has completed all required clean up, removal, and repair as described in 3.03 of this section. Brauer and Associates, Ltd. Project #02 -13 B. Final acceptance: the work shall be considered 100% complete after the Contractor has met or exceeded the performance standards given in this section, and completed all required clean up, removal, and repair as described in 3.03 of this section. C. The Contractor shall guarantee Type 1 seeded areas will meet or exceed the following performance criteria one (1) full growing season after provisional acceptance: vigorous growth of seeded areas to the expectation of the Owner/LA-E. C. The Contractor shall guarantee Type II, Type III, and Type IV seeded areas will meet or exceed the following performance criteria one (1) full growing season after provisional acceptance: 70% plant cover, seedlings of three planted grass /sedge species found and seedlings of four planted forb species found. 3.07 RETAINAGE A. Owner will hold 10% of the contract amount as retainage for all seeded areas until the seed establishes vigorous growth at the end of the guarantee period. B. If the seed does not establish a vigorous growth to the satisfaction of the Owner /LA -E, the Contractor is responsible for re- seeding and maintenance until turf establishment is deemed acceptable by the Owner /LA -E as described in paragraph 3.05 of this section.
