HomeMy WebLinkAbout2010-068 Council ResolutionCouncil Member Roeser introduced the following resolution and moved its • adoption: • • CITY OF LINO LAKES COUNTY OF ANOKA RESOLUTION NO. 10 -68 English as the Official Language of the City of Lino Lakes Whereas, the English language is the common language of Lino Lakes, the State of Minnesota and of the United States; and Whereas, the government of Lino Lakes can reduce costs and promote efficiency in its roles as an employer and a government accountable to the people, by using the English language in its official actions and activities; and Whereas, this Resolution would not prohibit the City from using other languages for common sense, non - official reasons that serve the public interest; and Whereas, those reasons would include, but not be limited to, the protection of public health and public safety, the promotion of tourism, the administration of justice and the handling of emergencies; NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino Lakes that: 1. English shall be the official language of the government of Lino Lakes. 2. Official actions which bind or commit the City or which give the appearance of presenting the official views or position of the City shall be in the English language. Unofficial or non - binding translations or explanations of official actions may be provided separately in a language other than English if they are labeled as such. 3. The city of Lino Lakes will not expend public dollars for the translation of any documents or publications. 4. Nothing in this resolution shall be interpreted as conflicting with the statutes of the United States or the State of Minnesota. 5. Language other than English may be used when required: a. to teach or encourage the learning of languages other than English; b. to protect the public health, sanitation, and public safety; c. to teach English to those who are not fluent in the language; d. to comply with the Native American Languages Act, the Individuals with Disabilities Education Act, the Voting Rights Act, or any other federal or state law; • • • e. to protect the rights of criminal defendants and victims of crime; f. to promote trade, commerce, and tourism; g. to collect payments, fines or other financial obligations due and payable to Lino Lakes; h. to create or promote mottos or designations, inscribe public monuments, and perform other acts involving the customary use of a language other than English; i. to utilize terms of art or terms or phrases from other language which are commonly used in communications otherwise in English. 6. Printed materials, signage, or other materials or documents of Lino Lakes printed in languages other than English at the time of the adoption of this resolution and not otherwise excepted in this section shall not be discarded or reprinted solely in English at the additional cost or expense of the taxpayers of Lino Lakes until they are exhausted or become otherwise obsolete. 7. Nothing in this Resolution should be construed as infringing on the free speech rights of City officials or employees from using a language other than English in non - official communications with others when the official or employ has the ability and desire to do so. 8. If any provision of this resolution, or the applicability of any provision to any person or circumstance, shall be held to be invalid by a court of competent jurisdiction, the remainder of this resolution shall not be affected and sh;` given e - - to the fullest extent practicable. an Bartell, C,ty C rk Jeff Rein- , � ayor Adopted by the Lino Lakes City Council this 26th day of July, 2010. The motion for the adoption of the foregoing resolution was duly seconded by Council Member O'Donnell and upon vote being taken thereon, the following voted in favor thereof: Roeser, O'Donnell, Rafferty, Reinert The following voted against same: Gallup Whereupon said resolution was declared duly passed and adopted.
