Although progress is being made, it is apparent that the terms of a renewal franchise ordinance will not be agreed upon and adopted by 1 October 1999. In order to preserve our rights under the existing franchise and to provide enough time to negotiate a renewal ordinance, it will be necessary to extend the agreement through 18 February 1999. Gary Uhde, the developer of Behm's Century Farm's 5th addition, is requesting the vacation of the following described property to facilitate the final platting of his 5th Addition: 1. Laurie Avenue between Palomino Lane and Carl Street. 2. The north 3' of Palomino Lane (old Thomas Avenue) between Sunset Road and Mustang Lane. Those issues involved lighting, ponding, parking of tractor /trailer units, and additional landscaping on the southerly side of the property. Staff would comment on these items as follows: 1. The lighting fixtures have been diffused under the canopy area and the south side area lights. We have not, however, received a lighting schematic indicating the candle power of these diffused units. 2. The ponding area bas been surveyed by Metro Land Surveying & Engineering. they have provided a letter to the City indicating that the total volume of the pond is larger than originally proposed. Staff would require submittal of a large scale plan for review and approval by the City Engineer. 3. Parking of truck/tractor units: a. Parking of truck/tractor units has been discussed at previous Council Work Sessions with questions raised concerning enforcement. The City Attorney has advised staff that we can not prohibit the parking of these vehicles without adopting an ordinance, applicable to the general populace, that would prohibit such parking. Should an ordinance be adopted the Police could ticket the individual truckers for violations. b. As an alternative, the City Attorney has indicated that we can limit the number of parking spaces, restrict the hours of parking and prohibit parking vehicles with running refrigeration units as a condition of the Amended CUP. The permit holder is responsible for meeting the conditions of the permit. To enforce them, the City could revoke the CUP. Revocation would shut down the business. • • • 4. Fencing /landscaping: The applicant has provided a sketch and letter indicating that additional screening will be provided along the south property line by the extension of the existing board on board fence to the south/westerly property line. Staff would suggest some additional evergreen plantings, similar to the existing plantings, on the north side of the fence to act as an additional sound barrier between the parking area and the south property line. In summary, staff would recommend approval of this Amended Conditional Use Permit with the following conditions: 1. Proper permits be obtained from all affected agencies. 2. The City Engineer review the ponding survey to confirm compliance. 3. Site lighting shall conform to the requirements of the Zoning Ordinance in relation to light and glare and the applicant shall supply a photometric lighting plan to confirm compliance. 4. A 6' board on board fence shall be installed along the south property line to the south/west corner of the site. Additional evergreens shall be planted along the new fence line to provide a double row of evergreens, 10 feet apart. 5. The parking lot shall be striped to provide ten (10) tractor /trailer parking spaces in designated areas only. 6. Conditions 1 through 8, contained in the original permit, granted May 11, 1992 shall be made a part of this permit (conditions attached) 7. We have contacted the applicant who agreed to continue the discussion to the 9/22/99 Work Session and 9/27/99 Council meeting. Staff has discussed the matter with the City Attorney and explained that the issues include: 1. Parking of tractor /trailer units on the site for extended periods of time. 2. Noise and diesel fumes from the parked units. 3. Enforcement of any parking limitations. 4. Possible revocation of the CUP for violations. 5. Possibility of an ordinance prohibit parking of certain types of vehicles. Mr. Hawkins indicated that we could impose parking restrictions as a condition of approval for this amended CUP and /or limit the number of spaces provided for said parking. He indicated enforcement would involve notification of any violation to the owner with a time period provided for correction, then notification from the City Attorney that violation must cease or a criminal citation would be issued with further court prosecution. The citation and prosecution would involve the holder of the CUP, not the individual truckers. We will be prepared to review these issues with the Council at the next work session. In the interim we would like to continue this item to the 9/27/99 Council meeting. I, like a dozen other truck owners, feel this is wrong. I fuel our trucks at your facility, and I have for years. There has been times when after fueling, we park for a few hours, before leaving on a trip. Because the load is heavy, and can't be park- ed on the street just anywhere, we now are told that are business at Oasis is with the attitude, "Pay for your fuel, and get off the lot ". I hold a Fleet Fueling card from Amoco, And spend Thousands of dollars a year at your truck stop. If this is the attitude Oais is going to have for the bus- iness we bring to you, Myself and alot of other truck owners will find other facilities to buy our fuel at. As far as the things said about Drugs, and other things, this is all a sham to put leverage on Twin Cities Stores to get there demands. I know that all these things to be untrue, as I have lived here 30 years. Our complaints have been expressed repeatedly many times over the past years. We live at 7481 Lake Drive for the last 35 years. We have addressed our complaints to the Building Inspectors Pete, and Tom, Mary Kay Wyland, and we have invited Mayor Sullivan on October 23, 1998, to visit our home to see and hear what goes on, but she has never honored our request. John Miller told us that there was to be a large sign posted stating the rules of truck parking, that was many years ago and several gas station owners. John Miller stated that there was a 2 hour truck parking, no sleeping and no unattended trailers or truck and trailers, also a fire lane sign was to be posted. Today, there is still NO rules or regulations Hosted for truck drivers. There should be no reason for truck trailers left running unattached, unattended from a truck. Example: Memorial weekend, this past week (May 28, 29, 30, and 31, 1999) there were 10 trailers parked with only 2 trucks attached to the trailer. The one trailer (NO TRUCK ATTACHED) had refrigeration running 24 hours a day, Friday night, all Saturday, all Sunday and Monday late. There was loud radio noise at 11:55 P.M., you couldn't sleep. There has been times when all parking spaces for truck/trailer were full and they parked double and then single along the south property line. Last summer when putting in the water and sewer for the new Town Center a nick -ur truck went behind the semi- trucks in the grass and camped for the week, gas transport trailers parked unattended and unattached from a truck. We have given pictures to Tom the Building Inspector, regarding the truck parking and the lighting at the station. The lights, light up our whole yard. They are blinding when turning into our driveway at night. In the past there were drugs being pushed, extra loud noises and it doesn't make any difference who the owner of the gas station is, OUR CONCERNS HAVE NEVER BEEN FULLY ADDRESSED AND CARRIED OUT. Yours, COUNCIL MINUTES JUNE 28, 1999 • Oasis Market/Amoco, 7509 Lake Drive, Amended Conditional Use Permit, Mary Kay Wyland - Twin Cities Stores Inc., DBA Oasis Markets is the current owner of the property and is requesting this Amended Conditional Use Permit to allow two (2) additional gas pumps to be located on the Lake Drive side of the building. These gas pumps were shown as "future pumps" on the originally approved site plan. Staff has reviewed the request and recommends approval of the additional pumps. There appears to be adequate maneuvering space in this location and no parking will be displaced. Staff does, however, have some other concerns that need to be addressed which include truck parking, lighting, and drainage. The Planning and Zoning Board held a public hearing on June 9, 1999. After considerable discussion, they recommended approval of this Amended Conditional Use Permit with conditions. Buffering on the south boundary of the property was discussed. Several trees between this business and the residence to the south were lost in the storms last year. This particular area also includes an easement and the City has constructed utility service on the easement. A future roadway may also be constructed between the property and the residential property to the south. There may not be room for additional buffering. Mr. and Mrs. Skoglund, 7481 Lake Drive, property owners on the south boundary of this property came forward and presented their concerns. Cecil directed staff to determine which trees need to be cleared by the property owner. Staff will contact the Skoglund's re indicated he would contact the owner of the prope f connections in that area. He stated he would meet with the neighbors after the shields are installed to make sure they are acceptable. Council Member Lyden moved to table the Amended Conditional Use Permit for 30 days until the following conditions are met: 1. Proper permits are obtained from all affected agencies. 2. Consider Approving Signage Request from Kathy Hansmann, Brian Wessel - Jeff and Kathy Hansmann are the owners of Fast Break Corner Market, which is under construction at the southwest corner of Lake Drive and Apollo Drive in the Town Center area. The Hansmann's want to install a 25 -foot high monument style sign on one corner of their building site. Current City ordinances allow such a sign. However, projects in the Town Center area are usually approved by the City Council upon the recommendation of the Planning and Zoning Board with the condition that design issues are reviewed by a staff/citizen group known as the Town Center Committee. The Hansmann's signage request was approved by the City Council in August 1997, but has not been considered by the Town Center Committee. It has been reviewed by staff and consultants who indicate that a 25 -foot high sign is too high and that a 14 -foot high sign would be more appropriate. The Hansmann's are requesting that City Council approve their request without referring it back to the Town Center Committee. STAFF ORIGINATOR: Mary Kay Wyland DATE: June 9, 1999 TOPIC: PUBLIC HEARING, Oasis Market/Amoco, 7509 Lake Drive, Amended Conditional Use Permit BACKGROUND: The City issued a conditional use permit in May of 1992 to raze and rebuild the Fina Mart at 7509 Lake Drive. This permit was extended in April of 1993 and again in 1994. Permits were filially issued for the construction in August of 1995. Twin Cities Stores Inc., DBA Oasis Markets is the current owner of the property and is requesting this Amended Conditional Use Permit to allow two additional gas pumps to be located on the Lake Drive side of the building. These gas pumps were shown as "future pumps" on the originally approved site plan. Several months ago City Staff spoke with the Oasis Market Manager and a representative of the petroleum company concerning this expansion and advised them both that action by the City was necessary for this expansion. The manager and petroleum representative are no longer with the respective companies and consequently failed to communicate this requirement to the appropriate parties. City Staff noticed the construction early this spring and stopped the work until the appropriate city approval could be received. Therefore, this application is before you. The pumps are in place but are not in operation pending approval. Staff has reviewed the request and would recommend approval of the additional pumps. There appears to be adequate maneuvering space in this location and no parking will be displaced. We do, however, have some other concerns that need to be addressed. TRUCK PARKING: When the permit was issued in 1992 to raze and reconstruct there was discussion concerning truck and trailer parking on the site. At that time, the owners representative assured the City Council that signs would be placed indicating a two hour maximum limit on the parking of trucks on the site. Staff has received numerous complaints from the adjoining property owners concerning the parking of trucks and the storage of Trailers on the rear of the property. Trailers are often left unattached with their refrigeration units running for hours and days, especially on holiday weeks. Mr. and Mrs. Skoglund indicated that over the recent Memorial Day Weekend ten (10) trailers were left parked on the site, only two with the tractor units attached. This has been a continual problem on the site and the present and past management have been unsuccessful in curbing the problem. Additionally, no sign is apparent on the site. • We would recommend that a condition of approval include the placement of a sign on the rear parking lot, and within the building, that truck/trailer parking is limited to a maximum of two hours and that overnight parking of trucks, tractors and trailers is prohibited. We would further recommend that this sign be placed prior to the pumps becoming operational. LIGHTING: Complaints have also been received concerning the site lighting. Apparently new canopy lights were installed that have intensified site lighting. The property is Zoned R -1X and according to the Zoning Ordinance Section 3. General Provisions, Subd. 4 T. Fences and Walls. Fences and walls shall require a building permit and shall be permitted in all yards subject to the following: 1. Height. b. Should the rear lot line of a lot be common with the side lot line of an abutting lot, that portion of the rear lot line equal to the required front yard of the abutting lot shall not be fenced to a height of more than four (4) feet. The Zoning Ordinance additionally provides 4. Residential istrict, ,R. end. Fences in residential districts may be located in any yard to a height of four (4) feet, except that a fence up to six (6) feet may be erected from the front facade of the principal building to the side and/or rear lot line As mentioned above, Ms. Walseth has a corner lot and would like to construct a 6' privacy fence on her rear lot line and her side lot line (Holly Drive) to approximately the front of her hone. This section of the Ordinance would prohibit the construction of a 6' fence from the setback line of the adjoining home on Holly Drive (40') and also along Holly Drive to the front of her home (see attached sketch). The Ordinance would allow a 4' fence. In addition, Anoka County has established sight/distance guidelines which, if used in considering this request, would support the intent of the Ordinance requirement limiting the fence height to 4' (see attached sketch indicating sight/distance triangle). In considering all requests for variance or appeal and in taking subsequent action, the City shall make a finding of fact: • • 1. That the property in question cannot be put to a reasonable use if used under conditions allowed by the official controls. 2. That the plight of the landowners is due to physical circumstances unique to his property not created by the land owner. 3. That the hardship is not due to economic considerations along and when a reasonable use for the property exists under the terms of the ordinance. 4. That granting the variance requested will not confer on the applicant any special privilege that would be denied by this ordinance to other lands, structures, or buildings in the same district. 5. That the proposed actions will be in keeping with the spirit and intent of the ordinance. Staff would conclude that a variance to allow a 6' privacy fence in this location would not meet the above Findings of Fact. A compromise could be a 6' fence on the rear property line. This fence would match the existing 6' fence on the east side of 1101 Holly Drive which was constructed to screen the Trappers Crossing Development from 1101 Holly. However, we would not support a 6' fence within the County sight/distance triangle. The Planning and Zoning Board reviewed this variance at their September 8, 1999 meeting. After considerable discussion (see attached minutes) Kirk Corson made a motion to deny the variance request. Motion failed with 2 ayes (Corson and Johnson), 2 nays (Schilling and Lane), and 2 abstained (Carlson and Dunn). (See attached drawing.) This fence would not interfere with the city's existing 15 foot road easement on Holly Drive. Because the lot is located near Holly Drive, I had always been planning to have the back and side yards fenced: (1) for my large outdoor dog (2) for privacy from pedestrian and car traffic and the associated noises (3) for my above -ground pool, to keep small children out (4) for security reasons (5) for maintaining my comfort level, as I liked the fenced yard at 1101 Holly Drive all the 14 years I have lived there. I planned to have this fence installed just prior to my closing on this property, which is tentatively scheduled on or before October 22, 1999. I had always intended to use a six -foot privacy fence, mainly because of the traffic issues and my pool. I never dreamed that it would ever be a problem, because I see similar fences on other Lino Lakes properties. After discussing my fence plans on 8/2/99 with Mary Kay, she had faxed me a drawing of where I could install a 6-foot fence, but it had to be installed 40 feet from my property line, which is exactly where my new house foundation is currently located. So the fence could be installed directly from my house's rear side comer, towards my rear lot line. I would be losing an incredible amount of my side yard: 5,400 sq. ft. — almost half the minimum requirement for an R -1 X lot area of 12,000 - plus. My initial reaction is that my residential yard is small enough as it is without the city taking away even more of it with these easements. If I install a 6 -foot fence at the city's prescribed location, 1 would feel as if I was giving up my ownership and rights to that portion of my property — almost abandoning it, because it is obviously excluded from my fenced area. I was informed that I could install a 4-foot fence along my south property line, not a 6 -foot. A 4-foot fence is useless to me, as it doesn't afford any privacy at all from the pedestrian or car traffic on Holly Drive. So my only altemative is to apply for a variance. I have composed my own findings of fact below: Findings of Fact: In considering all requests for variance or appeal and in taking subsequent action, the City shall make a finding of fact. 1. That the property in question cannot be put to a reasonable use, if used under conditions allowed by the official controls. • The property can be put to reasonable use, but there is an obvious Toss of privacy in any family - related entertainment activities in the side and rear yards. • • 2 • I intend to re- install an above - ground pool, which will be re- located from my previous yard. With the addition of a 6-foot fence, children passing my property will not be tempted to trespass into my yard, as it would be more difficult to even see the pool through a 6 -foot privacy fence, versus a short 4-foot fence. Lino Lakes already requires that pools must be fenced, to prevent access from children. Children can readily climb over 4 -foot fences. A 6-foot privacy fence would be quite difficult. • There are currently no trees or shrubs planted along Holly Drive to offer any privacy whatsoever while using the backyard for any personal entertainment activities. • There is a current plan for a walking trail to be installed on Holly Drive, along this property, which further invades any right of privacy. • Eastbound traffic on Holly Drive travels along a curve in the road, west of this property – which provides drivers with a full -view of the entire side and rear yard. In the evenings, the yard would be lit up from the glaring (and aggravating) headlights, exiting this curve. • The privacy fence will be a noise buffer from the traffic, using Holly Drive West. Currently, the south side of "Trapper's Crossing" is being developed with the addition of another 86 homes, plus "Peregrine Pass" has another 9 homes — averaging about an additional 190 cars a day, using Holly Drive as their main thoroughfare. (Two cars per household.) Just driving back and forth to work only, at a minimum, is another 380 cars— on top of the existing traffic volumes from "North Trapper's Crossing" and "Brandywood ". 2. That the plight of the landowner is due to the physical circumstances unique to her property, not created by the landowner. The physical circumstances were created by the developer, when the plat was designed – not myself. I could not afford any of the other lots, with my income level. This lot was the most inexpensive one in this particular development – the majority of the other lots have sold for about $15,000 more than this lot's asking price. This lot is similar to what other lower -priced lots currently sell for in Lino Lakes. I was aware of it being a comer lot, but had assumed that the installation of a six -foot fence would provide the needed privacy from the street and pedestrian traffic, and noises associated with them. 3. That the hardship is not due to economic considerations alone, and when a reasonable use for the property exists under the terms of the ordinance. The hardship is due to the original plat design, not economics. There is no current landscaping buffer (provided by the Gemini Estates developer) from the main road (Holly Drive). Other developments have had evergreen trees planted, privacy fences installed, or berms created, all paid for by those particular developers. 4. The granting of the variance requested will not confer on the applicant, any special privilege that would be denied by this ordinance to other lands, structures, or buildings in the same district. Other applicants with similar circumstances could request a variance consideration. The 6 -foot high privacy fence would begin at the typical front comer of the house, as in any normal side yard, under the current city ordinance. Under current city policy, my official property comer is located about 15 feet from the street pavement. There is also an additional city easement of 40 feet – increasing the distance to 55 feet from the street pavement. Just by briefly driving around Lino Lakes, I noticed these similar privacy - fencing discrepancies (photos included) that were previously permitted by the city for other comer Tots' permits, which did not have to be located 55 feet from the curb. • About 100 feet from my lot, 6401 Trapper's Crossing North (Trapper's Crossing North & Holly Drive) has a six -foot privacy fence, which ends 15 feet from the Holly Drive street pavement. It would be more aesthetically- pleasing to have both privacy fences on each side of the same Holly Drive property, to be similar in length and location. • There is a property at 7154 Mourning Dove Road (comer of Mourning Dove & Sunflower) whose 6-foot privacy fence extends 15 feet from Sunflower's street curb. • 3 • There are 2 properties at 7174 & 7180 Sunfish Court (comer of Elm St. & 2nd Ave.), whose 6- foot rear privacy fences extend 17 feet from the 2nd Ave. curb. • There is a property at 6692 Blue Heron Drive (comer of Hodgeson Road & Blue Heron Drive) whose 6 -foot privacy fence is located 23 feet from Hodqeson's pavement, not 55 feet, even though Hodgeson Road is much busier than Holly Drive. It also has an awkward- looking additional garage installed in the middle of its backyard, which was permitted by the city. • There is property at 405 Ash Street (comer of Ware Road & Ash Street), which has a 6 -foot privacy fence 23 feet from the Ware Road pavement – not 55 feet, even though Ware Road & Ash St. both are significantly busier than Holly Drive. 5. That the proposed actions will be in keeping with the spirit and intent of the ordinance. The spirit and intent of the ordinance provides for single family use of the property, by providing some privacy to this lot — and for other reasons as stated in this document. I am not asking for anything special, beyond what other property owners have been previously given permission to by the city, regarding their privacy fence installation. I have discussed the proposed fence construction with my one future neighbor (Brian Mickelsen), who will own the abutting property on my rear lot line (1101 Holly Drive West). He has indicated no objection to the proposed variance. It does not appear that the proposed variance would cause a visibility problem at the intersection of Holly Drive and Cassiopeia Court. • Any potential visibility concems with the nearby curve on Holly Drive is nonexistent, as the curve itself is located westerly on the opposite side of Cassiopeia Court. • The 6 -foot section of fence would begin about 55 feet from the Cassiopeia Street curb — and not be located immediately next to the east side of the intersection. • There would still be another 1 -plus car lengths beyond the 6 -foot fence's edge, of un- obscured visibility for any cars stopping at this intersection, to tum onto Holly Drive. • The project's traffic volume is very low. There are only 8 other homes on the Cassiopeia Court cul- de -sac, so just a minimal number of cars would even be using this street intersection. • If there should be any fence installed in the side yard at the front of the house, it will only be only four feet high, and composed of chain -link. Therefore it wouldn't obscure any driver's line -of- sight, while looking in an easterly direction up Holly Drive. The city already has about a 15 foot easement from the Holly Drive pavement edge, which I have to pay to sod and later mow, although it would be outside the boundaries of any fence, should I install one. Isn't that 15 feet enough? Why does the city need another 40 feet, for a total of 55 feet from the curb? It is a restricted cul-de -sac road in a residential area. What big plans could the city possibly have to require such a large easement near here? I believe that my request is reasonable, qualified and justified under the city's description of a variance. Being the initiator of the variance, I would naturally recommend that the city grants me its approval. As you know, the City acquired some property from Mr. Vaughan that was subsequently exchanged with Anoka County. The matter came up for trial last spring and it became clear that there was a discrepancy between what property the City intended to acquire and what property the City in fact did acquire. As part of the settlement we agreed to petition Anoka County to reconvey to us certain small parcels of property in order to adjust the property lines and avoid interfering with Mr. Vaughan's preliminary plat. We went though a very long process of getting surveys and presenting the information to Anoka County. Fortunately, Anoka County has agreed to reconvey some parcels of property to the City which we can in turn reconvey to Mr. Vaughan. The matter was heard and approved by the Anoka County Park Board and also approved unanimously by the Anoka County Board. I am requesting that this item be placed on the agenda at the next City Council meeting scheduled for September 27. We are requesting that the City Council authorize the conveyance of the property received from Anoka County directly to Mr. Vaughan. The terms of the settlement agreement approved by the Judge require this reconveyance. My suggestion is that you prepare a short presentation for the Council summarizing the initial land transfer, the problems that developed at trial and the solution that we reached with Mr. Vaughan and Anoka County. I am enclosing a map describing the property that we are receiving from Anoka County and conveying to Mr. Vaughan should you need to use this with the City Council. I spoke with Dan Klint and he indicated that he had sent the deed to the County Board for signature and I expect that we will receive that prior to the City Council meeting. We will prepare a deed for signature at the time of the City Council meeting.
