HomeMy WebLinkAbout2009-060 Council Resolution• Council Member Stoltz moved its adoption: introduced the following resolution and • CITY OF LINO LAKES COUNTY OF ANOKA RESOLUTION NO. 09 -60 Authorizing amendment to joint powers agreement with Vadnais Lake Area Water Management Organization (VLAWMO) Whereas, the City of Lino Lakes is a member of the Vadnais Lake Area Water Management Organization (VLAWMO) and maintains a joint powers agreement (JPA) to provide water management as required under MN Statutes, Chapters 103B and 103D; and Whereas, all affected JPA municipalities have been consulted in the boundary change process and have approved the new boundaries between adjoining watersheds; and Whereas, the attached map and legal description of VLAWMO have been developed to reflect the updated boundaries of this watershed; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: That the City Council authorizes amendment of the joint powers agreement with the following amendment together with the attached updated legal description and map of the VLAWMO watershed area: Amendment to the Joint Powers Agreement Protect and Manage the Vadnais Lake Area Water Management Organization Said amendment is made and entered into as of the last date of execution by and between the participating units of local government of the cities of Gem Lake, Lino Lakes, North Oaks, Vadnais Heights, and White Bear Lake and the Township of White Bear. The updated legal description and map of the VLAWMO jurisdiction dated May 6, 2009 are attached tot his resolution and hereby replace the previous legal description and are incorporated as Appendix A of the VLAWMO joint powers agreement. • rtell, " ity Clerk Kathi Gallup, ting Mayor Adopted by the Lino Lakes City Council this 24th day of August, 2009. The new watershed boundary lines were approved by each of your communities last year The Minnesota Board of Water and Soil Resources approved the petitions for change last March. One last step remains. A new legal description of the Vadnais Lake Area Water Management Organization (VLAWMO) has been developed by Stevens Engineering and is enclosed. The legal description, watershed map and the experience of the technical experts who generated it have been reviewed, by the VLAWMO legal counsel. "Based upon his (Joe Grandburg, Stevens) certification, his training and experience, and the methodology explained to me, it is my opinion that the VLAWMO Board may rely upon the legal description and map prepared by Stevens." Roger Jensen, VLAWMO legal counsel VLAWMO asks all of our member communities to amend the VLAWMO Joint Powers Agreement by replacing the previous legal description with the new Appendix A including both the updated legal description and the attendant map. A sample draft Resolution of Amendment to the JPA is also enclosed for your use. Obviously feel free to modify the resolution to fit your resolution conventions. As part of this process, they request that the city authorize amendment of the existing joint powers agreement between VLAWMO and the city to reflect a new legal description. RECOMMENDATION Approval of Resolution No. 09 -60 authorizing an amendment to the city's joint powers agreement with VLAWMO.
