Council Member introduced the following resolution and moved its adoption:
CITY OF LINO LAKES
RESOLUTION NO. 09-117
RESOLUTION DISSOLVING SITE AGREEMENT BETWEEN THE CITY OF
LINO LAKES AND CENTENNIAL SCHOOL DISTRICT NO. 12
WHEREAS, In 2003, Site Agreement was executed that combined the Rice Lake
Elementary School Site Agreement (1991), the Centennial Middle School Site
Agreement (1997), and Blue Heron Elementary School; and
WHEREAS, To assist in balancing the 2010 budget, the termination of the Site
Agreement between the City of Lino Lakes and Centennial School District No. 12 (CSD)
was agreed upon by the City Council as a cost saving measure; and
WHEREAS, The Site Agreement states, "This Agreement shall continue and be
automatically renewed annually commencing on January 1, unless either party is served
written notice at least thirty (30) days prior to January 1 of each year that it intends to
terminate or modify this agreement;" and
WHEREAS, The City of Lino Lakes sent written notice on September 22, 2009 notifying

the Centennial School District No. 12 of the City's intent to terminate the Site Agreement
as required.

NOW, THEREFORE, BE IT RESOLVED, the Lino Lakes City Council hereby officially
acknowledges the termination of the Site Agreement between the City of Lino Lakes and
Centennial School District No. 12.

The motion for the adoption of the foregoing resolution was duly seconded by Council
Member RoPsPr and upon vote being taken thereon, the following voted in favor
thereof:
O'Donnell, Roeser, Gallup, Reinert, Bergeson

none
Whereupon said resolution was declared duly passed and adopted.

BACKGROUND:
On August 10, 2009, the City Council began the process of formulating the 2010 budget. To assist in
balancing the 2010 budget, the termination of the Site Agreement between the City of Lino Lakes and
Centennial School District No. 12 (CSD) was agreed upon by the City Council as a cost saving
measure during this budget work session and subsequent work sessions.
Section 17 of the Site Agreement states, "This Agreement shall continue and be automatically
renewed annually commencing on January 1, unless either party is served written notice at least thirty
(30) days prior to January 1 of each year that it intends to terminate or modify this agreement." To
maintain a positive, working relationship with the CSD, staff sent a letter on September 22, 2009
rving written notice of the City's intent to terminate the Site Agreement. Staff felt it was important to
rovide sufficient notice so the CSD would have adequate time to make the necessary adjustments.
Upon the official adoption of the 2010 budget (which doesn't include funding for maintaining the
school district facilities), at the December 14, 2009 City Council meeting, staff is recommending that a
separate resolution be approved acknowledging the termination of the Site Agreement between the
City of Lino Lakes and Centennial School District No. 12 as outlined in the letter sent to CSD
September 22, 2009 (attached).

Dear Dr. Stremick:
The purpose of this letter is to serve official, written notice of the City of Lino Lakes' intent to
terminate the "SITE AGREEMENT BETWEEN CITY OF LINO LAKES AND CENTENNIAL
SCHOOL DISTRICT NO. 12" (dated February 2003). This Agreement combined the Rice Lake
Elementary Site Agreement of 1991, the Centennial Middle School Site Agreement of 1997, and
added Blue Heron Elementary School.
Section 17 of this Agreement requires either party to serve written notice at least thirty (30) days
prior to January 1 of each year that it intends to terminate or modify this Agreement. Therefore,
all agreements pertaining to the maintenance of outdoor facilities at Rice Lake Elementary
School, Centennial Middle School and Blue Heron Elementary Schoo ill effectively
terminate on December 31, 2009.
With the termination of the Site Agreement, I assume the Centennial School District will change
our priority listing classification related to the District's Facility Use Policy No. 2060. Please
notify us of any changes relating to our use of Centennial School District facilities (time line for
permits, fees, etc). The Parks and Recreation Department will be submitting the facility request
forms to the Community Service Department for our winter programs next week.
