Council Member Stoltz introduced the following resolution and moved its adoption:
CITY OF LINO LAKES
RESOLUTION NO. 08 -27
RESOLUTION APPROVING CHANGE ORDER NO. 4
LEGACY AT WOODS EDGE PHASE 2 — STREETLIGHTING IMPROVEMENTS
WHEREAS, pursuant to the resolution of the Council adopted April 24, 2006, awarding
the construction contract for the Legacy at Woods Edge Phase 1 — Streetlighting
Improvements to W.H. Response, and
WHEREAS, repairs of damage to the street lighting system caused by a lightning strike
are necessary to complete installation and operation of the street lighting system, and
WHEREAS, under the contract provisions the contractor is not responsible for repair
costs associated with "Acts of God ".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA that:
1. Change Order No.4 in the amount of $2,811.44 is hereby approved.

Adopted by the Lino Lakes City Council this 25th day of February, 2008.
The motion for the adoption of the foregoing resolution was duly seconded by Council
Member O' Donnelland upon vote being taken thereon, the following voted in favor
thereof:
Stoltz, O'Donnell, Gallup, Reinert, Bergeson
The following voted against same:
none
Whereupon said resolution was declared duly passed and adopted.

Simple Majority
On April 24, 2006 the City Council awarded the Legacy at Woods Edge Phase 2 —
Street lighting Improvements contract to W.H. Response.
Change Order No. 4 is for repair of damage to the street lighting system caused by a
lightning strike last fall. Under the terms of the contract, the contractor is not
responsible for repair costs associated with "acts of God ". The total cost of Change
• Order No. 4 is $2,811.44.
RECOMMENDATION
Staff is recommending the adoption of Resolution No. 08 -27, Approving Change Order
No.4 in the amount of $2,811.44.

Purchased and installed 16 new GFI Receptacles damaged by fghtning strike. Troubleshot system to determine
problem, purchased new GPI's, removed old and installed new GFrs. This work was perfomued on 12/5/2007

• Painted several poles that were dearly not damaged by our installers (we did paint poles that had scuffs that
could have been caused by us as we wired the poles)
• Reamed and re -wined Trne Clodcs that were either faulty from the factory or damaged due is the rightnirg
&Ice
• Reinstalled contactors in service cabinets that were damaged by the lightning strike
• Retested entire electrical system after contactors and time dodos were reinstalled
• Replaced stainless steel bolts in all hand holes that were removed by the utility beaters so they can gain quicker
access to wires inside hand holes
• Re-aimed flood rights in roundabout after we were given direction to aim them straight up
• Bitable hours - 9 hours for the foreman, laborer and equipment - $913.32
• Bitable hours - 4 hours for the electrician and equipment $406.00
• Total for this work - $1,319.32
