HomeMy WebLinkAbout2009-096 Council Resolution• Council Member ga (1 t .� introduced the f Ilowing resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 09 -9( RESOLUTION DECLARING A VACANCY ON THE CITY COUNCIL WHEREAS, Council Member Dan Stoltz submitted his resignation from the Council in writing on October 26, 2009; and WHEREAS, under Section 2.05 of the Lino Lakes City Charter, a vacancy is deemed to exist upon such resignation and the Council is required to declare the vacancy by resolution; and WHEREAS, Section 4.05, subdivision 5, of the Lino Lakes City Charter provides that when a vacancy occurs within 60 days prior to a regular election, a notice of the vacancy shall be published as soon as is practical and the candidate for Council Member with the third highest vote total in the upcoming election shall fill the vacancy. NOW, THEREFORE, BE IT RESOLVED BY TH E CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA that: 1. The Council sat occupied by Council Member Stoltz is hereby declared vacant due to his resignation. 2. The City Clerk is directed to publish notice of the vacancy as soon as possible in the official newspaper, a daily newspaper of general circulation in the area, as well as on the City website, in City Hall, and any other location wherein notice of elections are posted. 3. The vacancy shall be filled pursuant to the Lino Lakes City Charter, Section 4.05, subdivision 5. u i. ne Bartell, C. r Clerk Joh Ber son,' ayor Adopted by the Lino Lakes City Council this 26th day of October, 2009.
