The City Council hereby finds and determines that: (a) it is in the best interest of the health, welfare, and safety of the City and its residents that the City construct improvements to the intersection of Main Street and Lake Drive and the intersection of Birch Street and Ware Road, in each case including installation of traffic signals, widening, median placement and resurfacing (collectively, the "Project "); (b) the City is authorized by the provisions of Minnesota Statutes, Chapter 475, as amended (the "Act'), to issue its obligations to finance the Project in whole or in part and to pledge its full faith, credit and taxing powers to the payment of such obligations; and (c) it is necessary and expedient to the sound financial management of the affairs of the City that the Project be financed in whole or in part by the issuance and sale of the City's general obligation bonds pursuant to the Act in a principal amount not to exceed $ 1,840,000. 2. The proposition for the issuance of the bonds will be submitted to the voters of the City at a special election to be held on Tuesday, November 2, 2010. The election will be held and conducted in accordance with the laws of the State of Minnesota relating to special municipal elections. 3. The City Clerk is directed to cause a sample ballot in substantially the form attached as Exhibit A and a notice of election in substantially the form attached as Exhibit B to be posted, published, and delivered as required by law as follows: (a) The notice of election will be delivered to the County Auditor of Anoka County, Minnesota, at least 74 days prior to the election, pursuant to Minnesota Statutes, Section 205.16, Subdivision 4, together with a written request to notify the Secretary of State of the election at least 74 days prior to the election pursuant to Minnesota Statutes, Section 205.16, Subdivision 5; • • (b) The notice of election will be published twice in the official newspaper of the City, the first publication at least two weeks prior to the election, and the second at least one week prior to the election, pursuant to Minnesota Statutes, Section 205.16, Subdivision 1; (c) The sample ballot will be published twice in the official newspaper of the City, the first publication at least weeks prior to the election, and the second at least one week prior to the election, pursuant to Minnesota Statutes, Section 205.16, Subdivision 2; and (d) The sample ballot will be made available for public inspection in the office of the City Clerk at least two weeks prior to the election, and will be posted in each polling place on election day, all pursuant to Minnesota Statutes, Section 205.16, Subdivision 3. 4. The polling places, hours of election, and the respective judges for the election will be those established by the City for municipal general elections. The polls will be open from 7:00 a.m. until 8:00 p.m. 5. The City Clerk is authorized and directed to prepare the ballot in substantially the form attached as Exhibit A, and in accordance with all requirements of Minnesota Statutes, Section 205.17. 6. The City Council shall meet in the City Hall on Monday, November 8, 2010, at 6:30 p.m., to canvass the results of the election and to declare the results thereof. Following meetings with the County, the SJR is being revised for fmal review and comment by the County. TKDA was also authorized to prepare a concept layout and cost estimate for the intersection signal and associated roadway work. The concept layout is based upon the discussions with the County for the SJR and potential signalization. A draft concept layout was prepared and provided to the City and County on June 10, 2010. TKDA revised the concept layout based on comments received. A construction estimate was prepared using the revised concept layout and in consideration of the following items: • • The quantities were separated into two groups, one reflective of the changes on Birch Street and the other for the completion of Sioux Lane to Hokah Drive. • The existing ground elevation was estimated due to the lack of survey information. Topographical information, where available, was used to help estimate the ground elevation. • Permanent right -of -way needs were estimated for three corners. Temporary construction easement for the Sioux Lane connection was also estimated. • The existing shoulders on Birch Street were assumed to need removal and replacement to provide a suitable cross section for through traffic. • Where it was necessary to widen Birch Street to accommodate the new raised median, a full - depth bituminous sawcut was assumed at the inside edge of the road. All of the approximately 6 -foot widening occurs on the north side of Birch Street. • To allow for the raised median on Birch Street, an 8- foot -wide full -depth bituminous sawcut was assumed in the road. This width provides space for the 4- foot -wide median, B412 curb and gutter, and an approximately 1 -foot area for new bituminous pavement between the new concrete and the existing bituminous. • A mill- and - overlay was planned for areas adjacent to new widening or where new striping will be required. Curb removal and replacement were included for this widening. • The regional trail was moved north to maintain the existing boulevard between the trail and the roadway. • A geotechnical investigation was not completed. Geotechnical information from previous projects in this area indicated that the existing soil is a mix of sand, fill material, and organic material. This construction estimate included the removal of 24 inches of topsoil, organic material, and existing soils. • The proposed pavement section was based upon a typical section assumption provided by the County and consisted of 6 inches of bituminous pavement over 6 inches of class 5 aggregate base. A 1 -foot subcut that would be backfilled with select granular material was also included. • The proposed project was expected to be less than 1 acre of disturbed area and will therefore not require a storm water permit from the Rice Creek Watershed District or the MPCA. This construction estimate is based on the above items and is considered preliminary. Preparation of final plans will be required to address all of the issues and to obtain a more accurate construction estimate. The total project cost is estimated to be $925,000, including contingencies and right -of -way acquisition. The following contingencies have been added to address other items necessary for construction of the proposed project: • 15% contingency to account for items that will not be quantified until construction plans have been created. • 20% contingency for engineering plans, specifications, and bid package preparation. • 5% contingency for legal, fiscal, and administration duties, which does not include expenses associated with the bond. • 8% contingency for construction services and observation. The attached summary table shows the estimated construction costs for each portion of the proposed project, the Birch Street improvements and the Sioux Drive connection, followed by the right -of -way costs and contingencies. Itemized construction estimates are then attached for each project segment. Topographical information, where available, was used to help estimate the ground elevation. • Permanent right -of -way needs were estimated for three approaches. • Where widening was necessary to accommodate the new turn lanes, a full -depth bituminous sawcut was assumed at the inside edge of the road. • A mill- and - overlay was planned for areas adjacent to new widening or where new striping will be required. The depth of the mill planned was 2 inches. • Bituminous removal and sawcut quantities included reconstruction of private driveways where necessary. • The new curb in the northwest quadrant on Main Street eliminated the existing on- street parking. • Access management associated with the proposed project reduced the private driveways intersecting the public roadways. • A geotechnical investigation was not completed. This construction estimate included the removal of 24 inches of topsoil, organic material, and existing soils. In anticipation of potential water quality improvement needs, a storm water treatment pond has been assumed for the proposed project. • New storm water pipes were added to drain from the sections of new curb and gutter. The new pipes were assumed to connect into the existing system and drain into the proposed storm water treatment pond. This construction estimate is based on the above items and is considered preliminary. Preparation of final plans will be required to address all of the issues and to obtain a more accurate construction estimate. • The total project cost is estimated to be $1,668,000, including contingencies and right -of -way acquisition. Both intersections are experiencing growing congestion and safety problems. On April 12, 2010 the City Council authorized the preparation of Signal Justification Reports (SJR's) for the intersection of Birch Street and Ware Road and the intersection of Lake Drive and Main Street. While the SJR's still require review by the Minnesota Department of Transportation (Mn /DOT), Anoka County has given their support for both projects. On June 14, 2010 the City Council authorized the preparation of a Concept Layout and Construction Estimate for both intersections. TKDA, the City Engineer, has completed the conceptual layouts and determined a construction estimate. While the Signal Justification Report (SJR) identified a need for improvements to this intersection under future traffic volumes, existing volumes did not meet the same thresholds. As a matter of policy, Anoka County will not contribute to projects where future conditions are used to satisfy warrant thresholds. • The County will fund 50 % of the Lake Drive and Main Street intersection improvements. Accordingly, the total amount proposed to be funded by the City of Lino • Lakes, including bond issuance cost, is estimated at $1,840,000. The estimate includes contingencies to account for unknowns due to the conceptual nature of the plans and the probable construction start date of 2012. • • Local funding for the project is proposed to be provided by the issuance of General Obligation Bonds payable from the collection of property taxes. No special assessments are being proposed. Minnesota Statutes, Chapter 475 includes provisions that allow the city to fund improvements in this manner subject to voter approval. The City's Bond Counsel, Kennedy & Graven, has prepared the required resolution Calling for the Special Election. Resolution 10 -71 includes both projects in one ballot question. Alternatively, Resolution 10 -71 B, provides a separate ballot question for each project. The bond amount listed in each resolution is a not to exceed number. The resolution provides authority to issue bonds up to the not to exceed amount. If project costs are higher than estimated, the City would need to either find alternative funding or hold an additional election. If project costs are lower than the authorized amount, the City would only issue bonds in the amount necessary to cover the improvement costs. The adopted resolution must be submitted to Anoka County prior to August 20, 2010 to be included on the November 2, 2010 election ballot. RECOMMENDATION Adopt Resolution No. 10 -71 ATTACHMENTS 1.
