RESOLUTION NO. 09 -04
RESOLUTION APPROVING CHANGE ORDER NO. 5
LEGACY AT WOODS EDGE PHASE 2 — STREETLIGHTING IMPROVEMENTS
WHEREAS, pursuant to the resolution of the Council adopted April 24, 2006, awarding
the construction contract for the Legacy at Woods Edge Phase 1 — Streetlighting
Improvements to W.H. Response, and
WHEREAS, W.H. Response was required to perform additional work required to
mobilize and install Tight poles on the Lake Drive bridge over 35W due to anchor bolt
pattern changes installed under Lake Drive contract by Lunda Construction Co.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA that:
1. Change Order No.5 in the amount of $2,625.31 is hereby approved.

Adopted by the Lino Lakes City Council this 12th day of January, 2009.
The motion for the adoption of the foregoing resolution was duly seconded by Council
Member and upon vote being taken thereon, the following voted in favor
thereof:
Stoltz, Gallup, Bergeson (absent - O'Donnell, Reinert)
The following voted against same:
none
Whereupon said resolution was declared duly passed and adopted.

Simple Majority
On April 24, 2006 the City Council awarded the Legacy at Woods Edge Phase 2 —
Street lighting Improvements contract to W.H. Response.
Change Order No. 5 is to compensate W.H. Response for additional work required to
mobilize and install light poles on the Lake Drive bridge over 35W due to anchor bolt
pattern changes installed under Lake Drive contract by Lunda Construction Co.
RECOMMENDATION
Staff is recommending the adoption of Resolution No. 09 -04, Approving Change Order
No.5 in the amount of $2,625.31.
