HomeMy WebLinkAbout2010-089 Council Resolution• • Council Member Roeser moved its adoption: introduced the following resolution and CITY OF LINO LAKES RESOLUTION NO. 10 -89 RESOLUTION CALLING FOR A PUBLIC HEARING ON PROPOSED RE- ASSESSMENTS, PINE STREET PAVING IMPROVEMENTS WHEREAS, a resolution of the City Council adopted the 28th day of September 2009 called for a Public Hearing on the proposed paving improvements of Pine Street from Lake Drive to 4th Avenue, AND WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was given, and the hearing was held thereon on the 26th day of October, 2009, at which all persons desiring to be heard were given an opportunity to be heard thereon, AND WHEREAS, Resolution 10 -40, Calling for a Public Hearing on Proposed Assessments, Pine Street Paving Improvements, approved on April 26, 2010 is replaced by this resolution based on the final project costs, AND WHEREAS, the clerk has notified the council that such proposed re- assessment has been completed and filed in her office for public inspection, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1. A Public Hearing shall be held on the 25th day of October, 2010 in council chambers of City Hall at 6:30 p.m. to pass upon such proposed re- assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such re- assessment. 2. The City Clerk is hereby directed to cause a notice of the hearing on the proposed re- assessment to be published once in the official newspaper at least two weeks prior to the hearing, and she shall state in the notice the total cost of the improvement. The City Clerk shall also cause mailed notice to be given to the owner of each parcel described in the re- assessment roll no less than two weeks prior to the hearings. 3. The owner of any property so re- assessed may, at any time prior to certification of the re- assessment to the County Auditor, pay the whole of the re- assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire re- assessment is paid by November 15, 2010; If assessment is not paid in full, interest shall accrue beginning on November 15, 2010. The owner may, at any time thereafter, pay to the City Treasurer the entire amount of the re- assessment remaining unpaid, with interest accrued. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. Studenski, City Engineer September 27, 2010 Resolution No. 10 -89, Calling for a Public Hearing on Proposed Assessments, Pine Street Paving Improvements. Simple Majority Following the City's action declaring cost to be re- assessed for the Pine Street Paving Improvements project, the City must call for a Public Hearing on the proposed re- assessments. It is staff's recommendation to call for a Public Hearing on the proposed re- assessments for the Pine Street Paving Improvements project. The Public Hearing, Adopting the Proposed Re- assessment Role for the paving improvements of Pine Street will be held at the October 25, 2010 City Council Meeting. RECOMMENDATION: Staff recommends approving Resolution Number 10 -89, Calling for a Public Hearing on Proposed Re- assessments, Pine Street Paving Improvements.
