HomeMy WebLinkAbout2009-063 Council Resolutionr • Council Member Reinert introduced the following resolution and moved its adoption: CITY OF LINO LAKES COUNTY OF ANOKA RESOLUTION NO. 09 -63 Ratifying the City's practice of investigating liquor license renewal applicants Whereas, consistent with the requirements of Minnesota Statutes, section 340A.412, the City conducts a preliminary background and financial investigation of applicants for intoxicating liquor licenses; and Whereas, Minnesota Statutes, Section 340A.412, subd. 2, allows cities to conduct a background investigation on license renewal applicants if the city's governing body deems it in the public interest; and Whereas, the City has historically conducted background investigations on license renewal applicants and the Council feels that such investigations have been, and continue to be, appropriate and in the public's interest; and Whereas, the City Council received a recommendation from the Lino Lakes Police Department that the practice of conducting background investigations on license renewal applicants is needed and is in the best interest of the City and its residents. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino Lakes: That the appropriate city officials are hereby directed to continue conducting a background investigation on all individuals applying for renewal of an intoxicating liquor license in the City of Lino Lakes. u is ne Bartell, • ity C erk • Adopted by the Lino Lakes City Council this 14th day of September, 2009. The motion for the adoption of the foregoing resolution was duly seconded by Council Member Stoltz and upon vote being taken thereon, the following voted in favor thereof: Reinert, Stoltz, O'Donnell, Gallup, Bergeson The following voted against same: none Whereupon said resolution was declared duly passed and adopted. • • 0 9 AGENDA ITEM 1B STAFF ORIGINATOR: Julie Bartell, City Clerk MEETING DATE: September 14, 2009 TOPIC: Resolution No. 09 -63, ratifying the City's practice of investigating liquor license renewal applicants VOTE REQUIRED: 3/5 BACKGROUND The council received a report at the August work session regarding the city's process for investigation of liquor license applicants. The city currently requires and charges an established fee on initial applications and also on license renewal applications. The city attorney advised that while state statute clearly requires an initial background check, an investigation on renewal applicants is optional. It was recommended that the city council pass a resolution explaining the rationale for the renewal investigations and to amend the city code to remove "particular application" language. A resolution ratifying the City's practice of investigating liquor license renewal applicants is attached. The appropriate amendment to the liquor licensing section of the city code will be included in the new code that will be considered by the council as part of the current recodification project.
