Council Member Gallup introduced the following resolution and moved its adoption:
CITY OF LINO LAKES
RESOLUTION NO. 08 -16
RESOLUTION APPROVING THE CIRCLE PINES, NORTH ROAD AREA JOINT
POWERS AGREEMENT
WHEREAS, The City of Lino Lakes and the City of Circle Pines are interested in
formalizing cross community water connections in the North Road Area.
WHEREAS, Circle Pines owns and maintains sanitary sewer and watermain facilities
adjacent to certain parcels located in Lino Lakes. These facilities have the capacity to
provide water service to Lino Lakes customers on or near North Road.
WHEREAS, it is desire of the parties, the City of Lino Lakes and the City of Circle
Pines, through this agreement, to provide for water services to customers in the North
Road area of Lino Lakes.
WHEREAS, Minnesota Statues, Section 471.59, provides that two or more
governmental units, by agreement entered into through action of their governing bodies,
may jointly or cooperatively exercise any power common to the contracting parties or
any similar powers, including those which are the same except for the territorial limits
within which they exercise.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA:
Joint Powers Agreement between the City of Circle Pines and the City of Lino
Lakes formalizing cross community sanitary sewer and water connections in
the North Road Area.
Adopted by the Lino Lakes City Council this 28th day of January, 2008.
The motion for the adoption of the foregoing resolution was duly seconded by Council
Member° Donnelland upon vote being taken thereon, the following voted in favor
thereof:
Gallup, O'Donnell, Reinert, Bergeson
The following voted against same:
none (Stoltz absent)
Whereupon said resolution was declared duly passed and adopted.

TOPIC: Resolution No. 08 -16, Approving Joint Powers
Agreement with Circle Pines, North Road Area.
VOTE REQUIRED: Simple Majority
BACKGROUND:
Utility connections have been made in the North Road area over the last 12 years using
our standard practices. At this time we are combining all connected properties within a
standard Joint Powers Agreement between Lino Lakes and Circle Pines.
The attached Joint Powers Agreement defines billing, maintenance, and metering
responsibilities of both the City of Lino Lakes and the City of Circle Pines. Also,
attached is a map detailing the Lino Lakes properties served by the Circle Pines
sanitary sewer and water systems in the North Road Area.
This agreement is in the same format as the previously approved Ash Street Area
(County Road J) Joint Powers Agreement with the City of Circle Pines. The City of
Circle Pines staff has reviewed the Joint Powers Agreement and will be requesting
approval from the Circle Pines City Council.
RECOMMENDATION:
Staff recommends approval of Resolution 08 -16, Circle Pines, North Road Area Joint
Powers Agreement.
