CITY OF LINO LAKES
RESOLUTION NO. 10 -88
RESOLUTION DECLARING COSTS TO BE RE- ASSESSED, PINE STREET
PAVING IMPROVEMENTS
WHEREAS, a resolution of the City Council adopted the 28th day of September 2009
called for a Public Hearing on the proposed paving improvements of Pine Street from
Lake Drive to 4th Avenue,
AND WHEREAS, ten days' mailed notice and two weeks' published notice of the
hearing was given, and the hearing was held thereon on the 26th day of October, 2009, at
which all persons desiring to be heard were given an opportunity to be heard thereon,
AND WHEREAS, Resolution 10 -39, Declaring Costs to be Assessed, Pine Street Paving
Improvements approved on April 26, 2010 is being replaced with this resolution based on
the final project costs,
AND WHEREAS, The costs to pave Pine Street will be split as a 50% - 50% cost share
with the City of Columbus and it is proposed to finance the project with special
assessments assessed 100% to the benefited property owners,
AND WHEREAS, this improvement project is subject to a Joint Powers Agreement
between the City of Columbus and the City of Lino Lakes Regarding the Pine Street
Paving Improvements and Maintenance,
WHEREAS, pursuant to a resolution passed by the council on January 25, 2010, TKDA
has prepared plans and specifications for the paving improvement of Pine Street and has
presented such plans and specifications to the council for approval,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA:
1. The project is 100% assessed to the benefited property owners. The City will be
re- assessing $169,647.44 at this time.
2. Assessments shall be payable in equal annual installments extending over a period
of 15 years, and shall bear interest at the rate of 7 percent per annum from the date
of the adoption of the assessment resolution.
3. The City Clerk, with the assistance of the City Engineer, shall forthwith calculate
the proper amount to be specially re- assessed for such improvement against every
assessable lot, piece or parcel of land within the district affected, without regard to
cash valuation, as provided by law, and she shall file a copy of such proposed re-
assessment in her office for public inspection.
• 4. The City Clerk shall upon the completion of such proposed re- assessment, notify
the council thereof.

The motion for the adoption of the foregoing resolution was duly seconded by Council
Member Rafferty and upon vote being taken thereon, the following
voted in favor thereof:
O'Donnell, Rafferty, Roeser, Gallup, Reinert

Whereupon said resolution was declared duly passed and adopted.

Resolution No. 10 -88, Declaring Costs to be
Assessed, Pine Street Paving Improvements.
Simple Majority
A Public Hearing was held for the Pine Street Paving Improvements on October 26, 2009.
Before any further action could be taken on the proposed project as required by the City Charter,
60 days was required to elapse following the Public Hearing, that date was December 25, 2009.
The Public Hearing was initiated by a resident petition to research the costs of paving Pine Street.
On April 26, 2010 the City Council approved Resolution 10 -39 declaring the costs to be assessed
for the Pine Street Paving Improvements using the estimated amount of $199,250.00 from the
feasibility study. The project has been successfully completed and is significantly under the
estimate. The total costs including construction, administration, engineering and legal are
$169,647.22, which allows for a reduction in the assessments as shown on the attached final re-
assessment roll. The unit assessment can be reduced from $9,488.10 to $8,078.44.
The costs above are the Lino Lakes portion of the project as the costs to pave Pine Street are
being split as a 50% - 50% cost share with the City of Columbus through a Joint Powers
Agreement.
The next step in the process is to declare the costs to be re- assessed based on the final project
costs.
RECOMMENDATION:
Staff recommends approving Resolution Number 10 -88, Declaring Costs to be Re- Assessed,
Pine Street Paving Improvements.
