ELECTION OF NEW OFFICERS Grundhofer made a motion to nominate O'Dea for office of Chair. Bor seconded the motion. Motion carried unanimously. Grundhofer made a motion to close nominations for Chair. O'Connell seconded the motion. Motion carried unanimously. O'Dea made a motion to nominate Smith for Vice Chair. Grundhofer seconded the motion. Motion carried unanimously. O'Dea made a motion to close nominations for Vice Chair. Grundhofer seconded the motion. Motion carried unanimously. The Board elected O'Dea as Chair and Smith as Vice Chair. The Board adjusted the seating arrangement to reflect the elections. 2. APPROVAL OF MINUTES February 23, 2005 Page 4, fourth paragraph: "The Emerald Ash Bore from the East was moving west and wiping out the Ash trees." Page 4, ninth paragraph: "O'Connell made a motion to recommend approval of the rezoning of the land, but conditional to ongoing work with staff on recommendations with the understanding that it will be reviewed at each building phase." 1 DRAFT MINUTES ENVIRONMENTAL BOARD MEETING MARCH 30, 2005 Page 5, eighth paragraph: "Mr. Schlink answered that there would not be a homeowners' association, and the monuments would be made durable." Page 9, fifth paragraph: Delete the paragraph. Page 10, seventh paragraph: "Chair Kukonen submitted an example of a large furniture company wanted to build a 10 -acre warehouse in the City." Kukonen made a motion to approve the February 23, 2005 meeting minutes. Bauman seconded the motion. Motion carried unanimously. 3. APPROVAL OF AGENDA • Discuss Marshan Meadows comments in 6E. • Discuss the Election of new officers prior to Approval of Minutes in 1A'. The Board approved the agenda as amended. 4. OPEN MIKE No citizen comments were made. 5. ACTION ITEMS A. Fairview Clinic Expansion Asleson reviewed the background and analysis. He indicated there was no photometric plan submitted to the City. Kukonen inquired about the Tree Preservation Plan. Asleson answered they needed to show the boundaries of the fences. The trees needed to be individually identified by species and size. Chair O'Dea asked for clarification of the seeded areas. Asleson agreed, and added that seeded grass needed irrigation. Bor indicated she worked for the Fairview organization, so she would be abstaining from the discussion and any vote. Grundhofer noted the lighting fixture was included, but it needed to be flush mounted. Asleson clarified the bulb placement was in question, and the bulbs should be recessed. O'Dea reviewed the recommendations from the Board: • Contingent on the submission of the Tree Preservation Plan identifying significant trees. • Areas seeded with turf grass must also be irrigated. 2 DRAFT MINUTES • ENVIRONMENTAL BOARD MEETING MARCH 30, 2005 • Lighting should be flush - mounted with recessed bulbs. • The new monument sign would follow the lighting specifications of the City. O'Connell made a motion to recommend approval with the recommendations from staff and the Board. Bauman seconded the motion. Motion carried with 5 votes and one abstention from Bor. B. Resolution Supporting CRT Waste Asleson briefly reviewed the resolution. Grundhofer asked if Asleson supported the resolution. Asleson indicated he supported the resolution. He was seeking a method that would not involve the taxpayers, and believed up front costs could be helpful. Chair O'Dea called for a discussion. Asleson stated that an important component should be no reliance on government solutions. Bor inquired if industry was working for a more compatible method of disposal. Chair O'Dea recommended the last word in the first line should be "have" instead of "has." In addition the areas indicating "(name of organization)," should have "City of Lino Lakes." Bor recommended adding a statement at the end of the document. "We support technological innovation to reduce or eliminate hazardous substances contained in these products." Grundhofer made a motion to support the resolution as amended. Kukonen seconded the motion. Motion carried unanimously. 6. DISCUSSION ITEMS A. Review and Comment of the Apollo Landing Draft Landscaping and Aesthetics Document. Asleson indicated he was willing to receive comments from the Board. Kukonen expressed concern about the environmental impact of treated wood privacy fences. He recommended using environmentally friendly and arsenic -free fencing. 3 DRAFT MINUTES • ENVIRONMENTAL BOARD MEETING MARCH 30, 2005 Grundhofer inquired if there would be parking in both the front and back of the building. If there would be parking in back, she suggested that native plantings could be used. O'Connell recommended that instead of the phrase "or other shade trees," put "and other shade trees." Grundhofer indicated that for #3 reference to "planter islands" they should also add the phrase, "include native plantings." In addition, paragraph #5 referencing site features, she questioned who was strongly encouraging these items. Asleson responded that it was an acceptable cultural expression. Grundhofer inquired about the "lighted planting beds." Asleson assured her that it would not have a lot of light pollution, and offered some security and artistic expression around plantings. Bor suggested reviewing the lighting ordinance. Asleson stated lighting could be inviting and improve the safety of the patrons. Kukonen questioned if in the reference to landscaping standards, should natives be suggested. Grundhofer inquired about various specific species. Kukonen stated there were a few fixtures still to be identified. Grundhofer referred to section B4, stating "dramatic effect," and recommended changing it to "artistic effect." Chair O'Dea inquired about the meaning of the term bollard. Asleson stated that it meant post. O'Connell questioned if the lighting on the sidewalks had downward focused lights on bollards. Grundhofer responded that the picture had shields. Asleson stated the lighting would still need to meet City requirements. O'Connell asked for clarification for page 5, part F. Since the hotel would be open 24 hours a day, would it address other businesses. Asleson confirmed that it concerned other businesses on site. Kukonen inquired about section C. Asleson responded that he was unsure of the specified height, but the light candles had specifications in the Lighting Ordinance. He added that it should be clarified. 4 DRAFT MINUTES ENVIRONMENTAL BOARD MEETING MARCH 30, 2005 Kukonen asked how "Exhibit T" could shine on the wall. Asleson answered that there was a dark cover on the front of the fixture so it would only illuminate the wall. Kukonen addressed Section D, 2c, if the recessed canopy light was acceptable, and requested a picture. The Board also asked that a picture be submitted of the bollards discussed in Exhibit 9. Kukonen made a motion for the comments from the Board to be passed on to the Council. Bor seconded the motion. Motion carried unanimously. B. Goals/National Wildlife Federation /Other Boards Grundhofer stated that the City would need a score of 375, based on the population of the City for the Community Wildlife Habitat designation from the National Wildlife Federation. She indicated that she was aware of five residents and one school already in the program. For the Education component, the City needed 40 points, and they were very close to that amount. • Kukonen indicated the kiosk contained information on native plantings, landscaping, and rain barrels. Chair O'Dea stated it would be worth having the PDF brochure in color copies. Grundhofer suggested that one category was to have articles in the media. Bor responded that there was a new Quad reporter, and she was excited to address various new community issues. Grundhofer indicated that residents could obtain credits from the University, and the City would receive 10 points for each person who completed them. She estimated that the City could complete 30 of the 40 points required for that category through the course work. Kukonen stated he came up with the sum of 50 points, because the library could be used, so he believed that the City had met the requirements for that category. Asleson mentioned he would try to set aside a portion of a shelf in the library specifically for environmental media. Grundhofer stated that she believed the City met the requirements of Community Projects, and gathered 55 points. 5 DRAFT MINUTES • • ENVIRONMENTAL BOARD MEETING MARCH 30, 2005 Asleson requested that Grundhofer and Kukonen pull the information together into one document. Bor stated that there were seven residents already registered, and inquired what process to become certified. Grundhofer responded one merely fills out the form online, and send in $15.00. Asleson indicated a resident was willing to organize residents in the Backyard Habitat program, and he referred the resident to Kukonen. Bor stated that the Board members could inquire in their neighborhoods. Grundhofer noted that the information could be put on the City Website. Bor added that a link should be created to the National Wildlife Federation. Grundhofer indicated that businesses and schools also would count. She mentioned that Rice Lake was already registered. Asleson added that Lino Lakes Elementary held an Arbor Day celebration, and he inquired about the initiation fee for schools. Both Kukonen and Grundhofer mentioned they would get in touch with their contacts for that information. Bor questioned the focus of the goal. Is the Board assessing the pursuit of the certification, or trying to become certified. Kukonen stated the Community Certification was a 2 -3 year process. He suggested some information in the Quad would be helpful. Bor inquired if the Board wanted to pursue the Community Certification as a goal. She considered it favorable if the community achieved it. It would be good for the education of residents and businesses. Several businesses could be very close. She suggested the Chamber of Commerce in the City be contacted. She reiterated the need to contact the National Wildlife Fund for the business and school costs for certification. In the area of other boards, the Board members stated the cities they would be responsible for contacting. O'Connell indicated she would find information for Golden Valley and Crystal. Bor volunteered to inquire about Ham Lake, and questioned Asleson if there was any environmental board in Centerville. Asleson responded there was no such board in Centerville or Circle Pines. Kukonen mentioned he would call about Afton. The City of Blaine was updated. Grundhofer indicated she would find information on North Oaks and Lexington. Bauman volunteered to inquire about Fridley, Oak Grove, and Ramsey. DRAFT MINUTES ENVIRONMENTAL BOARD MEETING MARCH 30, 2005 • Kukonen questioned staff if Shakopee had a board. Asleson answered that he should contact Mark Quinlin for that information. • • O'Dea recommended re- visiting projects, to find out what was effective, and what needed to be addressed in the process. She gave the example of the Grill and Chill. Bor agreed and requested a site visit and a reviewal of the process to assess the recommendations from the Board. Asleson suggested that the condensed files could be pulled. He agreed it would be helpful to visit the entire site, because there was a lot to point out. Options that were possible were to meet before a meeting on site, or to choose a Saturday in the summer and visit several sites. O'Connell requested to see comments from the Planning and Zoning Board, and the final comments to assess if the company made changes on their own or if the requirements changed after the Board made recommendations. Bor indicated it would be helpful to view the vegetation, and if possible go after a 100 -year flood event. She stated it would be good to go to one site in June to begin the process, and then do several sites on another date. She requested the recommendations from the Board be provided to members prior to the visit. Bauman indicated it would be helpful to revisit a residential, a large industrial, and a medium development. The Board agreed to table the discussion to the April 27, 2005 meeting. C. Fox Den Acres Asleson stated that Mr. Huvseth was working with the developer, and would also be present at the Earth Day celebration. Staff referred to a website called Rhode Island Basins that had recommendations for developments, and indicated that most of the suggestions were going to be done on the site. The developer had not yet broken ground, but was planning to do so soon. D. Earth Day O'Connell indicated the celebration would take place on April 23, 2005. Wargo would open to the public at 12:30 p.m. with popcorn available. Participants in the clean-up effort would be able to eat at 11:30 p.m. She noted that Wargo had announced the festivities in the Saint Paul Pioneer Press. Clean-up Day was planned for May 7, 2005. May 6, 2005 would be Arbor Day at Lino Lakes Elementary. 7 DRAFT MINUTES • • ENVIRONMENTAL BOARD MEETING MARCH 30, 2005 Grundhofer showed the Board a poster with a heron on it, and indicated she procured 400 for the Earth Day celebration, and any extra for Heron Days. She also had worm postcards for Earth Day. Kukonen stated the Living Green Expo would be soon after Earth Day. Grundhofer indicated the theme for Earth Day would be "Plants and People." E. Marshan Meadows Asleson indicated the EPA guidelines had everything the Board desired. Kukonen referred to page 3, and recommended the down spouts should be directed to green or pervious areas. Grundhofer stated that the Common Tern should be referenced. F. Heron Update Bor reported that they were a beautiful sight to see them on the scene, but the numbers were low. She indicated her brother witnessed a heron picking up a stick. Asleson stated that six of the raccoons were banded. He noted they were crossing over to the other shore, and another den was located. G. Netlawn Update Asleson noted that Rehbein had a promotional brochure it passed out at the Erosion Control Conference. Many people were using it. Grundhofer indicated that another type of pervious paving was used in Spirit Hills. Asleson indicated that Netlawn was used on an auto dealership in White Bear Lake, and there was no erosion found on site. 7. OTHER DEPARTMENT REPORTS A. Transcribed by: Brigette Blesi TimeSaver Off Site Secretarial, Inc. 9 DRAFT MINUTES • • • AGENDA ITEM 6A STAFF ORIGINATOR: Marty Asleson DATE: April 27, 2005 TOPIC: Settings of Woods Edge BACKGROUND: The Settings of Woods Edge is part of the Village of Woods Edge property that was reviewed in 1999. At that time the Environmental Board reviewed an EAW for The legacy of Woods Edge Development. The Council approved the EAW with a no- significant impact vote. Subsequently, as part of the Village Development, Hartford Group Inc. is submitting a proposal to develop the town home area of the Village using Town and Country Homes as builders, and Landform for the Civil engineering and landscaping. The proposed plan calls for 157 condominium units on 11.09 acres. The site is proposing 61.6% impervious and 38.4 % pervious. This is a sewer /water project, i.e. no septic. Analysis: Surface Water Surface water for this site is designed into the Village overall design. There are 2 ponds designed for this part of the Village (Attachment 3). There is a 10 wetland buffer proposed. In addition to the 10 ft buffer there is a retaining wall that is proposed with another 10 to 45 feet separating the wetlands from the project. There is a pond access trail for pond 3. There is not a pond access shown for Pond 1. Pond access on Pond 1 should be shown. Erosion Control Under the Erosion Control Notes of Attachment 5, language should include that all NPDES requirements will be met. In relationship to this, a detailed Storm water Pollution Prevention Plan must be on site, as well as inspection reports for weekly, and post rainfall events. Location of this plan and the inspection reports must be indicated on the plan. There is no discussion of storm sewer protection in the plan. The developer must provide a detail on storm sewer inlet protection. Floc socks or other protection devices must be indicated and utilized. In addition, as part of the SWPPP, language • • should include maintenance of Silt fences when silt fences are 1/3 full. In addition, a clean -out area for cement trucks should be shown on the plan. Permanent erosion control should include the City native seed mix in buffer, pond and areas outside the retaining wall. Grading All grading in pond and buffer areas should be done with low impact track -type equipment and fenced off after initial grading to prevent further compaction. All soils on sodded green areas should be roto - tilled as deeply as possible. All top soils should be toughly incorporated into subsoil to prevent interface issue. Landscape Plan Sodded areas are indicated by the shaded areas on the Landscape Plan (Attachment 8). All sodded areas must be irrigated and shown on the plan as such. All seeded areas with sod -seed must also be shown as irrigated. All areas on the east side in the buffer areas and pond areas should use the City Native seed mix specifications. All sodded and seeded turf areas should be thoroughly tilled to loosen compacted soils, and top soils incorporated into the subsoil so that soil - interphase is not present. This language needs to be incorporated into the Notes and written into the contract specifications. The plan calls for an Interesting selection of plants. I would suggest substitutions for Greenspire Linden and White Fringetree. Greenspire lindens are a little leaf linden and marginally hardy. White Fringetree is not zoned for Minnesota. Tree Protection A tree preservation plan is not presented as it should be in the submittal. The application package should show all significant trees, the significant tree diameters, and species. This information should be placed on the grading plan. Significant trees within 25 feet of the property line, bordering the regional park should be located. The root zone areas of these trees come on to the development property. The plan should show all tree protection measures to be taken such as fence locations for protecting remaining trees, and procedures to avoid oak wilt and construction damage to remaining trees and adjacent property trees. Land cover The Lino Lakes MLCCS shows a transition of vegetation from Oak forest on the South to Tamarack Swamp (off the Site) to the East. The Tamarack swamp was degraded in the 1960's when the highway came through. This Tamarack area has a high potential for restoration in the future. The development appears to have no impediments to this restoration idea. The oak woodlands for the most part start in the project area on the South and go into the Regional Park. Efforts to maintain integrity to this woodland in the Regional Park must be made. • • Unique Features The Tamarack bog to the East, although impacted is worthy of being called unique, and the real possibility of restoring this bog is attainable. The Lino Lakes Blandings Turtle Modal shows a possible breeding site and activity site to the East, but nothing on the site. There is a Bald Eagle nesting site to the East as well. If the nest is active during construction, recommendations of a 1/4 mile buffer are desirable, and 1/2 mile if the topography makes the construction visible from the nest. The nest is at t % is e t IeaS� i Ile away from the proposed construction. Most critical times for buffer concerns are from March 15 — May 15 North of Highway 210, and Feb 10 — May 1 South of Highway 210. There are no rare plant community indicators on this site. The site was evaluated during the EAW process for rare plants, and none were found. Lighting There is no submitted lighting plan at this time. OPTIONS: 1. In 2001, the Environmental Board reviewed the Market Place without user definition. The configuration of the buildings has changed however. Instead of three 6000 sq ft buildings there is now a 14,000 Sq Ft multi- tenant retail building. Analysis: Coversheet: Show Lino Lakes on the map and Not Brooklyn Park. Storm Water All surface water issues for 3rd Addition must be verified in conformance with previously approved plans for Market Place. This Plan has been modified with 2 larger pond areas vs. three smaller pond areas. The ponds should be designed so that they infiltrate and draw down to surface within 7 days. Regardless of the storm water plan, and in relationship to the desire to reduce impervious pavement, a pervious type of parking such as "perma- pave" should be considered for some overflow parking. Grading All grading in pond and buffer areas should be done with low impact track -type equipment and fenced off after initial grading to prevent further compaction. All soils on sodded green areas should be roto - tilled as deeply as possible. All top soils should be toughly incorporated into subsoil to prevent interface issue. Erosion Control Under the Erosion Control Notes of Attachment 5, language should include • that all NPDES requirements will be met. In relationship to this, a detailed Storm water Pollution Prevention Plan must be on site, as well as • • inspection reports for weekly, and post rainfall events. Location of this plan and the inspection reports must be indicated on the plan. There is no discussion of storm sewer protection in the plan. The developer must provide a detail on storm sewer inlet protection. Floc socks or other protection devices must be indicated and utilized. In addition, as part of the SWPPP, language should include maintenance of Silt fences when silt fences are 1/3 full. In addition, a clean -out area for cement trucks should be shown on the plan. Permanent erosion control should include the City native seed mix in buffer, pond and areas outside the retaining wall. Entrance points to the project should be designated and 50 Foot rock entrances installed. Site Vegetation The property was rough graded when Target and Kohl's came in. The site has been struggling with vegetation establishment for erosion control since the original grade was established. Landscape Plan The landscape Plan is included as attachment 8. Landscaping should conform to the original intent of Market Place. Proposed landscaping shows a gap on the west side of the 14K sq Ft building. The old plan however, showed 80 trees in the landscape and the new plan shows 97. Species are appropriate for the site. All proposed sodded areas must be irrigated. All planting beds for shrubs should be mulched with organic, earth -toned products consistent with other Market Place Areas. The Landscape Plan discusses sodded transition areas to natural areas. The only areas that this could be referring to are the pond areas. Native, i.e. natural areas would be difficult to maintain as a native seed area with the number of trees proposed for the site. A more formal native plant/shrub "rain garden" may be a better approach. With that a written and signed agreement must be given to manage and maintain this or any types of landscape on the site. Perhaps this could be part of the Target/Kohl's contract. As with the target/Kohl's site, a written statement of BMP's and a plan for action approved by the City should be supplied. Periodic impervious sweeping, trash and litter pick -up, replacement of dead or dying landscape materials, deicing salt storage on site, are important issues that should be tied down before agreement to develop is enacted. Tree Protection There are no trees on the site. • Lighting A Photometric plan is included as Attachment 9. The light fixtures would be the same type as the Market Place Design. OPTIONS: 1. The lot is in MUSA and will be serviced with sewer and water. The Lot is 32, 781 Sq Feet. The lot is located on the SE corner of Lake Drive and Main Street. Owner is proposing to build a building to provide for a car wash/ pet wash use. Analysis: Unique Resources There are no known rare or unique plant or animal resources on or near this site. There are no wetlands on the site. Site Vegetation The MLCCS is attached as Attachment 9. The oak area delineated in this area does not include the car wash site. Previous disturbance of this are has resulted in a Boxelder, Elm type of wooded area. There is a nice white spruce in the woodland. Regardless of the composition, the vegetation does lend itself to screening the business to the south and a residence to the East. Storm Water Since this site is less than an acre a RCWD permit, and a SWPPP is not required. The City is requiring that the developer maintain preexisting conditions for runoff and Storm water treatment. A recommendation from the Environmental Board should require this. Attachment 6 Grading Plan shows a pond to capture additional impervious runoff. This pond size will be verified for size need by TKDA. That information is not available at this time. The developer may also add pervious pavement to his design. If you recall, the car wash that came in 2 years ago had designed pervious parking and pavement at the exit of the car wash. This pavement at the exit would capture any soap residue running out of the building. Recommend this at the exit with or with out the pond. • Landscape Plan The developer is indicating sod on the perimeter and pond area. City native seed mix should be specified for the pond area as well as at least a three year agreement with an approved landscape company that is knowledgeable in the installation and maintenance of native landscapes. All sodded areas must be irrigated and shown on the plan as such. Vegetation and some trees have been removed from the site. Where the removal of existing vegetation has impacted the natural screening that previously existed, additional plant materials should be placed in the landscape, particularly on the East side where there is an adjacent residence. Larger type shade trees should be planted in place of the flowering crabs. A group of three crabs would be ok on the corner. Grading All grading in pond and buffer areas should be done with low impact track -type equipment and fenced off after initial grading to prevent further compaction. All soils on sodded green areas should be roto - tilled as deeply as possible. All top soils should be toughly incorporated into subsoil to prevent interface issue. Erosion Control The developer should provide a rock entrance to help keep soil on site. Tree Protection The Developer intends to keep the trees around the perimeter. In this case, the plan should reflect the location of tree preservation fence. This fence must be in place before soil disturbance occurs on the site. Parking There are 4 parking stalls planned for the project. The Zoning code does not require any parking stall for this type of use. If the owner would like parking stalls, perhaps a consideration for pervious parking should be considered. Lighting Attachment 3 is the lighting plan and photometric. The design meets the standard for residential and commercial sides of the building. The small picture of the fixture that is on Attachment 3 seems to show the type of light fixture we require. While the PDO established the general use and design parameters within the Market Place development, the Special Provisions section of Ordinance No. 16- 01 requires that the development of single tenant buildings on the site, including the proposed restaurant, be subject to site plan review approval in accordance with the Lino Lakes Zoning Ordinance. The applicant, Frauenshuh Companies, has now submitted an application to construct a 3,487 .sq.ft. building upon a 45,802 sq.ft. lot, as previously proposed in the PDO. The building would house a DQ Grill & Chill Restaurant. Planning and Zoninq Board The Planning and Zoning Board reviewed the request at its March. 12, 2003 meeting. The board recommended approval of the Site and Building Plans and CUP for the accessory drive through with the following. conditions: 1. Building elevations shall be modified to incorporate face brick consistent with the material types and colors used throughout the Market Place Development with the exception of the stone treatment on the "chimneys ", 2. Perimeter and interior landscaping will shall be provided in conformance with the MarketPlace PDO requirements. Islands located in the parking lot shall be landscaped and of sufficient width to accommodate the vegetation. 3. The plans shall be modified to the reduce the impervious surface to 75% or less. (Section 2.B), which delineate a number of materials, colors, finishes, and accents to be used for any building constructed within the Market Place complex, in order to achieve a uniform architectural aesthetic. Building materials requirements for single use tenants are particularly noted. in Section 2.B.5, which states: "Single use tenants shall substantially comply with the development standards outlined above while still maintaining their retail dress image. It is strongly encouraged that each building incorporate the gable end roof form and standing seam metal over the entry or on the comers to reflect the vernacular established by other buildings on the site." In conformance with the Planning and Zoning Boards recommendation the applicant has submitted revised building elevations that incorporate face brick consistent with the material types and colors used throughout the Market Place Development. Height According to the Zoning Ordinance, no building within a Shopping Center (SC) Zoning District may exceed 45 feet in height. At 20 feet in height, the proposed restaurant complies with the Ordinance. Landscaping Perimeter and interior landscaping, in conformance with the Market Place PDO master landscaping plan. The revised landscaping plan incorporates the tree types and quantities as setforth in the Market Place PDO. Additionally, landscaping parking islands, including overstory trees has been added to the plan. • City Council April 14, 2003 DQ Grill & Chill Site Plan Review & CUP Green Area The revised plans show 25.5% of the site area as green area in conformance with the district provisions. Access /Circulation Access to the site from Lake Drive (C.S.AH. 23) is via either Apollo Drive or the secondary entrance at Market Place Drive. A private road connecting Apollo Drive and Market Place Drive borders the eastem side of the site. An entrance /exit driveway from the site connects to this road. As stated in the Engineer's report potential queuing or stacking of drive through service traffic into the driveway entrance area and neighboring street is a possible concem. To mitigate this concern the plans have been revised to show the relocation of the ordering Kiosk westerly to accommodate additional stacking. Additionally, the drive- through exit has been extended slightly further south, eliminating one parking space, to route existing traffic through the parking lot more uniformly. Accessory drive- through facilities are subject to the following requirements: 1. The architectural appearance and functional plan of the building and site shall not be so dissimilar to the existing buildings or area so as to cause impairment in property values or constitute a blighting influence within a reasonable distance of the lot. Comment: The Site and Building Plans are consistent with the approved Market Place PDO. 2. At the boundaries of a residential use or district, a strip of not Tess than ten feet shall be landscaped and screened in compliance with Section 2, Subd. 4.S. of. this Ordinance. Comment: The site does not abut any residential districts. Landscaping will be provided around the perimeter of the site in accordance with the approved Market Place PDO Landscaping Plan. 3. Parking areas shall be screened from view of abutting residential districts in compliance with Section 3, Subd. 4.S of this Ordinance. Comment: The site does not abut any residential districts. 4. The proposed sidewalk width has been reduced to six feet, consistent with the remainder of the Market Place sidewalks to provide separation between the sidewalk and parking stalls on the southeast side of the site. • City Council April 14, 2003 DQ Grill & Chill Site Plan Review & CUP Lighting Lighting fixtures are shoebox style with downcast lighting, in conformance to City standards and similar to fixtures within the rest of the Market Place complex. The lighting plan meets with the approval of the CPTED review. The Market Place PDO requires that any building- mounted accent lighting should conform to standards noted in the PDO. Accent lighting is proposed for the building and staff are working with the applicant to insure that minimal direct or sky- reflected glare results. Signage Signage is govemed by the City's sign ordinance and permits are required for all signs. All signs will be reviewed with the sign permit applications. The Lino Lakes Market Place PDO, Section 2.C.1.d, states that wall signage for single tenant buildings within the Lino Lakes Market Place complex "shall be designed in accordance with the sign requirements of the Shopping Center (SC) Zoning District as specified in Ordinance No. 12 -97" (Lino Lakes Sign Ordinance). According to the Lino Lakes Sign Ordinance, wall signage in the SC District is limited to one wall sign, which is limited in size to 100 sq.ft. or 20% of the building face, whichever is less. The Market Place PDO, provides for one monument sign on the site in accordance with the approved design standards. Trash Trash equipment will be confined to a fully enclosed structure, which will be constructed of brick to match the principle building and located at the southeast comer of the site. Utilities A utility plan has been submitted for review by the City Engineer. Water and Sanitary sewer service were provided to service the site as part of the Market Place development. As a condition of plan approval, the utility related modifications and comments, as set forth in the City Engineer's memo, should to be incorporated into the final plans.. Copy of Drainage Calculations submitted by BKBM Engineers to Rice Creek Watershed District and dated February 7, 2003. 3. Plans previously submitted to the City and titled "Lino Lakes Marketplace ", prepared by Parsons Transportation Group, Inc. for Ryan' Companies, USA, dated October'3, 2001. Comments - General The project site is located adjacent to the east side of Lake Drive (CSAH 23), just north of I -35W. Any type of temporary access or work within the right of way will be subject to the review and approval of Anoka County. Any work within the County Right -of -Way requires a permit from the County. The Developer shall be responsible for attaining said permit and adhering to any other conditions of the County as required. The plan review has been performed in conjunction with plans previously submitted and titled "Lino Lakes ' Marketplace ", prepared by Parsons Transportation Group, Inc. for Ryan Companies, USA, dated October 3, 2001. The Chill and Grill site generally conforms within the scope and layout of the larger Marketplace area plan. The Contractor shall adhere to working hours for construction activities in accordance with the requirements of the City of Lino Lakes. A single entrance from the east (Marketplace area) is provided for the site. Potential queuing or stacking of drive through service traffic into the driveway entrance area and neighboring street is a possible concern. The proposed construction appears to be consistent with similar types of facilities constructed elsewhere. However, based upon the configuration, it appears that there is enough stacking for only about 4 cars from the ordering kiosk, before spilling into the entryway. In addition, it is recommended that the drive- through exit be extended slightly further south (eliminating one parking space), to route exiting traffic through the parking lot more uniformly: Comments - Drainage Review and Calculations Hydro -Cad calculations have been reviewed and accepted. The proposed site is included within the greater area of the Lino Lakes Market Place Master Plan, which was previously reviewed and approved by the Rice Creek Watershed District. The proposed Dairy Queen Chill and Grill site generally meets the concept design presented in the permit previously approved. Grading, Drainage, and Erosion Control 1. The site area is approximately 1 acre in size. Although the site area has already been approved by Rice Creek Watershed District, erosion control measures will be required, and are addressed on the plans. 2. Under note 7, the Contractor shall provide a sweeper to clean streets and paved areas outside of the project site on a daily basis as needed. . 3. The Contractor shall confine all work activity, including storage of equipment and materials, to the site area itself. The Contractor's activity shall not impede or impact traffic access for other businesses and through traffic in the immediate area. All adjacent streets and access drives shall be kept clear at all times. Utilities 1. The proposed site improvements will be connected to either in place utilities or utilities constructed as part of the overall Lino Lakes Marketplace Plan. The Chill and Grill utility plan shows a combination of existing and proposed sanitary sewer, storm sewer, and waterfacilities. These utilities are not clearly defined as to which are existing and proposed, and whose responsibility it is to construct them. It does appear that all necessary supporting existing infrastructure has been constructed and is in place. . 2. A note must be added that the City of Lino Lakes Utility Supt. Shall be contacted at least 48 hours prior to any utility work, utility connections, or any work in the public right of way performed. 3. A note must be added that all sanitary sewer and water main installed as part of this project shall be installed; tested and accepted per the requirements of the City of Lino Lakes, Specifications of the City Engineers Association of Minnesota, the MinnesotaDepartment of Health, and the Minnesota Pollution Control Agency as required. Sanitary Sewer service pipe shall be SDR 26 or SCH 40 and ductile iron water.pipe shall be CL 52. Gate Valves shall be Mueller A- 2370 -20 with mechanical joints, meeting AWWA Specifications C500 -61. Additional shade trees should be incorporated in to the North and South boundary areas of the design. Island areas on the SE and SW sides of the building should include shade trees. ▪ Island areas on the SE and SW side of the building should include a native "ornamental style" ground story that complements the front island design of Target. ▪ Screening -type plant materials along Apollo Drive should be consistent with the landscape -scale design approved in the Market PlaciPlan. . Additional trees should be placed in the green area to the West of the building. - Additional shade trees should be placed along Apollo Drive. Added trees should be oak species. Northern Pin/Red Oak or Burr/White Oak. • • The City minimum standard for parking stalls should be used for the design of this site. • A suggestion was made to lower the parking lot light fixtures without adding additional fixtures. • That the surface water calculations for the site should not exceed the intended calculations approved by the original Market Place, after adjustment for lot size changes.
