Mr. Hallin has an inoperable brain disorder. Resolution 99 -97 approves the application for gambling exempt permit and to waive the 30-day waiting period. OPTIONS: 1. Approve Resolution 99 -97 2. Approve the application: By taking no action, the city allows the Board to issue a permit after 30 days. 2. Waive the above - mentioned waiting period: The city allows the Board to issue a permit before 30 days. 3. Deny the application by passing a rejection resolution with in 30 days of the event. NOW, THEREFORE BE IT RESOLVED, that the City of Lino Lakes hereby grants authorization to approve the Lino Lakes Lions Club International Lawful Gambling Application for Exempt Permit to conduct raffles at the above - mentioned location. NOW, THEREFOR BE IT RESOLVED, that the City of Lino Lakes hereby grants authorization to waive the 30 day waiting period (option 2), thus granting permission to conduct raffles within 30 days of Saturday, October 16, 1999. As of today, we have not received the information necessary for approval of the final plat. A developer's agreement is a key part of this. Staff has notified the applicant that if the necessary information is not received by noon, Friday, we will pull the item off the City Council agenda. It is the applicant's responsibility to submit the required information. If we receive the information necessary for approval, we will prepare a full greensheet report and forward it to you A final plat drawing has been submitted. The final plat conforms to the approved preliminary plat. However, drainage easements must be added. The City Attorney has reviewed the title commitment. Two signatures must be added to the signature page or those signatories' interests released. The applicant is responsible for making these changes and submitting an amended plat drawing and signature page. We do not have a complete developer's agreement, which is necessary before the final plat can be approved. The City has submitted to the applicant a modified version of our standard developer's agreement. The City Attorney has reviewed it, and the City's interests are protected. The applicant has not yet responded. Another requirement for final plat approval is completion of applicable conditions of approval. Conditions that apply to the plat include obtaining necessary approvals from Anoka County and the Minnesota Dept. of Transportation- (MnDOT). MnDOT has stated that it does not require a permit until development immediately adjacent to their right of way is proposed, which will occur in the fixture. We have not received notice of the status of Anoka County's permit. It is the applicant's responsibility to obtain County approval and submit a copy to the City. As you know, the City acquired some property from Mr. Vaughan that was subsequently exchanged with Anoka County. The matter came up for trial last spring and it became clear that there was a discrepancy between what property the City intended to acquire and what property the City in fact did acquire. As part of the settlement we agreed to petition Anoka County to reconvey to us certain small parcels of property in order to adjust the property lines and avoid interfering with Mr. Vaughan's preliminary plat. We went though a very long process of getting surveys and presenting the information to Anoka County. Fortunately, Anoka County has agreed to reconvey some parcels of property to the City which we can in turn reconvey to Mr. Vaughan. The matter was heard and approved by the Anoka County Park Board and also approved unanimously by, the Anoka County Board. I am requesting that this item be placed on the agenda at the next City Council meeting scheduled for September 27. We are requesting that the City Council authorize the conveyance of the property received from Anoka County directly to Mr. Vaughan. The terms of the settlement agreement approved by the Judge require this reconveyance. My suggestion is that you prepare a short presentation for the Council summarizing the initial land transfer, the problems that developed at trial and the solution that we reached with Mr. Vaughan and Anoka County. I am enclosing a map describing the property that we are receiving from Anoka County and conveying to Mr. Vaughan should you need to use this with the City Council. I spoke with Dan Klint and he indicated that he had sent the deed to the County Board for signature and I expect that we will receive that prior to the City Council meeting. We will prepare a deed for signature at the time of the City Council meeting. MEETING DATE: October 11, 1999 TOPIC: -Site and Building Plan Review - Variances from Setback from Ordinary High Water Level - Variance for the Number of Parking' Stalls Shirley Kaye's, 6810 Lake Drive VOTE REQUIRED: 3/5 BACKGROUND The application for a site plan review is for an addition to the existing building for Shirley Kaye's, a bar and restaurant at Lake Drive and Hodgson Rd. (CSAH 23 and CSAH 49). The plan includes additional dining/bar area, space for a new liquor store, and paved parking. The variances are requested because both the proposed new building addition and the parking lot would not meet the shoreland setback from Ordinary High Water Level of Rice Lake: 150 feet required on a natural environment lake. Another variance is requested for the number of parking stalls. The GB General Business district lists restaurants as well as on and off sale liquor as permitted uses. The Planning & Zoning Board approved the site plan and variances on April 14, with conditions. The applicant has requested several extensions to redesign the building and site plans to meet the concerns expressed by the P & Z Board and staff Since then, staff has reviewed several revised plans to advise the applicant on how to resolve the concerns. Because of the state deadline law, the City must act on the application October 11 or receive another agreement from the applicant to extend the review period. ANALYSIS Wetlands: To our knowledge, the Rice Creek Watershed District (RCWD) has not approved the wetland delineation. Approval of the drainage plan by the RCWD and the City Engineer are standard conditions of approval. • • Shirley Kaye's October 11, 1999 page 2 Shoreland Setback Variance: Variances from setbacks from the ordinary high water level (OHWL) would be needed for both the building and parking lot. The OHWL for Rice Lake is 883.1 as determined by the MN Dept. of Natural Resources (DNR). Rice Lake is classified as a Natural Environment Lake and the City's shoreland ordinance requires a 150 -ft setback from the OHWL for the building and for parking areas. The Environmental Board does not like the idea of the setback variance. Building Setback: The site is between Lake Drive and Rice Lake and is very narrow. The property includes about 30 acres, but most of it is unbuildable because of steep slopes and wetlands. This limits the ability to expand the building without encroaching into the setback. However, the encroachment should be minimized if the setbacks cannot be met. The original design had the building addition jutting toward the lake. The applicant redesigned the building in response to shoreland issues. The site plan shows the building 120± feet from the OHWL. The City's shoreland ordinance states that "where structures exist on adjoining lots on both sides of a proposed building site, structure setbacks may be altered without a variance to conform to the adjoining setbacks from the ordinary high water level..." There is a garage on the next lot that is about 120 feet from OHWL. If we had data regarding the exact location of structures on neighboring lots, a variance may not be necessary. However, granting a variance as requested is reasonable since it is likely that the neighbor's garage is about the same distance from the OHWL as the proposed building addition. Parking Setback: The setback for the parking is also 150 feet. If that is not possible, the parking lot should not be within 75 feet of the OHWL unless there are no other reasonable and feasible alternatives, and then the impacts should be minimized. The parking lot is less than 40 feet from OHWL. The DNR comments on the original plan recommended against the setback variances for the building and parking lot. Staff later spoke with DNR staff about the redesigned site plan. The DNR is less concerned now that the building does not encroach so far into the setback. The DNR recommends extra conditions to offset the negative effects of the variances. This could include extra landscaping for screening or treating runoff to meet higher standards than normally is required. The existing parking is within 75' of the OHWL. There are no reasonable and feasible alternatives to the location of the parking because of the physical characteristics of the property. The proposed improvements, including the stormwater pond, would be better than the existing situation. • Staff supports the variances for the 120± ft. distance from the OHWL for the building and the 35± ft. for the parking lot as long as the remaining issues are properly addressed. • Shirley Kaye's October 11, 1999 page 3 Landscaping Plan: Landscaping will affect the visual characteristics of the site. This will be important for two reasons. First, because of the location on Lake Drive, which is one gateway into Lino Lakes. Second, the site is in a shoreland area and needs a variance from the setback. The County just received a significant grant to develop trails in the regional park reserve. The visual impact of the site when viewed from the lake will become increasingly important as the park is used more and more. The original landscape plan was minimal. 'A new landscape plan shows 10 dogwoods along the lakeshore edge of the parking lot. In addition, it shows five new black hills spruce along Lake Drive). The City Environmental Specialist reviewed the most recent landscaping plan and recommends the following changes: -group the dogwoods rather than line them up for a more natural result - replace the black hills spruce with hackberries for better salt tolerance -add a native flower bed near the hackberries - plant native grasses /flowers around the stormwater pond - define the detail areas on the plan at the front of the building. Staff recommends a condition of approval to require a new landscaping plan to be approved by the City Environmental Specialist before a building permit is issued. Green space: The GB district requires a minimum of 25% green space. In a shoreland area, no more than 60% may be impervious surface. The property is over 30 acres, which is large enough to meet these requirements and still accommodate the proposed project. Structure: Sprinlders will be required for the entire building. The basement level complies with City requirements to be two feet above flood elevation and three feet above OHWL. Floor Area: The project architect submitted floor space data. With the building expansion, the floor area will be as follows: square feet dining/bar area existing main floor 2356 existing lower level 800 new main floor 1814 new lower floor 2320 total dining/bar 7290 retail new main floor 1485 all storage, restrooms, stairs, etc. 4957 Total 13,732 • • • Shirley Kaye's October 11, 1999 page 4 Exterior: The proposed building addition would be brick to match the existing building, including the screened trash area. Lighting: Lighting should not shine up into the night sky, out over the lake, or create glare onto Lake Drive. Staff recommends that lighting should be completely shielded to ensure light is directed down, not sideways. Wall pack fixtures should not be acceptable. Additional information on lighting should be a condition of approval. Traffic, Circulation: The access is via a driveway on Lake Drive. The project must obtain County approval of design of the access to Lake Drive. It is possible that turn lanes will be required by the County. The applicant is responsible for obtaining all approvals from Anoka County regarding the access drive. The County's comments from April are attached. The circulation on the site is constrained. In several places, the drive aisle is very narrow (20 feet wide) and traffic lanes cross in one spot. This is not acceptable. This issue would be resolved if the eight 45- degree parking spaces behind the building were changed. Staff recommends one of two options. Option one, make them 90- degree spaces and move them closer to the building. Curb stops should be installed to provide safe pedestrian entry into the building. The traffic lane would then be two way. Option two would be to shift the orientation of the eight spaces so that they are at 45- degrees but vehicles enter them from the building side. This will create a one -way traffic lane moving west between these spaces and the building. Traffic then continues around the west side of the lot, and moves east along the lake side. This eliminates the crossing of traffic near the retaining wall. Parking Variance: The parking requirements listed in the Zoning Ordinance are as follows: restaurants/bars 10 stalls for each 1000 sf plus one for each employee of the maximum shift (The maximum shift at Shirley Kaye's will be 8 employees.) retail 1 stall per 200 sf parking total s.f. required dining/bar 7290 81 retail 1485 7 total 88 proposed by applicant 78 • • Shirley Kaye's October 11, 1999 page 5 The new plan includes 78 parking stalls. This would require a variance to allow 10 fewer spaces than required by ordinance (an 11% difference). The initial submittal included only a very rough building plan. Based on that, an estimate by staff of the floor area calculated out to 70 required parking spaces. Based on that, the P & Z recommended a variance to allow a minimum of 60 spaces. However, later plans included more complete and accurate floor area data, which allowed a better analysis. The physical configuration of the property results in limited space. Staff supports the variance to allow 78 parking spaces, 10 fewer than required by ordinance. Stormwater Management: The project will need approval from the Rice Creek Watershed District and the City Engineer. RCWD has not approved the wetland delineation. The Environmental Board expressed concern about the drainage design. Due to the physical characteristics of the site, there is no space for infiltration methods. All parking runoff will go into the new stormwater pond. This provides some treatment, which is an improvement over the present situation. Currently, runoff goes directly into the lake. As a point of interest, the grading plan does not indicate the locations of the existing soil stockpiles. These piles must be gone when the project is complete. Sign: An existing sign is in the County right -of -way. The applicant has obtained permission from the County for the sign to remain. ENVIRONMENTAL BOARD COMMENTS At its April 1 meeting, the Environmental Board commented that they did not like the precedent of the shoreland setback variance and that the drainage design should be re- examined. As noted above, the drainage design has been reviewed. FINDINGS FOR VARIANCE Before approving a variance request, the City must make the following findings. 1. That the property in question cannot be put to a reasonable use if used under conditions allowed by the official controls. 2. That the plight of the landowners is due to physical circumstances unique to his property not created by the land owner. Shirley Kaye's October 11, 1999 page 6 3. That the hardship is not due to economic considerations alone and when a reasonable use for the property exists under the terms of the ordinance. 4. That granting the variance requested will not confer on the applicant any special privilege that would be denied by this ordinance to other lands, structures, or buildings in the same district. 5. That the proposed actions will be in keeping with the spirit and intent of the ordinance. Staff supports setback variances for the building and parking lot and for the number of parking spaces because of the physical constraints of the site. PLANNING & ZONING BOARD RECOMMENDATION At the April 14 meeting, the P & Z recommended approval of the application with conditions (which are attached to this report for information purposes). Some of those conditions have been met, the plan site plan has been amended, and additional review resulted in more complete and accurate information. These factors have led staff to amend our recommended conditions of approval. • CONDITIONS OF APPROVAL: Site Plan and Variances If the City Council approves the project, staff recommends that the following conditions should apply to the site plan and variances: 1. Proper building permits must be obtained prior to any construction and 1% of the construction costs must be put in escrow to insure completion of all site improvements. A fire sprinkler system is required. 2. New information describing exterior lighting must be submitted and obtain approval by City staff, including the CSO, prior to issuance of building permits. Lighting shall be shielded and not direct light up or out. Wall pack fixtures are not acceptable. 3. The sign in the County right of way must continue to comply with County agreement conditions and the City sign ordinance. Any new signage shall conform to the sign ordinance and proper permits obtained. 4. All permits /approval required by the Rice Creek Watershed District, including drainage and grading and wetland delineation, shall be obtained prior to any site grading. • • • Shirley Kaye's October 11, 1999 page 7 5. Final utility, grading, and drainage plans must obtain approval from the City Engineer prior to site grading or building permit. 6. A new landscaping plan shall be submitted that includes the recommendations of the City Environmental Specialist and obtain his and the CSO's approvals before building permit is issued. 7. The applicant is responsible for obtaining all County approvals for work in the County right of way. This includes supplying information required by the County. The applicant must submit to the City proof of such County approval before site grading begins or building permit is issued. 8. The parking spaces shall be redrawn as follows: Option one, make them 90- degree spaces and move them closer to the building. Curb stops should be installed to provide safe pedestrian entry into the building. The traffic lane would then be two way. Option two would be to shift the orientation of the eight spaces so that they are at 45- degrees but vehicles enter them from the building side. N.W., ANDOVER, MINNESOTA 55304 (612) 862 -4200 FAX (612) 862 -4201 RE: Site Plan Shirley Kaye's Sports Bar /Grill Dear Mary Kay, April 14, 1999 We have reviewed the Proposed Grading and Erosion Control Plan for Shirley Kaye's Sports Bar /Grill, located on the southeast side of CSAH 23 (Lake Dr.) within the City of Lino Lakes, and I offer the following comments: Existing Right of Way adjacent to CSAH 23 should be adequate for future reconstruction purposes. It appears that portions of the proposed bituminous parking lot are within Anoka County Right of Way. Encroachments of this nature are not permitted by ACHD and parking setbacks regulated by the city should be enforced. It also appears that an existing sign is located within Anoka County Right of Way. This sign is to be removed from Anoka County Right of Way unless the owner enters into a License Agreement with Anoka County allowing the sign to remain. For your information and use I have attached a copy of the pertaining portion of a Minnesota Highway Department Right of Way Map which shows the right of way as it was when TH 49 was turned back to Anoka County. It appears that both the existing and proposed buildings will become obstructions to Case I sight distance requirements for an access as shown on the site plan. The proposed access should be slid to the northeast to a point where the buildings will be outside of the Case I sight distance triangle. The access approach to CSAH 23 should also be re- graded to a higher elevation to improve intersection sight distance. It appears that this site includes Lot 13, Lot 14, and Lot 15 of Auditors Sub. 151. Our records show that right of access to Lot 13 from CSAH 23 has been dedicated to Anoka County with exception of the southwesterly most 33 feet. It does not appear that right of access to Lot 14 or Lot 15 was dedicated to Anoka County. A 30 ft. wide access to Lot 14 or Lot 15 is acceptable provided it is located where sight distance requirements can be met as mentioned above. Anoka County Highway Department will install the appropriate traffic control devices within County Right of Way for a commercial access to this site. Affirmative Action / Equal Opportunity Employer The City of Lino Lakes shall provide traffic analysis with trip generation data to show whether or not construction of left/right tum lanes are warranted with the development of this site. If no data is supplied, ACHD will require tum lane construction and road widening to accommodate painted channelization on CSAH 23.
