ADJOURN • • Joint Environmental Board Park Board Meeting Meeting Date: March 31, 2004 Topic: Joint Environmental Board and Park Board Meeting Summary: Jeff Schoenbauer of Brauer and Associates has requested the following information for the packet: Park Board and Environmental Board Meeting Objective: Provide the Park Board and Environmental Board with an overview of the planning process to date and have an open discussion on: general planning issues; developing strong synergies between park, greenway, and environmental planning; and developing a common vision that will influence the system plan and character of the community. Park and Environmental Board Meeting Agenda: • Introduction • Overview of common vision statements from the 20/20 Vision Plan, Comprehensive Plan, Handbook for Environmental Planning and Conservation Development, and the Park and Greenway System Plan. • Consideration of initial findings related to the park and greenway system. • Consideration of the initial findings related to the trail system plan. • Consideration of natural resources stewardship planning issues. • Consideration of implementation challenges and possible approaches. There will be open discussion related to each of the listed agenda items after a presentation of findings. In preparation for the meeting, each member of the two boards should please think about and be prepared to discuss your perspectives on each of these agenda items. Agenda Item 5A Environmental Board Meeting Date: March 31, 2004 Topic: Fox Den Acres /Preliminary Plat Review Background: Royal Oaks Realty submitted application for Preliminary Plat Consideration of Fox Den Acres Subdivision on March 11, 2004. The area is in the MUSA and guided for low- density sewered residential and a growth staging timing between 1998 and 2010. The total proposed Fox Den Acres boundary area is 50 acres. The total upland area listed is 38.16 acres. The total proposed wetland area is 11.8 acres. The proposal maps 64 single - family lots. The single family lots account for 36.81 acres or 73.62% of the total land area. The developer is proposing a park land dedication of 5.14 acres. The streets account for 8.05 acres or 16.10 %. The average lot size is 0.57 acres. The density is 1.28 lots per acre. On the Certificate of Survey exhibit, Parcel "A" is zoned R -! (Low density). Parcel "B" and "C" are zoned R. Fox Den Acres Greenway 13. Tree Inventory Analysis: Site Vegetation The site inventory lists 2337 trees on the site. The MLCCS inventory in this area was a bit inaccurate for this site. For the most part, higher density hardwoods (oaks, hackberry, red maple) are confined to areas to the NE, with sporadic areas to the far East and far North. I have included Attachment 9 so that you can get a feeling for where the tree types are. The developer has submitted a tree preservation plan. However, this plan is not superimposed on the grade plan so there is no way review the intentions of tree - save /tree - removal (or our goal to save significant trees) except where there is an obvious inference to removal such as a road. . According to the tree preservation -fence drawing, since most of the buildable area follows the upland tree types, most of the trees will be lost on the site. See Attachment 6 and Attachment 13. Four specimen trees are identified, and all but one of them is to be removed. Recommend that the trees be overlaid on the grade plan and a meeting set to discuss the boundary of the tree preservation lines. The entire area is a matrix of wetland (Attachment 6) to upland vegetation (including the trees). Most of the Aspen /Aspen & Birch buffering wetlands will be lost. I have identified some areas throughout the City as rare vegetation habitat, with possible rare vegetation location points. Fox Den has two such points located in a rare eco- corridor mostly following CD25. These areas most usually are found in a flood plain area. The two points identified are on disturbed areas and there are no rare plants present on the site. Recommend that this rare eco corridor be preserved as open space through conservation easement or plat as "City". Soils A good part of the site is "isanti wet" soils. The seasonally high water table in Isanti wet soils are very shallow, between 0 and 2 feet. The rest of the site is for the most part Solderville soils. See Attachment 10. The seasonally high water table in Solderville soils is between 2-4 foot from the surface. These soils are also very permeable. The developer should demonstrate in all cases, especially proposed NURP pond areas that there would be at least 4 feet of separation between the bottom of the NURP ponds and the seasonally high ground water table. The ponds are designed in isanti wet soils and Soderville soils. Seasonally high water tables for these two soil types are 0 -2 feet and 2 -4 feet respectively. It is important that the developer demonstrate achievement of this 4 -foot separation so that the ground water is not polluted. This pollution can happen in a very short time in these soils according to the Anoka County Soil Ground water Model. Most of the proposed Fox Den Acres pond bottoms are designed at or below the indicated DNR ordinary high water level. Seasonally high levels of the ground water should be determined by soil boring investigation. Given that this area is so low, and the water table high, it is assumed that there will need to be substantial fill imported to allow for building. This fill should be similar soils and not allowed without City approval. Exporting soils should not be allowed without City approval. The developer is planing on phasing his grade work. This is good in terms of protecting soils in other areas from compaction. Soil compaction should further be addressed by fencing off any areas not destined for grade work. Rock entrances should have an additional stockpile of rock available to top dress when the rock becomes filled. Surface Water Surface water is directed to NURP ponds from impervious surfaces. Surface water runoff from back yards and rooftops seems to be directed directly into wetlands. Since there are no proposed buffers around the wetlands, lawn and rooftop runoff should be buffered at least before entering the wetland. It is also important to provide adequate buffering to County Ditch 25. A segment of this ditch appears to be immediately adjacent to the central nurp pond on the East Side of the proposed development. The pond is designed to discharge directly into this ditch. Fine soil particles take about a week to settle out adequately, and dissolved pollutants (lawn pesticides, nitrogen) need additional filtration before being allowed to enter the ditch. Water from the CD25 area flows to Wards Lake than to Reshanuau. A conservation easement is indicated for the southern ponds in the Outlot areas. This conservation easement is for maintenance access. There does not appear to be any access to the conservation easement or any of the other wet or pond areas in the treatment train. Site Restoration The Developer has specified a MNDOT 26B mix for the pond restoration areas. Although the mix is native (Attachment 11), I recommend that the developer be required to use the city native seed mix and have it installed by a nursery business knowledgeable in native seen installation. The developer should also hire the services of such nursery to maintain the seeded area for a minimum of three years. One boulevard tree of the City's choice should be planted per housing frontage. Open Space Issues A park is designed into the NW corner of the property. The 1992 Open Space Plan indicates no need for a park in this area. Instead, the plan demonstrates a need for a greenway system connecting two established parks. The City Land Use Plan shows this area as greenway. This is because of the high ground water, percentage wetlands present, and unsuitability to building. Lino Lakes Environmental has further revised this notion of greenway planning into an area that includes hydric soils and flood plain. (Attachment 12) A Buffer of adjacent land is needed to provide for environmental integrity, and resident use. This greenway area contains points where ecological conditions exist that would support rare vegetation. The wildlife potential model we have run shows this • greenway area as Blandings turtle activity area, with a couple of breeding patches to the east, South, and West. Proposal Design Based on a low- density residential zoning, it is doubtful that the developer can achieve any buffering, the preservation of any natural resources, or guided open space plans. The park dedication decision is of coarse a Park Board issue. Given the existing natural resources on the site, a PUD /Conservation Development scenario on this site is appropriate. Without PUD /Conservation development approach, the City will have lost its opportunity to provide for unique resource preservation, and social accessibility through a greenway system. With a planned development, there is the possibility of achieving buffering along a greenway system and acquisition of park area. Options: 1. Approve with comments and recommendations 2. Recommend table with discussions of moving to a PUD /Conservation Development in this area. Our field work was performed between February 9th and February 19t , 2004, by Matt Gogala, Shawn Tracy, and Mark Rehder and myself all Kunde Company personnel with ample experienced in tree inventories throughout the metro region. In this case, we recorded species, size, and condition, and tagged each tree with a unique number. The surveyors from E. G. Rud & Sons, Inc. then mapped the locations of these tagged trees and produced the accompanying map. The City of Lino Lakes definition of "Significant Tree" from the current Zoning Ordinance was used. This is defined as "A healthy tree measuring a minimum of six (6) inches in diameter for deciduous trees, or a minimum of twelve (12) feet in height for coniferous trees ". No coniferous trees of significant size were found on the site. Some additional areas comprised of trees less than six inches in diameter are also delineated on the map. We rated the condition of each tree on a one (1) to ten (10) scale, with any condition ones and twos not included as obviously not healthy enough. See attached notes for further details and explanations of the scale. It should be noted that --any condition three (3) trees also have questionable value in a residential setting where targets of value will exist. Although these tress serve a function in a natural woods, special efforts to save them are not warranted as each may be a potential hazard tree structurally. Larger trees of condition four (4) or greater that are near proposed grading limits should still be reevaluated carefully for what tree protection or disease prevention measures may be appropriate. "Save " and "Remove" designations on each tree are being made by the project engineers and not Kunde Company. Specimen trees, defined as 30 inches dbh or greater, in good condition (4 or better), and single stemmed, were also noted. Five trees meeting this definition were identified; they are tag numbers 919, 934, 1170, 1633, and 1255. Three areas within the property boundaries were designated by the project engineer as exclusion areas where an individual tree count was not required, per conversation with City staff, because they will be beyond 50' from any proposed grading. impacts. A gap in tag numbers occurs where some trees within these exclusion areas were tagged, but were not surveyed. A total of 2337 trees were tagged. Accounting for the gap mentioned, 'a total of 2,294 significant trees exist on the property. Condition Codes An "official' and more extensive rating system for condition appraisal, published by the MN Society of Arboriculture, does exist. The following is an interpretation of this approach, as adapted and applied for rapid field evaluation. 0 = Dead or fatally diseased.NOT INVENTORIED. 1 = Nearly dead or in imminent threat of failure. NOT INVENTORIED. 2 = Heavily diseased or decayed, or with some severe structural defects. NOT INVENTORIED. 3 = Structurally compromised, with moderate to serious defects or decay, or in decline due to disease or insects. May have wildife or ecological value, but is more of a laibility than an asset if a target is present. 4 = Structurally. sound or only small risk of potential failure, but with some defect such as a wound, multiple cracks, significant lean or asymmetry (but stable root plate), or showing symptoms of a non - lethal disease. 5 = An average tree that can be expected to live many more years; may have a single crack, some minor limb damage, or dead limbs that are prunable, etc. 6 = Above average in form and structure, with only minor defects such as a slight lean, twist or sweep. 7 = Noticably above average in symmetry and structure, with no apparent defects. 8 = An exceptional tree with outstanding structure, no apparent defects and a well - balanced crown and branch structure. 9 = A tree with exceptional structure and form, also well- pruned and maintained, not normally found in natural settings. 10 = The ideal, perfect tree, essentially never used. The property is located North of 62nd Street, and west of West Shadow Lake Drive (See attachment 1). The Junes property is zoned LDSR (Low Density sewered Reserve) in an area staged for growth between 1998 and 2010. The following attachments are provided: 1. Location Map 2. Rice Creek Watershed Correspondance Analysis: The Minnesota Land Cover Classification (Attachment 3) shows short grasses with sparse tree cover, a pond, and a few aspen in a saturated situation. Recently the entire area has been cultivated and is for the most part bare ground. There are no significant trees on the site; therefore, a tree preservation plan is not needed. The larger scale picture (Attachment 4) shows the Junes property in a unique /rare plant corridor area. The rare plant corridors were generated on GIS by referencing the soils, and hydrology of known rare plant locations. This corridor generally follows a designated greenway area in the City Land Use Plan. A survey of the site verified that there are no remaining rare plant species on the portion of the site to be developed. It would be desirable to obtain a conservation easement for the rest of the site in the unique corridor. The soils for this area are wet (Attachment 5). These soils would be very difficult, if not impossible to develop. A portion of the site abuts a feed line to County ditch 25, and the conservation easement would ensure a buffer to this ditch. According to the Blandings turtle modal, the area of this conservation easement is an activity area of the turtles, with a breeding site to the SW. Since the land to the west is City parkland, perhaps the developer would plat this conservation easement as park. • Water from CD25 flows to Wards Lake. The developer is proposing to fill a pond in the vicinity of the existing house, fill a portion of wetland and mitigate wetland replacement to the North of the existing house (Attachment 2). A letter from Rice Creek Watershed disagrees with the wetland mitigation. (Attachment 6). Regardless of where the wetland mitigation occurs, the developer should use the City native seed specification for restoration of the ground in the pond area. Options: 1. Recommend approval of the Junes subdivision with staff and Environmental Board recommendations. 2. Your proposed plan involves the creation of two additional lots north of 62nd Street and West of West Shadow Lake Drive and 9,771 square feet of wetland impact. The Rice Creek Watershed District is required by State law to accept or deny wetland replacement plans based on their compliance with Minnesota Rules Chapter 8420, the Minnesota Wetland Conservation Act Minnesota Rules Chapter 8420.0548 Subp 3C5 states that "If the local government unit determines that a feasible and prudent alternative exists that would avoid impacts to wetlands, it shall deny the replacement plan." Minnesota Rules 8420.0548 Subp 3C2 states that "An alternative shall be considered feasible an d prudent if it meets all of the following requirements: (a) it is capable of being done from an engineering point of view; (b) it is in accordance with accepted engineering standards and practices; (c) it is consistent with reasonable requirements of the public health, safety, and welfare; (d) it is an environmentally preferable alternative based on a review of social, economic, and environmental impacts; and (e) it would create not truly unusual problems. The wetland impacts may be avoided by building the third lot in the location of the existing barn. This would eliminate any degradation of the wetland from the horses. Impacts from residential edge could be minimized or eliminated by placing signs along the edge to educate the residents of the existence of the wetland and what activities are not allowed within the wetland. Another alternative would be to eliminate lot 2 and change the footprint of lot 1 to avoid wetland impacts. According to Minnesota Rule 8420.0520 Subp. 7a., the case that the wetlands proposed to be impacted are extremely degraded and the proposed project will increase the quality of the wetland can only be made if a functional assessment is conducted using a methodology approved by the Board of Water and Soil Resources and is reviewed by the Technical Evaluation Panel. The Technical Evaluation Panel includes representatives from the Soil and Water Conservation Wayne Junes, Page 2 District, the Board of Water and Soil Resources, the Minnesota Department of Natural Resources and the U.S. Army Corps of Engineers. The Technical Evaluation Panel makes recommendations to the Rice Creek Watershed District but the Rice Creek Watershed District has the final authority to accept or deny a wetland replacement plan. Since a functional assessment has not been submitted and alternatives exists that would avoid impacts to the wetlands and meet all the requirements outlined in Minnesota Rules 8420.0548 Subp 3C2, the Rice Creek Watershed District Staff will recommend that the Rice Creek Watershed District Board of Managers deny your wetland replacement plan at the Board Meeting held on April 28, 2004, 7:00 p.m. at the Shoreview City Hall. If you wish to submit a functional assessment you may either write me a letter requesting an extension on the decision date until the assessment is complete or you can submit a new application when the assessment is complete. If a letter requesting an extension on the decision date is received before April 19, 2004, the recommendation for denial of the wetland replacement plan will not be presented to the Board of Managers at the April 28, 2004 meeting. The Rice Creek Watershed District is administratively extending the decision period until April 29th, 2004 allow you time to submit any additional information. I would be willing to meet with you and your engineer to discuss possible changes to your plan that would conform to the Wetland Conservation Act and allow the Rice Creek Watershed District to approve the plan. Any mitigation plan that is accepted will need to include a mitigation site that has irregular edges and specify on the plans that the bottom of the wetland will be irregular.
