The following report was submitted at the March 31, 2004 Environmental

Background: West Shadow Ponds 2nd: Addition is a 1 acre subdivision
request located on the NE corner of West Shadow Lake Road and 62nd °Street.
The present parcel is unsewered.:The applicant is requesting-to connect a sewer
line to proposed 2 new residential units. The present site is partially in the MUSA
and in a staged'growth area of 1998 to 2010. The applicant:;is requesting MUSA
for the West Side of the present lot: The parcel is zoned Low Density Sewered:
See Attachment 1 and 2. The following attachments are included with this
report:

Analysis:
West Shadow Ponds MLCCS shows the area as Short Grasses and :Mixed Trees
with 26 -50 % impervious cover. See Attachment 3 Trees are described on the
survey as confined to the north part of the Lots, and as Aspen, `;fair condition,
between 10 to 40 'years old. It appears the developer intentions are to leave the
trees undisturbed. The developer should show his intentions with tree - protection.

Analysis:
West Shadow Ponds MLCCS shows the area as Short Grasses and Mixed Trees
with 26 -50 % impervious coyer. ' `See Attachment 3 Trees' are described on the
survey as confined to the north part; of the Lots, and as Aspen, fair condition,
between 10 to 40 years old.. It appears the developer intentions are to leave the
trees undisturbed. The developer should show :his intentions with tree - protection
fence locations. The tree protection fence should be installed and verified byi

The Developer, Mr. Rick Carlson tabled the agenda item until wetland issues
were addressed. Included, as Attachment 1 is new submitted information from
Mr. Carlson. Attachment 1 includes a cover letter of intentions, a Declaration of
Restrictions, Covenants, Drainage, Utility Easement, and map showing restriction
area.
Analysis:
Because of the nature of grading and room on the East wet area, little can be
done in terms of buffer (although the wetland is still protected). It is my
understanding that the lot may separate this wetland by some sort of retaining
wall. The developer is proposing to place permanent restrictions on a 35 -foot
buffer on the northern wetland area that includes much of the aspen bordering
the wetland. Please see Attachment 1 (Rick Carlson concerning Buffer), and
Attachment 2 (Mattke Surveying and Engineering, concerning wetland
delineation /mitigation). It appears that the small amount of wetland proposed for
fill would meet the deminimus requirements and allowed under a national permit.
Options:
1. Recommend approval with proposed restrictive covenants, and one tree per
frontage planted, and other discussed recommendations of the Environmental
Board.
2. Recommend that the City not approve.

Dear Marty,
Thank you for your suggestions regarding the buffer area along the North property line. I have
met with Mr. Tedd Mattke of Mattke Surveying & Engineering, Inc. to locate a line that would
give the city a maximum buffered area in a recorded drainage and utility easement and still allow a
reasonable area for back yards for the two homes.
I have enclosed a copy of the Declaration of Restrictions and Covenants for a Drainage and
Utility Easement (Exhibit A). In addition to some of the wetland areas, it will show a 35'
easement running East to West along the North property line. This document will be recorded
and attached to the Deed for future ownership.
If this satisfies the environmental board, please give your stamp of approval before the Planning
June 9, 2004.

DECLARATION OF RESTRICTIONS AND COVENANTS
FOR
A DRAINAGE AND UTILITY EASEMENT
This Declaration of Restrictions and Covenants for The Drainage and Utility Easement
(Declaration) is made this day of 2004 by the undersigned Declarant:
RECITALS
A. The Declarant holds the fee title or perpetual easement on the real property
described as follows:
See Attached Exhibit "A ";
RESTRICTIONS AND COVENANTS
The Declarant makes the following declaration of restrictions and covenants for the
Drainage and Utility Easement. These restrictions and covenants shall run with the land, and bind
Declarant, and Declarant's heirs, successors, and assigns:
1. The Declarant shall maintain a Drainage and Utility Easement of the size and type
specified in Exhibit A. Declarant shall not make any use of the Drainage and Utility Easement
that would adversely affect the functions or values.
2. Declarant grants to the City of Lino Lakes, the local Watershed and their agents,
reasonable access to the Drainage and Utility Easement for inspection, monitoring, and
enforcement purposes. This Declaration grants no access to or entry on the lands described to the
general public.

3. Declarant represents that he or she has a fee simple or easement interest in the land on
which the Drainage and Utility Easement is or will be located. Declarant represents that he or she
has obtained the consent of all other parties who may have an interest in the land on which the
Drainage and Utility Easement is or will be located to the creation of the restrictions and
covenants herein, and that, all such parties have agreed in writing to subordinate their interests to
these restrictions and covenants, pursuant to the attached Consent and Subordination
Agreement(s).
4. Declarant shall record or file this Declaration, pay all costs associated with
recording or filing.
5 These restrictions and covenants shall be unlimited in duration, without being re-
recorded.
5.(a) Shall, at Declarant's cost, establish and maintain permanent vegetative cover on
areas specified in the Drainage and Utility Easement for permanent vegetative cover, including
any necessary planting and replanting thereof.
5.(b) Shall not produce agricultural crops on the areas specified in the Drainage and
Utility Easement.
5.(c) Shall not graze livestock on the areas specified in the Drainage and Utility
Easement.
5:(d) Shall not place any materials, substances, or other objects, nor erect or construct
any type of structure, temporary or permanent, on the areas specified in the Drainage and Utility
Easement.
5.(e) Shall, at Declarant's cost, be responsible for weed control by complying with
noxious weed control laws and emergency control of pests necessary to protect the public health
on the areas specified in Exhibit A
5.(f) Shall comply with requirements that limit haying, mowing, timber removal or other
vegetative alterations that do not enhance or would degrade the ecological functions and values of
the Drainage and Utility Easement.

9. This Declaration may be enforced, at law or in equity, by the City of Lino Lakes.
The City of Lino Lakes shall be entitled to recover an award of reasonable attorney's fees from
Declarant in any action to enforce this Declaration.

Environmental Board Meeting Date: May 26, 2004
Topic: Marshan Townhomes 2 "d Addition
Background:
Marshan Lake Townhomes Phase 1 was approved in 1995. The Environmental
Board reviewed Marshan Townhomes 2 "d Addition in December 2003. At that
time, the Environmental Board recommended denial due to inconsistencies with
the Comp Plan. The original submittal plan indicated 46 units on 4.05 acres.
The new plan before you consist of 23 units, on 4.05 acres, for a density of 6.0
units per acre. This conforms to the City Comprehensive Plan. The land area of
the proposed development is zoned R -3, and is guided for medium density. The
developer is requesting approval of a conditional use permit for R -3, medium
density residential /PUD /Preliminary Plat
Analysis:
Marshan Townhomes 2 site is in an area designated as a Lake Protection Zone
in the Lino Lakes Handbook for Environmental Planning and Conservation
Development. This means that extra care should be given to the management of
surface water resources in this area.
The MLCCS indicates "Short Grasses and Mixed Trees with 26 -50% impervious."
There are no rare plant or potential rare plant on the site.
The site consists of 31.2% Impervious. Water flows to a created pond on the
East Side of the townhome complex. Surface water calculations for the pond
were designed to include the entire site build -out.
A Tree Preservation Plan is submitted as Attachment 6. As requested at the
December 3rd Environmental Board Meeting trees on the NW corner of the
project are save trees. The developer has indicated verbally that all hazard trees
will be removed.
A landscape plan is included in this packet as Attachment 8.
The Environmental Board made the following species change suggestions at the
December 3rd meeting:
• Change Black ash to Green ash or one of the native oak species.
• Colorado spruce to White spruce
• Austrian pine to White or Red pine.
• Autumn applause to Northern pin oak.
These suggested changes should also carry forward to the new plan.

M PLANTING SPECIFICATIONS
1. PLANTING BED PREPARATION: ALL MASS PLANTING BEDS SHALL BE TILLED TO A MINIMUM
DEPTH OF 10 ". AMENDMENTS SHALL BE APPLIED AFTER CULTIVATION.
2. BACKFILL SOIL: USE SOIL EXCAVATED FROM PLANTING HOLES AND PROVIDE AMENDMENTS.
REMOVE ALL DEBRIS INCLUDING ROCKS LARGER THAN 3" DIAMETER.
3. FERTILIZATION: ALL PLANT MATERIALS SHALL BE FERTILIZED UPON INSTALLATION WITH

8 PLANTING PLAN: ALL PROPOSED PLANTS SHALL BE LOCATED CAREFULLY AS SHOWN ON THE
