HomeMy WebLinkAbout2009-102 Council Resolution• O'Donnell Council Member introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 09 -102 RESOLUTION APPROVING JOINT POWERS AGREEMENT WITH CITY OF HUGO 1 -35E/ CSAH 14 (MAIN STREET) INTERCHANGE RECONSTRUCTION WHEREAS, the Cities of Hugo and Lino Lakes have participated in the 1 -35 W/E Coalition along with several surrounding cities, counties, and state agencies for the purpose of consolidating efforts regarding common transportation needs affecting the region, and WHEREAS, the City of Lino Lakes, and the County of Anoka have entered into an agreement to reconstruct the Interchange of I -35E and County State Aid Highway 14 (Main Street) including the bridge over 1-35E, hereinafter referred to as the "Project "; and WHEREAS, the City of Hugo has proposed to contribute financially to the City of Lino Lakes local share of project costs; and WHEREAS, Minnesota Statutes section 471.59 authorizes political subdivisions to enter into joint powers agreements. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1. The City Council hereby approves the Joint Powers Agreement with the City of Hugo for the Reconstruction of the Interchange of I -35E and County State Aid Highway 14 (Main Street) and authorizes the Mayor and City Clerk to execute said agreement on behalf of the City. u i. nne Bartell, C' y Clerk Adopted by the Lino Lakes City Council this 23 day of November, 2009. John I' Berg :won / ayor 2 • • STAFF ORIGINATOR: CITY COUNCIL MEETING DATE: TOPIC: ACTION REQUIRED: BACKGROUND AGENDA ITEM 6C (i) Michael Grochala November 23, 2009 Consideration of Resolution No. 09 -102 Approving Joint Powers Agreement with City of Hugo for Construction- I -35E /CSAH 14 (Main Street) Interchange Simple Majority On October 5, 2009 the City approved the Joint Powers Agreement with Anoka County for the construction of the I -35E /CSAH 14 ( Main Street) interchange. The City's share of the project is estimated at $4,241,833. The City of Hugo has been a participant in the I -35W /E Coalition and recognizes the importance of the improvements to the region. Therefore the City of Hugo is committing financial assistance, in the amount of $100,000, for construction of the interchange. The Joint Powers Agreement (JPA) provides for payment to the City of Lino Lakes upon acceptance of bids and project award by the County. RECOMMENDATION Staff is recommending approval of the JPA with the City of Hugo. ATTACHMENTS 1. Resolution No. 09 -102 2. Joint Powers Agreement JOINT POWERS AGREEMENT I -35E /CSAH 14 Interchange THIS AGREEMENT made and entered into this day of , 2009, by and among the City of Hugo, Washington County, Minnesota ( "Hugo ") and the City of Lino Lakes, Anoka County, MN ( "Lino Lakes ") WITNESSETH: WHEREAS, the Cites of Hugo and Lino Lakes have participated in the 1 -35 W/E Coalition along with several surrounding cities, counties, and state agencies for the purpose of consolidating efforts regarding common transportation needs affecting the region, and; WHEREAS, the interchange at I -35E and CSAH 14 in Anoka County has been the source of major congestion affecting this region for the past several years, and serves as the primary entrance for traffic entering and exiting Hugo, and; WHEREAS, recent development in Hugo, and other nearby cities, has contributed to the traffic and congestion at this interchange, resulting in long delays for traffic using roads near the interchange, and; WHEREAS, Hugo has determined that improvements to this interchange are important for the purposes of reducing traffic delays, and improving access to and from the City. Reducing traffic delays at the interchange will improve the City's economic development prospects, improve the quality of life for residents within the community, and will reduce air pollution in the City, and; WHEREAS, the I -35 W/E coalition has succeeded in obtaining Federal funding for the design and construction of the interchange at 1 -35E and CSAH 14 in Anoka County, and; WHEREAS, construction plans for the project have been approved, and Lino Lakes and Anoka County have entered into a joint powers agreement concerning the construction and financing for this project, and; WHEREAS, Hugo recognizes the benefits of the completion of this project to all taxpayers in Hugo, has offered financial assistance for the project at meetings of the 1 -35 W/E coalition, and now commits financial support for the project via this joint powers agreement, and; WHEREAS, Minnesota State Statute authorizes political subdivisions to enter into joint powers agreements. NOW THEREFORE, HUGO AND LINO LAKES MUTUALLY AGREE THAT: 1. Lino Lakes, through its agreement with Anoka County will complete the approved interchange project in accordance with the timelines contemplated under that agreement. 2. Hugo will submit payment to Lino Lakes not to exceed $100,000 within 30 days upon receipt of an invoice for said funds from Lino Lakes. Said invoice may be submitted following the acceptance of bids and after authorization has been given to the contractor to proceed with construction of the project. 3. Said funds shall be used in the construction of the improvements, and the City of Lino Lakes shall provide documentation to the City of Hugo sufficient to demonstrate that the funds have been utilized to construct the interchange.
