Fifth paragraph change considerable too considerably. Ms. Grundhofer made a motion to approve the November 29, 2006 meeting minutes with changes. Ms. Bor seconded the motion. Motion carried unanimously. 3. APPROVAL OF AGENDA Remove Item 6B - Gary Averbeck Add Item 6E - Year End Summary for the Blue Heron Rookery Approval of agenda. Motion by Ms. Grundhofer to amend seconded by Ms. Bor to approve agenda as is. Motion carried unanimously 4. OPEN MIKE Open Mike closed at 6:34 p.m. 5. ACTION ITEMS 1 DRAFT MINUTES ENVIRONMENTAL BOARD MEETING DECEMBER 20, 2006 No action items. 6. DISCUSSION ITEMS A. EAW Jeff Smyser, City Planner, was present for the Nature's Refuge Review. Mr. Smyser stated that the comment period for the Environmental Assessment Worksheet ended Nov. 22. The EAW stands for Environmental Assessment Worksheet. The City of Lino Lakes is required to respond to the comments. The EAW will be presented to the city council on Jan. 8th. A decision on the EAW is not an approval or denial of the project itself. The document addresses environmental issues from an environmental standpoint. The document is an approach to get issues on the table and go from there. Ms. O'Dea asked if the neighbors would be notified of the January 8th, City Council meeting. Mr. Smyser stated as of this time, no. The meeting is posted in the City's legal newspaper, the Quad Press. He also stated we did send out notices to neighbors regarding the EAW as to where they could get a free CD or pay for hard copy of the document. We have received comments from a few of the neighbors. Mr. Smyser stated he will check into a notification mailing to the neighbors. Ms. O'Dea stated the Board will go through the document page by page. Page 4, Rare Species — The impact does not talk about what birds may be on site stated Ms. Grundhofer. Mr. Asleson stated he did not know of a list of birds. Ms. Grundhofer handed out her list of birds to be looked at. Mr. Husveth stated there are no known state or federal birds that have been listed on the property. There has been no formal survey conducted on the property regarding birds. Mr. Husveth stated that if there were state or federal birds, he would have noted it in the hundred of hours that were spent on the property. Ms. O'Dea asked if we could add a sentence to state this. Mr. Husveth stated yes. Mr. Husveth stated it does not mean there has never been or will never be any state of federal birds on the property. At this time, the answer is no, none to our knowledge. Mr. Husveth stated we can add to the EAW that there has not been an avian survey done as of September. Page 6, second paragraph - Mr. Bor questioned the impact to the school and the HVAC systems infiltration. Ms. Bor stated that perhaps the school children could be outside during the noon hour when development/construction would be less likely. Mr. Bor added she would like an awareness of wind born particles. Mr. Asleson stated that MPDES requirements have gone up as to wind born erosion. There are things the city does to prevent air born particle counts. 2 DRAFT MINUTES • • • • • • ENVIRONMENTAL BOARD MEETING DECEMBER 20, 2006 Page 7 — Mr. Bor asked who will be responsible for upkeep of the property development. Mr. Husveth stated this issue is addressed in the DNR's comments which are further on in the document. Page 9, bottom — The City of Columbus addressed the use of Pine Street. Mr. Smyser stated this Pine Street is one of two ways to access the development. Page 11, 2nd response - Ms. O'Dea stated we would like it to read seven acres. Page 11, 5th response - Mrs. Grundhofer asked about the floodplain. Mr. Husveth stated that wetlands have been delineated and submitted to Rice Creek Watershed District. Page 12, 4th response - Ms. Bor suggests that people buying properties provide a signed document stating they understand the developments requirements. Mr. Smyser stated we would look at adding a sentence that the city make a special effort to give the new homeowners documentation. Ms. O'Dea stated that the Homeowners Association should take on this responsibility. Page 14, Wildlife Habitat — Mr. Grundhofer questioned the proposed 55 percent of trees to be coming down, and that we should be looking at the whole city, not just that piece of property. Mr. Husveth stated that under the second bullet point on the document the focus of the response is regarding the Blanding's turtle. Mr. Husveth addressed this issue in other areas of the EAW. Mr. Husveth stated that this development should increase the biological integrity when completed. Page 15, Other, typo on sentence 4 — Change to read project will result in instead of project will result I. Mr. O'Dea then asked for a vote to either recommend or return to staff. Ms. O'Dea made a motion to recommend the adoption of the record of decision. Motion by Ms. DeHaven to amend seconded by Ms. Grundhofer. Motion carried unanimously. B. Gary Averbeck — Removed C. Environmental Board Goals — Changes below. Page 1, first bullet point, B: Take out the coma after inventory. Page 1, second bullet point from bottom: Take out onto and add as well as. 3 DRAFT MINUTES ENVIRONMENTAL BOARD MEETING DECEMBER 20, 2006 The Board talked about adding a goal deadline. The Board will discuss additions or changes to the goals at their January meeting. The Board members discussed a format to be used as a summary of past Environmental Board recommendations for development projects. D. Resource Management Mr. Asleson gave a verbal update on the Resource Management Planning/TMDL Study Update. Ms. Hogstad was asked to email the Resource Management Planning document to the Board members for their review. Mr. Asleson stated that he is looking at the plan with an environmental approach. Ms. Bor asked about the partners involved in this project. They are the City of Columbus and City of Lino Lakes. The document is being prepared by Emmons and Oliver Resources for the Rice Creek Watershed, in cooperation with the City of Lino Lakes and the City of Columbus. Mr. Asleson stated that the document should be released to the public in the month of February for comment. E. Year End Summary for the Blue Heron Rookery Nothing was discussed on this. 7. ADJOURN It was noted that the next meeting of the Environmental Board will be on January 31, 2007. Transcribed by: Lisa Hogstad Community Development Secretary 4 DRAFT MINUTES • • • Agenda Item 7A • • Staff Originator: Marty Asleson Environmental Board Meeting Date: January 31, 2007 Topic: Comforts of Home Planned Unit Development (PUD) Applicant: BACKGROUND: Request: CORE Development CORE Development has submitted an application for a Mixed -Use Planned Unit Development (PUD) to be known as "Comforts of Home ". The project includes four commercial /retail buildings of various square footage (range 5,000 SF to 55,000 SF), a 41 unit senior apartment building, a 42 unit senior assisted living building, and 48 senior townhomes. Site Location: The project is located in the NW quadrant of Hodgson Road and County Road J. Site Data: Gross Area: 17.18 acres Upland Area 16.72 acres Wetland .46 acres Land Use and Zoning: The City's Comprehensive Plan guides the site for mixed use development. The site is zoned GB, General Business District. ANALYSIS: Land Cover: The land cover for the property consists of forested and grass lands. Forested areas include both deciduous and conifers trees. A .5 -acre wetland is located in the northwest corner of the site. • • Rare and Unique Resources There are no recorded rare, threatened or endangered species on this site. Parks, Natural Open Space/ Greenways and Trail System Plan: The City's Plan identifies a potential greenway and trail extension across the northern portion of the site. Wetlands: One wetland is located on the NW side of the property. The wetland delineation was approved previously by Rice Creek Watershed District (RCWD). This delineated wetland is highly impacted. The wetland is inundated with Buckthorn and other noxious plants. It is recommended that that the developer be responsible for all noxious plant removals on the property. This wetland should be cleared /killed of all buckthorn and other noxious plants No direct permanent wetland impacts are proposed. However, temporary impacts are proposed in conjunction with the installation of a storm sewer outlet. Care should be given to ensuring a minimum disturbance and that the existing soils are indeed placed back on top of the pipe. Soils in the wetland will most likely be exposed when noxious plants are removed. The City native seed mix should be used to restore the wetland, as well as all disturbed infiltration pond, swale and wetland areas. No buffer is proposed around the wetland. The City's subdivision ordinance requires a minimum 10 foot buffer be provided. A trail and parking lot are proposed immediately adjacent to the existing wetland. These proposed structures should be relocated to provide the minimum buffer. No direct drainage to the wetland from impervious areas is allowed. Proposed drainage plans indicate direct runoff from impervious surfaces to the wetland. Drainage patterns should be corrected. Soils The soils on the site proposal are upland, non - wetland types of soils, except where the wetland was delineated in the NW corner. The upland soils are highly permeable and should be used to the greatest extent possible to infiltrate storm water. On the other hand, precautions should be taken with these soils when proposing fueling stations and that there is no potential to contaminate ground water. This site does propose a fueling station. A fueling site spill containment area • should be designed into the plan if this fueling station goes forward. • Any importing of soil onto the site should be reviewed and approved by the City Engineer prior to placement on the site. All soils compacted by construction should be loosened to preconstruction conditions. • Surface Water Surface water is ultimately tributary to Baldwin Lake. The project proposes three wet detention ponds and several small infiltration areas (rain gardens). Stormwater is proposed to be routed to the existing municipal stormsewer system located in the southwest corner of the site. The system will need to satisfy the City's discharge rate requirements (no net increase) as well as Rice Creek Watershed District infiltration requirements. Impervious parking areas should be kept to the minimum allowed under our City code. The pervious nature of the existing soils does allow opportunities for increased infiltration on the site. However, the high ground water level on the site may pose some limitations. All infiltration areas must have a minimum three feet of separation between the bottom of ponds and the ordinary high ground water level. The developer must demonstrate that this separation will exist. All ponds designs should include the use of for -bays to pretreat water entering ponds and allow for more efficient maintenance. There does appear to be opportunities for a significant portion of the surface water running off of the parking lots could be infiltrated with the use of stormwater bmp's such as the use of pervious pavers, pervious asphalt, and other periphery bmp's such as drainage swales, and rain gardens. Access to all surface water treatment areas must be provided for and indicated on the plat proposal. A storm water maintenance agreement will be required to insure proper maintenance of the systems. Storm Water Pollution Prevention Plan The developer has submitted a Storm Water Pollution Prevention Plan (SWPPP). The SWPPP must be approved and implemented prior to the commencement of a grading permit. A number of modifications to the SWPPP have been identified and will need be incorporated into the final plan as identified in the attached SWPPP memo. Tree Preservation A Tree Inventory was submitted by the developer. 11 trees were found and idenfitied on the inventory as specimen trees. A "Specimen Tree" is defined as a healthy hardwood tree measuring equal to or greater than thirty (30) inches in diameter and /or a coniferous tree measuring fifty (50) feet in height. Five of the trees are located either off site or in the proposed Hodgson Road right -of -way. • Of the remaining 6 only one appears to have the potential to save. The inventory notes that 340 trees are proposed to be saved. However, the vast majority of these are located in the proposed Hodgson Road right -of -way and will need to be removed. No preservation plan was submitted for trees identified as saved. Trail A pedestrian /bicycle trail is proposed across the northern portion of the site. The trail extends from Hodgson Road to its connection with an existing City trail located on the west side of the site. The trail alignment is generally in conformance with the City's trail system plan. As noted previously the trail encroaches into the required wetland buffer. The trail should be relocated accordingly. Lighting A photometric lighting plan was submitted. The plan appears in conformance with the City's lighting requirements. The plan proposes both a decorative lighting fixture for street lighting as well as a standard shoebox fixture for parking lot areas. All the fixtures appear to conform to the City's 90 degree cutoff requirement. • Landscape Plan • General. The Landscape Plan depicts a planting schedule of deciduous and evergreen trees, shrubs and perennials. Plant materials are not adequately labeled on the plan. The schedule should show ground story/cover planting schedules. All tree and shrub species should be selected and identified in accordance with City requirements. If there is sod planned as a ground story plant, then the sod areas must be irrigated and shown as such on the plan. The plan should indicate that all topsoil will be tilled into the sub -soils as deeply as possible. Screening /Adjacent Neighborhoods. Where commercial areas abut residentially zoned properties the site is required to provide screening along the boundary. The screening is required to provide 80% opacity to a minimum height of six feet at time of planting. The proposed screening along the western boundary of the project does not conform to this requirement. A revised planting plan should be submitted in conformance with this requirement. Rain Gardens. Rain gardens are shown on the grading plan. A landscaping design plan for these gardens should be submitted. The plan should include a detailed schedule of plants i.e, types, location, quantity. Provisions for the upkeep and maintenance of these areas should be incorporated into the required stormwater maintenance agreement. Parking Lot Islands. The large parking lot shows a number of islands. Small islands do not afford desirable planting conditions for trees. Consideration should be given to combining areas of smaller islands into larger islands. Further consideration might be given to treating these areas with dropped curb, and slopes to the islands to filter parking lot runoff. These might be formal plantings with designed rain garden characteristics (would also include trees). Pond Areas. All surface water areas not formally planted, or exposed pond, infiltration or wetland areas should be planted with the City Native Seed mix.. All native planting areas should include an annual maintenance program to insure survivability. RECOMMENDATION: Staff recommends that the following modifications be forwarded to the Planning & Zoning board for consideration: 1. Invasive species within the existing wetland should be eradicated as part of the site development. 2. The site should be modified to incorporate the required 10 foot buffer around the wetland. 3. A fueling site spill containment area should be designed into the plan. 4. Importing of soil shall be subject to review and approval of the City Engineer. 5. Pond designs should incorporate the use of for -bays for pretreatment and ease of maintenance. 6. Evaluate use of infiltration bmp's to treat parking lot runoff. 7. Provide adequate vehicle access to pond and infiltration areas. 8. A storm water maintenance agreement be executed between the City and Developer which includes a maintenance schedule for native planting and rain garden areas 9. The SWPPP be modified to incorporate the comments included in the SWPPP memo 10. A tree preservation plan shall be submitted. 11. A revised landscaping plan shall be submitted in conformance with City requirements including screening plan for the west side of the property, rain garden planting schedules and irrigation. 12. The area of parking lot islands should be increased to improve planting conditions. 13. This SWPPP must have the responsible manager listed and a 24 hour phone number that this person can be reached. 2. The SWPPP must address dewatering and ensure that no turbid dewatering is done to receiving waters. 3. An alternative /temporary pond should be designated and located on the plan. Dewatering using a temporary perforated outlet is acceptable. Final stabilization note should indicate stabilization will be done with the City native seed mix. Canada wild rye can be increased in the city mix to address any quick stabilization concerns. 4. The site plan must show the location of the SWPPP's location on the construction site, as well as weekly and post rainfall event inspection reports. An onsite mail box is recommended for storing SWPPP information so that the information is available to our storm water inspector. 5. All existing and new storm water catch basins must be protected with a city approved device. Infrasafe, Wimco, or a city approved substitute is required. Filter fabric will not be allowed. 6. The concrete washout area shown on the plan must be designed so that water and material does not leave the wash -out area. If the washout area becomes plugged because of concrete residue, than the washout area must be cleaned out. The developer must indicate to the City how these materials will be disposed (recycled) of. 7. The indicated rock entrance must be installed before grading occurs. A stockpile of rock is recommended to be on site for top- dressing sediment filled rock. Brock White -type "mud mats" may be a suitable substitute for the rock entrance. ATTACHMENT 6 8. All pond, infiltration, and rain garden areas must be analyzed for potential groundwater pollution. There should be at least 2 -feet of sand separation between the bottoms of water bearing structures and the normal high elevation of the ground water. 9. All proposed infiltration, pond and rain garden areas must be protected from construction traffic and compaction. These areas must be fenced off and built as on of the grading operations. Low impact equipment should be used to construct water treatment/pond areas. Soils must be loosened to pre construction capacity for infiltration if compacted. 10. All exposed soils, shall be covered and seeded to the City's satisfaction. All perimeter and areas determined to have an erosion potential, shall have fence, compost berms, or properly installed fabric socks installed. It is recommended to have a stockpile of compost or socks on site to quickly solve erosion issues. 11.AII SWPPP violations will have a 24 hour correction period. After this the City will take action to correct inefficiencies. This may include red -tags, project shut- downs, and outside contract for work to make corrections. Amend Conditional Use Permit Holiday Stationstores, Inc. Holiday Stationstore, Inc. has requested to tear the existing Holiday Stationstore down and rebuild on the site. Site Location: The Holiday Stationstore project is located on the existing Holiday Stationstore site at 7509 Lake Drive (Attachment 1). This is directly across Lake Drive from City Hall. The store is located in a General Business District. The total site area is 165,271 sq. ft., or 3.8 acres. The new store includes a car wash and retail store. ANALYSIS: Land Cover: Not surprisingly, the existing land cover is 70 -80% impervious cover in the used areas (Attachment 2). The back unused side of the station is classified as short grasses on upland soils. Rare and Unique Resources: None to consider Wetlands: There are no wetlands on this site. The wetland area that is shown on the map is actually an artificial hole that was dug years ago. Surface Water: All of the surface water from this site wants to go to the ditch just south of the property. This ditch flows directly to Marshan Lake. The water is received into the ditch about 1800 feet to the south (Attachment 3). • Referring to the submitted Grade Plan (Attachment 4), surface water runoff is directed to a NURP (National Urban Runoff Pond), out of that pond with a skim pipe (no elevation determined on outlet) into an infiltration pond, then piped to the south side of the project and released. Additional infiltration may be achieved if this piped section were replaced with open drainage swale with check dam berms and native vegetation planted. Recommend the City engineer look at this option. Access locations to pond and infiltration areas must be shown on the map. There are more parking stalls being proposed for Retail and Stationstore than are the minimum required. Parking should be kept to the minimum required. It would be beneficial if the developer would be willing to use permeable pavers in some of the parking areas, then it does not matter how much parking is proposed. Pump Stations: Pumps stations should be designed with spill- containment feature. Car wash: Car wash should drain to sanitary sewer. It is unclear from the map whether wash water is going to sanitary sewer or storm sewer. BMP's to keep prosperous and other car wash residue on site should be used. Previous car wash projects have designed pervious surfaces at the car wash exit. Recommend this design be looked at. Storm Water Pollution Prevention Plan: There are two pages that describe the SWPPP. Attachments 8 and 9 are called Erosion Control Plan and Erosion Control Details respectively. These two sheets should be called Storm Water Pollution Prevention Plan or SWPPP. Tree Preservation: The plans should include a tree inventory. The only trees on the site are trees to the West of the existing building. The trees are red oak, pine, and boxelder. The plan should indicate these trees as removals. Landscape Plan: A landscape plan is provided as Attachment 10. Sod planted areas must be irrigated. Top soil should be tilled as deeply as possible into existing sub - soils. Screening the western property line must meet 80% opacity. I would not rely on existing pines on the neighbor's property to provide this screening in that they are overstocked, disease prone, and storm damaged. Storm pond and infiltration areas should be planted with the City native seed mix and modified with enhancement plant plugs to achieve flowering forbs at a density of one every 5 feet. A planting schedule should be submitted with native seed and plants included. A contract with a City approved landscape company, that is knowledgeable and experienced in native plant installation and maintenance, should be submitted. The contract should cover installation and maintenance for 110 at least the first 3 years. If a burm is possible at the end of the third year, this should be included in the contract. A landscape plan should be submitted for the Retail store location. Lighting: There is no "Lighting Plan" in the submittal. There is a Tight level map submitted as Attachment 11. There is also a canopy, elevations & signage plan submitted as Attachment 12. A detailed description of all exterior types of light fixtures needs to be submitted including the intentions of lighting the canopy. All lighting needs to conform to the City Code. Canopy lights should be recessed into the canopy. OPTIONS: 1. Recommend approval with staff and Environmental Board recommendations 2. On Attachment 8, under Erosion Control Notes, language should include NPDS compliance. 2. The second paragraph of the Erosion Control Notes, that "stone pads will be installed at all entrance /exit points." 3. The fifth paragraph of the same section should start out with "The contractor.... ", and the part about "when at all possible" removed. 4. The 6th paragraph should add "sediment deltas removed and slope erosion repaired in 7 days." Erosion and sediment control notes must include: • Narrative /project description, and purpose and goal of the project. • List of sequence of all soil disturbance activities. • Identify receiving waters. • Describe erosion control practices. Describe each control, its purpose, materials required, and installation methods. • Describe sediment control, its purpose, materials required, and installation methods. • • ATTACHMENT 13 • Describe post construction stormwater management controls and why they were selected. • Inspection and BMP maintenance plan.
