HomeMy WebLinkAbout2010-036 Council Resolution• • Council Member Raf f eri roduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 10 -36 RESOLUTION APPROVING AN EXTENSION OF TIME FOR THE SUBMITAL OF THE FINAL PLAT CENTURY FARM NORTH 5TH ADDITION WHEREAS, review and approvals of plats are governed by state statutes and City ordinances, and WHEREAS, the Planned Unit Development — Development Stage Plan for Century Farm North, approved by the City Council on April 28, 2003 with Resolution 03 -60, included a phasing plan for final platting a specified number of units each year, and WHERAS, the phasing plan also specified numbers of acres of Metropolitan Urban Service Area (MUSA) reserve that would be granted to each annual phase, and WHERAS, the city's Subdivision and Platting Ordinance requires the final plat for subsequent phases be submitted within one year of approval of the final plat for the previous phase, and WHEREAS, a request has been submitted to the City to extend the time allowed for submittal of a final plat upon approval by the City Council, and WHEREAS, the Planned Unit Development — Development Stage Plan for Century Farm North is still in compliance with City requirements. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lino Lakes hereby approves an extension to the submittal time of the final plat for Century Farm North 5th Addition, subject to the following conditions: 1. The complete Final Plat for Century Farm North 5th Addition must be submitted by October 1, 2010; unless an additional extension is granted by the City Council. 2. All conditions of approval for Resolution No. 03 -60 will continue to apply to the site. 3. The 9.4 Acres of MUSA reserve assigned to Century Farm North 5th Addition by Resolution No. 03 -60 shall not e - ea oc ; t- . o a different project if the final plat for the 5th Addition is submitt-. by Octobe , 2010. MEETING DATE: April 26, 2010 TOPIC: Consideration of Resolution No. 10 -36 Century Farm North 5th Addition • Planned Unit Development Extension of Time VOTE REQUIRED: Simple Majority BACKGROUND The Century Farm North project received preliminary plat approval in 2003 with Resolution No. 03 -60. The approval included a phasing plan that would allow the final platting of certain dwelling units annually over five years time. The City's subdivision ordinance requires that a final plat be submitted within one year of the final plat of the previous phase. The City Council previously adopted Resolutions 07 -165, 08 -107 and 09 -39, which allowed the developer until April 30, 2010 to submit the final plat for the fifth phase. The developer has asked for another extension. The city's growth management policy monitors both lots platted and MUSA allocated. This development originally was allocated 33 lots and 9.4 acres of MUSA in 2007. As development has slowed, these can easily be provided for within the pre -2010 lot and MUSA allocations. Each phase of Century Farm North requires the creation of a new long term escrow account, so no money is currently held by or owed to the city in regards to the fifth phase. A full final plat application will be required when the developer is ready to proceed, which will include an escrow deposit per the city's fee schedule. RECOMMENDATION Staff is recommending adoption of Resolution No. 10 -36 approving an extension for the Final Plat submittal, subject to the following conditions: 1. The complete Final Plat for Century Farm North 5th Addition must be submitted by October 1, 2010; unless an additional extension is granted by the City Council. 2. All conditions of approval for Resolution No. 03 -60 will continue to apply to the site. 3. The 9.4 Acres of MUSA reserve assigned to Century Farm North 5th Addition by Resolution No. 03 -60 shall not be reallocated to a different project if the final plat for the 5th Addition is submitted by October 1, 2010.
