RESOLUTION NO. 08 -21
AGREEMENT EXTENDING GRANTEE'S OBLIGATION TO COMPLY WITH
LIVABLE COMMUNITIES DEMONSTRATION ACCOUNT
GRANT AGREEMENT CONDITION
Whereas, on December 20, 2000 the City Council (City) received a $450,000 Livable
Communities Demonstration Account grant to help support mixed - income housing in Legacy
at Woods Edge from the Metropolitan Council (Council); and
Whereas, the grant agreement included a condition to install a traffic signal on the
northbound off -ramp of I -35W to serve the development and existing development in Lino
Lakes; and
Whereas, on March 12, 2003 the City and the Council entered into grant agreement No. SG-
00 -135 which made the City's receipt of funds subject to the condition; and
• Whereas, on August 24, 2005 the City requested payment of the $450,000; and
•
Whereas, on September 30, 2005 the City and the Council executed an amendment to the
grant agreement under which the City agreed to reimburse the $450,000 by January 31, 2008
if the signal was not installed by December 31, 2007; and
Whereas, full reconstruction of the I -35W Lake Drive bridge and interchange is now expected
to be complete by June of 2008 and City staff requested an extension of the deadline for
signal installation; and
Whereas, at its January 9, 2008 meeting the Council gave the City until August 31, 2008 to
fulfill the traffic signal condition.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO
LAKES, MINNESOTA:
The City agrees to the representations made and agrees as follows:
1. The Council will forebear on its right to seek reimbursement of the $450,000 grant
amount until August 31, 2008.
2. The City will inform the Council in writing when the traffic signal is operational.
3. If the signal is not operational by August 31, 2008, the City will reimburse the Council
the entire $450,000 grant amount by September 15, 2008.
4. If the City does not reimburse the Council by September 15, 2008, the Council has a
right to seek immediate reimbursement of the grant amount.

The motion for the adoption of the foregoing resolution was duly seconded by Council
Member Stoltz and upon vote being taken thereon, the following voted in favor thereof:
O'Donnell, Stoltz, Reinert, Gallup, Bergeson
The following voted against same: none
Whereupon said resolution was declared duly passed and adopted.
