HomeMy WebLinkAbout2009-011 Council ResolutionCouncil Member Stoltz introduced the following resolution and moved it adoption CITY OF LINO LAKES RESOLUTION NO. 09 -11 RESOLUTION APPROVING A SUMMARY OF ORDINANCE NO. 02 -09, THE CITY'S SUBDIVISION REGULATIONS, FOR PUBLICATION WHEREAS, the City Council approved Ordinance No. 02 -09, amending the subdivision regulations, on February 23, 2009; and WHEREAS, Ordinance No. 02 -09 is lengthy and MN statute 412.191 provides for a city to publish a summary of an ordinance, and WHEREAS, the City Council determines that the summary clearly informs the public of the intent and effect of the ordinance, and WHEREAS, the publication in the official newspaper will include a notice that a full printed copy of the ordinance is available at City Hall, NOW, THEREFORE BE IT RESOLVED THAT the City Council approves the summary in ATTACHMENT A for publication according to state law and the City Charter. Adopted by the Lino Lakes City Council this 23rd day of February, 2009. • The motion for the adoption of the foregoing resolution was duly seconded by Council Member Gallup and upon a vote being taken thereon, the following voted in favor thereof: Stoltz, Gallup. MEETING DATE: February 23, 2009 TOPIC: Resolution 09 -11 Summary of Ordinance No. 02 -09 for Publication ACTION: 4/5 BACKGROUND The City Council approved the second reading of Ordinance 02 -09, which amended the subdivision regulations. Under state law and the city charter, the ordinance must be published in the official newspaper. The approved ordinance is very lengthy. State law and the charter allow for the publication of a summary of the ordinance. • Minnesota Statutes 412.191 provide that the city council may by a four - fifths vote of its members direct that only the title of the ordinance and a summary be published. The summary must be an intelligible synopsis of the essential elements of the ordinance. OPTIONS 1. Approve Resolution 09 -xxx, approving the summary of Ordinance 02 -09 for publication. 2.
