ADJOURN • • Agenda Item 5A Environmental Board Meeting Date: Topic: Fox Den Acres Background: Fox Den Acres submitted preliminary plat to the Environmental Board for review on March 28th 2004. The following recommendations were made at the March 28th meeting: The Environmental Board recommended that this plat be denied under the current zoning, that this would be an excellent property to develop with a greenway corridor. (If approved than other considerations of Environmental Board and Staff should be looked at). The following recommendations were made: Recommend this development be considered as a PUD and /or Conservation Development that would allow for variability in lot sizes and street widths. Suggest that the developer work with the Saddle Club site, or look at purchasing the Saddle Club site, for developing together with the Fox Den Acres site, so that the two sites could be planned concurrently. • That the proposed NURP ponds and infiltration ponds be evaluated for adequate separation and filtration to the seasonally high water table. That the developer works with staff to identify trees that can be saved in buffer areas and designated clear areas. That the development should allow for the creation of a greenway corridor from the South West corner to the South East corner, and up along the East side of the property. No soils should be imported or exported without City approval. Soil protection areas should be designated and fenced off. Rock entrances should have additional stockpile of rock on hand to top dress entrances when initial rock entrance fills. Storm water from roofs and back yards should follow some sort of a designed treatment train before water flows into existing wetlands. The developer should be required to use the City native seed mix, in NURP and infiltration pond restoration -work. That the seeding of these areas be accomplished with the services of an approved contractor that is knowledgeable in native plant restoration. That the developer be required to hire such a native plant contractor to manage the restoration areas for a minimum of three years. • • • The developer has submitted a new preliminary plat for your review. The Preliminary Plat meets all of the City Requirements (inside growth area, MUSA area, asking for no variances, meets zoning requirements, etc.) Analysis: This plan is a minimum acceptable plan in terms of greenway considerations. The plan will work for a minimum consideration of a greenway with room for a trail. However, environmentally we are trying do accomplish as much as we can with buffering, and capturing unique resources. A number of environmental issues could be improved in this proposal with the use of a Conservation Development approach. The approach would involve MNRAM (Minnesota Rapid Assessment Methodology) assessment of wetlands, meeting with the TAP (Technical Advisory Panel) of the Bureau of Soil and Water, and hopefully enabling some flexibility in moving some of the wetlands on the East side of the property. Through this redesign, it is believed that we could create more functional and valuable wetlands, maintain the desired spaces for houses for the developer, while increasing the amount of green space available for greenway. The developer has dropped the number of proposed lots to 56 on this plan from 64 on the original plan. We might also be able to save more of the tree areas using the Conservation Development approach, and be able to incorporate some very functional surface -water treatment features such as rain gardens. A stewardship program could be initiated through the establishment of a trust -fund and association fees. The trust fund would ensure the care of Conservation Areas in the development. The Homeowners Association would own the Conservation easement. The original concerns of the Environmental Board still hold. Since at this writing, we do not have soil boring information, there is no way to discern whether pond /infiltration areas are 3 feet above the seasonally high water table. Also, there are no approvals from the Rice Creek Watershed District. The wetland delineation was accepted by the watershed. In my opinion, there are some questionable wetland areas that were omitted from the delineation. Plant indicators in these areas include Spirea, Royal, and Sensitive fern. Options: 1. Conditional recommendation of approval 2. Recommend Council not to approve. Recommendation: Recommend conditional approval. Conditions should include a willingness of the developer to work with the City on investigating the Conservation Development approach as an alternative approach to his Preliminary Plat. This condition should not be a burdensome effort for the developer in terms of time in particular. I would recommend the services of Jeff Schoenbauer of Brauer and Associates to assist the City with this alternative approach. Other conditions should include Rice Creek Watershed District approval, proof that surface water ponds and infiltration areas will safely work, and recommendations of the March 28, 2004 Environmental Board Meeting. Many people and organizations deserve thanks! Thanks go to the cities of Centerville and Lino Lakes who both had to enact a protection ordinance. Centerville and Lino Lakes passed an ordinance in March 2002, but Lino Lakes needed to remove a sunset clause that would have terminated the no -wake zone protection ordinance and they did. (This no -wake zone ordinance only applies to the northern half of Peltier Lake, which is a part of the lake that is very shallow and filled with aquatic plants. It also helps protect a great blue heron rookery on a large island in the northern part of Peltier Lake.) Special thanks go to Jeff Perry, Natural Resources Specialist for Anoka Parks, Joan Galli, Minnesota DNR Nongame Wildlife Specialist, Marty Asleson, City of Lino Lakes Environmental Coordinator, and Art Hawkins, a biologist working with the DNR. These people provided the detailed expertise and leadership to get the job done. Jeff Perry led a task force on the issue. The outstanding work of these knowledgeable people from 2001 through 2004 was crucial to enact the protection. A total of 556 citizen petition signatures favoring the protection were submitted and was significant to enacting the protection. Thanks to each and every person who signed! It clearly demonstrated the community was in favor of this protection. Special thanks to those who helped gather signatures. Thanks go to the many organizations that supported protection. These include: Minnesota DNR, Anoka County Parks, Rice Creek Watershed District, Anoka County Commissioner Margaret Langfeld, Anoka County Commissioner Rhonda Sivarajah, Minnesota Ornithologist's Union, Director of Bell Museum of Natural History, St Paul Audubon Society, Minnesota Lakes Association, Walter J. Breckenridge Chapter of the Izaak Walton League, and the North American Lake Management Society. The no -wake zone has demonstrated improved water quality and some successful great blue heron nesting. Damaged aquatic vegetation appears to be returning. The no -wake zone formalizes protection for the unique and precious resources of Peltier Lake: the heron rookery, great egrets, eagles, rare plants, and high quality wetlands and shallows and waterfowl of all kinds. This year over 400 white pelicans stopped at northern Peltier Lake before continuing their migration north - without the protection now in place, the pelicans would have been forced out. The permanent protection now granted preserves these incredible resources now and for generations to come. The plan uses a provision in the Minnesota Wetland Conservation Act (WCA) for the creation of a Comprehensive Wetland Management Plan (CWMP). The CWMP will allow the wetlands of entire 53- 62 watershed to be managed as a single unit. Using this type of approach, the uplands are aggregated, making them more both more valuable and more usable; while the wetlands are combined making a higher - quality, contiguous wetland co greater biodiversity and better water quality function.
