Public Hearing — Delinquent Utility Accounts
VOTE REQUIRED: Simple Majority
BACKGROUND:
Attached is a copy of resolution 99 -116 certifying the delinquent utility accounts to
Anoka County for payable 2000 property taxes. Each property owners has been notified
that the account is past due of the stated amount and of the possible pending action.
OPTIONS:
1. Approve Resolution 99 -116 Resolution Authorizing the City Clerk to Certify
Delinquent Water and sewer utility bills for collection with the 1999 property
taxes, collectable in 2000

RESOLUTION AUTHORIZING THE CITY CLERK TO CERTIFY
DELINQUENT WATER AND SEWER UTILITY BILLS FOR COLLECTION
WITH THE 1999 PROPERTY TAXES, COLLECTABLE IN 2000
WHEREAS, pursuant to City Code Chapter 400, Section 401.29 and Chapter 402,
Section 402.14, Subd. 5, the Clerk- Treasurer has prepared a list of
residents who have delinquent water and sewer bills to be certified to the
Anoka County Auditor for collection with the 1999 property tax
statements, collectable in 2000, and
WHEREAS, the certification list is attached hereto this resolution, and
WHEREAS, notice of impending action was mailed to residents on October 4, 1999;
NOW, THEREFORE BE IT RESOLVED, by the City Council of Lino Lakes,
Minnesota that the City Council hereby levies the sums of money collectable in the year
2000 upon the attached list of properties in the City of Lino Lakes, Minnesota.
Adopted by the City Council of Lino Lakes, Minnesota this 25th day of October 1999.

BACKGROUND:
Attached please find a list of Election Judges that have successfully completed training
and four persons scheduled to complete training. Staff conducted election judge training
on October 18, and October 19, 1999. As a result of advertising, approximately 20
additional judges have been added to the election judge roster. Staff request council
considers approving the attached list of Election Judges.
OPTIONS:

SUGGESTED RULES OF CONDUCT
FOR THE CITY OF LINO LAKES COUNCIL
RULE #1 That council members treat each other, the staff, and the
public with respect and dignity.
RULE #2 That council members maintain the highest standards of
honesty and integrity in their public and private dealings.
RULE #3 That council members recognize the interdependency of the
council and the professional staff.
RULE #4 Thd(council members are courteous in their dealings, and do
not interrupt other council members, the staff, or citizens
when they are speaking at council meetings.
RULE #5
That council members respect the individuality and
contribution that other council members and staff members
bring to the city.
RULE #6 That council members respect the majority vote of the council,
and do not undermine or sabotage implementation of
ordinances, policies, and rules passed by the majority.

CITY COUNCIL ACTION:
-Final Plat, Lino Lakes Commercial Development

BACKGROUND
The City Council approved the final plat with conditions on October 11. One of the
conditions was that the approval was effective for two weeks. If all the conditions were
not met in that time, the Council would reconsider the plat approval.
Steps necessary for a final plat include a final plat drawing that conforms with the
preliminary plat, City Attorney review of the title commitment, a complete developer's
agreement, and completion of applicable conditions of approval.
A revised fmal plat drawing with all necessary elements will be submitted by the
developer. The City Attorney is reviewing the revised title information. Staff will ensure
all conditions are met. The main issue is the developer's agreement.
The developer and City are discussing elements of the development agreement,
particularly the financing and ownership of the road. If this issue is resolved before the
City Council meeting, the project can proceed.
If all the issues are not resolved, the City can again grant conditional approval of the fmal
plat, extending the time of approval. Alternatively, the City can deny the final plat and
the developer would simply submit the necessary information in the future. There is no
waiting period for resubmittal of a final plat.
Last time, the Council added a two -week limit on the conditional approval. The same
could be included as a condition tonight. It is included as condition 19. If the Council
does not want this to apply, condition 19 should be deleted.

CONDITIONS OF APPROVAL
If the City Council chooses to approve the final plat now, the following conditions should
apply:
1. All development except the Phase I McDonald's shall comply with the design
standards in this report. Phase I shall comply with the approved site plan and any
conditions of approval.
2. The access driveway onto Apollo Drive shall be a right -in only.
3. East side access drive shall meet the private road at a right angle and the drive lane
will be straightened.
4. Eliminate the five stalls on the front of the building and create an outdoor area for
seating unless or until a playland is built.
5. Create two landscaped islands in the parking lot, one at each end of the double row of
• stalls. A tree shall be saved in the front island if possible.

6. The landscaping plan shall be reviewed for approval by the City Forester.
7. Proper building permits must be obtained prior to any construction and 1% of the
construction costs must be put in escrow to insure completion of all site
improvements. Prior to issuance of building permits, building plans must be
reviewed by the City CSO for compliance with CEPTED recommendations.
8. A lighting plan must be submitted and obtain approval by the CSO for compliance
with CEPTED recommendations.
9. Any signage shall be reviewed for approval by the Town Center Committee.
10. All permits required by the Rice Creek Watershed District shall be obtained prior to
any site grading.
11. Utility, grading, and drainage plans must obtain approval from the City Engineer and
Rice Creek Watershed District.
12. The building design, architectural standards, and signage including the McDonald's
site are subject to review and approval by the Town Center Committee.
13. All necessary permits must be obtained from Anoka County and MnDOT.

14. A plat drawing must be submitted with all required easements and dedications shown.
The accompanying signature page must include all property interests.
15. Complete title information shall be submitted and obtain approval from the City
Attorney.
16. A developer's agreement shall be completed including financial securities.
17. In accordance with standard City policy, no site work shall begin on the site before
the developer's agreement is complete.
18. The final plat shall not be signed by the City and no site work shall begin until
conditions 10, 11, 13, 14, 15, 16, and 17 are fulfilled. The other conditions shall be
met before a building permit is issued.
19. This conditional approval of the final plat is effective for two weeks from the date of
approval. If all conditions are not met in that time, the approval expires.
OPTIONS
1. Approve final plat with conditions listed in report.
2. Return to staff to allow applicant to fulfill standard submittal requirements before
final plat approval.
3. Deny final plat approval.
