HomeMy WebLinkAbout2008-007 Council Resolution• • • Council Member Stoltz introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 08-07 RESOLUTION APPROVING THE PRELIMINARY PLAT FOR MARSHAN MEADOWS 2ND ADDITION. WHEREAS, the City has received applications for developing an area known as MARSHAN MEADOWS 2ND ADDITION; and WHEREAS, the development requires approval of a preliminary plat; and WHEREAS, a public hearing was held before the Planning & Zoning Board on December 12, 2007; and WHEREAS, the proposed plat meets the requirements of the City's Growth Management, Zoning and Subdivision Ordinances; and NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby approves the preliminary plat for MARSHAN MEADOWS 2ND ADDITION with the following conditions: 1. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. 2. A development agreement between the city and the developer must be executed prior to the issuance of any building permits for the site or signature of the final plat mylar. 3. Park dedication must be paid in accordance with the city's fee schedule. 4. The Rice Creek Watershed District must review the project prior to building permits being issued by the city for any new construction. 5. A boulevard tree shall be provided for each lot frontage. 6. The signs for the conservation easement must be in place prior to the issuance of building permits for either of the newly created lots. Resolution No. 08 -08, Approving a Final Plat BACKGROUND Bruggeman Homes has requested approval of a 2 lot residential subdivision to be known as Marshan Meadows 2nd Addition. The subject site includes Lot 1 Block 1 of Marshan Meadows. ANALYSIS The following is a summary of the proposal: Site Area 3.79 acres Upland Area Total Lots 2 Density 1.18 acres 0.52 units per acre Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. The new unit of Marshan Meadows 2nd Addition will not be platted until 2008 and will fit within that year's allotment. PRELIMINARY AND FINAL PLAT Shoreland Ordinance: The subject site is adjacent to Marshan Lake, which is considered a Natural Environment Lake and therefore is subject to the more restrictive Shoreland Ordinance Requirements for Lot Dimensions, Impervious Surface Coverage, and Setbacks. The lots depicted on the submitted plats meet all of these requirements. Setbacks: The submitted plans depict all required setbacks, including the 150 foot setback from the Ordinary High Water Line as required by the Shoreland Ordinance. This setback is measured to any improvement attached to the single family dwelling, including decks and /or patios. This means that the southernmost lot (indicated as Lot 2, Block 1) will be very limited in that regard. Impervious Surface Coverage: The lots will all be required to comply with the 30% Impervious Surface Coverage requirement of the Shoreland Ordinance as they develop. Streets: Stage Coach Trail is already in place for the majority of the site and will be connected fully with the Grandview project to the south. A sidewalk is shown on the east side of the street within the right of way. This must be continued to the southern boundary of the plat. Conservation Easement: A Conservation Easement was supplied by the developer for Marshan Meadows and will govern the development of both of these lots. Park Dedication: There is no land dedication needed, as Marshan Park is nearby, so the typical park dedication fee will be collected with the Development Agreement. Utilities: Sanitary sewer and water are located within Stage Coach Trail and both lots will be required to connect. The drainage and utility easement indicated on the south property line of Lot 2, Block 1 is depicted at 10 feet in width. This is in excess of what is needed for the city, which is 5 feet in width. This reduction may allow the developer to shift garage footprint closer to the property line thereby increasing the building area on the lot. This must be changed prior to the city signing and releasing the final plat mylar for the project. Grading: The grading plan has been reviewed by the City Engineer and his comments will need to be addressed to his satisfaction prior to the site being developed. The grading plan acknowledges the Grandview project that was approved by the city earlier this year, and the two developers are cooperating to guarantee that both projects work seamlessly together. Planning and Zoning Board: At the December 12, 2007 regular meeting the board voted unanimously to recommend approval of the project based on the conditions provided by staff. • DEVELOPMENT AGREEMENT The Marshan Meadows 2nd Addition is a lot spilt of Lot 1 Block 1 of the Marshan Meadows Addition. The lot splitting will create two parcels that already have sanitary sewer, storm sewer, street and watermain improvements available to them. One parcel has been assessed with the Marshan Meadows Project and the newly split parcel will be assessed within the attached Marshan Meadows 2nd Addition development contract. This lot spilt was made possible by the construction of the Grandview project. In accordance with the preliminary plat approval and City policy, staff has prepared a Development Contract. The contract provides for the following: 1. Submittal by the developer of a Letter of Credit in the amount of $2,200.00 representing 35 percent of the City improvement costs to insure completion of the project in accordance with the approved plans. 2. Deposit of a cash escrow in the amount of $3,800 to reimburse the City for costs incurred by the City related to the development and improvements of the site. Bruggeman Properties, LLC. has reviewed the contract and is aware of the conditions set forth. • • RECOMMENDATION i. Adoption of Resolution No. 08 -07, approving the Preliminary Plat subject to the following conditions: 1. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. 2. A development agreement between the city and the developer must be executed prior to the issuance of any building permits for the site or signature of the final plat mylar. 3. Park dedication must be paid in accordance with the city's fee schedule. 4. The Rice Creek Watershed District must review the project prior to building permits being issued by the city for any new construction. 5. A boulevard tree shall be provided for each lot frontage. 6. The drainage and utility easement shown on the south property line of Lot 2, Block 1 shall be reduced to 5 feet in width prior to the final plat mylar being signed by the city. 7.
