adoption:
CITY OF LINO LAKES
RESOLUTION NO. 09 -98
RESOLUTION APPROVING A SUMMARY OF ORDINANCE NO. 09 -09
FOR PUBLICATION
WHEREAS, the City Council approved Ordinance No. 09 -09, establishing the
2010 Fee Schedule, for first reading on November 9, 2009 and second reading
and final passage on November 23, 2009; and
WHEREAS, Ordinance No. 09 -09 is lengthy and MN statute 412.191 allows the
city to publish a summary of an ordinance, and
WHEREAS, the City Council has determined that the summary clearly informs
the public of the intent and effect of the ordinance, and
• WHEREAS, the publication in the official newspaper will include a notice that a
full printed copy of the ordinance is available at City Hall,
NOW, THEREFORE BE IT RESOLVED THAT the City Council approves the
summary in Attachment A for publication according to state law and the City
Charter.
Passed by the Lino Lakes City Council this 23rd day of November 2009.

Council MembeP Donneland upon vote being taken thereon, the following
voted in favor thereof:

CITY OF LINO LAKES
COUNTY OF ANOKA
SUMMARY OF ORDINANCE NO. 09-09
AN ORDINANCE ADOPTING THE 2010 CITY OF LINO LAKES FEE
SCHEDULE; REPEALS ALL ORDINANCES, PARTS OF ORDINANCES AND
PREVIOUS FEE SCHEDULES THAT CONFLICT THEREWITH.
The City of Lino Lakes City Council does ordain the following:
Section 1. Findings. Pursuant to Minnesota Law, the Lino Lakes City
Charter, and the Lino Lakes City Code, and upon a review of a study conducted
by City staff, a fee schedule for City services and licensing is hereby adopted as
follows:
2010 FEE SCHEDULE
A. Alcoholic Beverages;
B. Amusement and Commercial Recreation;
C. Business and Miscellaneous;
D. Park & Recreation User Fees;
E. Fire Regulations;
F. Police Fees;
G. Building — Construction Utilities;
H. Escrow Deposits;
I. Right -Of -Way Management;
J. Utility Fees;
K. Surface Water Management;
L. Land Use;
M. Engineering;
Section 2. Effective Date of Ordinance. This ordinance shall be
effective 30 days after its publication.
Passed by the Lino Lakes City Council on November 23, 2009.

VOTE REQUIRED: 4/5 vote
BACKGROUND:
Ordinance No. 09 -09 establishing 2010 fees will be considered for second reading and
approval by the city council on November 23, 2009. If approved, due to the length of
this ordinance, staff is requesting authorization to publish the ordinance in a summary
form. Minnesota Statutes, Section 412.191 allow for summary publication when
appropriate; a copy of the summary is attached to Resolution No. 09 -98.
OPTIONS:
•
1. Approve Resolution No. 09 -98 authorizing summary publication;
2. Deny Resolution No. 09 -98 thus requiring staff to publish Ordinance No. 09 -09 in
its entirety;
3. Return to staff.
