HomeMy WebLinkAbout2008-039 Council Resolution• Council Member Reinert adoption: introduced the following resolution and moved its • • CITY OF LINO LAKES RESOLUTION NO. 08 -39 RESOLUTION TO APPROVE THE 2007/2008 WORK SCHEDULE FOR FOXBOROUGH CONSERVATION AREAS AND TO DISBURSE FOXBOROUGH CONSERVATION MANAGEMENT STEWARDSHIP FUNDS WHEREAS, Foxborough is a conservation development that set up a stewardship fund for managing conservation easement areas set aside inside the geographic limits of the development; and WHEREAS, The fund has an existing available balance of $22,849 for, 2007 and 2008; and WHEREAS, The City received a proposed work plan describing work in 2007 and 2008; and WHEREAS, Proposed work plans are consistent with an approved Restoration and Management Plan, and has been reviewed by the City of Lino Lakes Environmental Board; and WHEREAS, The cost of proposed work in the 2007/2008 work plan totals $20,005.00; and WHEREAS, The Lino Lakes Environmental Board reviewed the proposed costs and work plan for Foxburough conservation areas on March 26, 2008 and recommended to the City Council that all proposed tasks and costs be approved for 2008. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: The City Council approves the release to the Foxborough Homeowners Association of $4,770 from the stewardship fund for work completed in 2007 described as Task 1 in the work plan and BE IT FURTHER RESOLVED THAT The City Council approves proposed work for 2008 and that completed word shall be reviewed before the City approves the release of funds for those tasks. • Julia nr(e }Bartell, City le Berg on, ayor Adopted by the Lino Lakes City Council this14 th day of April , 2008. Foxborough is a conservation development that set up a stewardship fund for implementing the management plan for conservation easement areas set aside inside the geographic limits of the development. Covenants and restrictions have been written subjecting all those who purchase property in Foxborough to a Homeowners Association with conservation easement use restrictions, yearly management work plan approvals by the City, and annual fees for the maintenance of conservation areas. The Conservation Fund for Foxborough consists of a $100,000 endowment established by the developer, and annual fees of $100 per lot. Yearly Interest off of the $100,000 endowment, plus the annual $100 per lot Homeowners Association fee establishes the amount of money available to manage conservation easement areas in Foxburough. There are 57 Tots within Foxborough. The annual contribution by the Homeowners Association is $5,700 plus interest accrued. The Homeowners Association is responsible for collecting the funds and the City maintains the collected funds in a separate account. Until sufficient lots are sold within the development, the Developer is the Homeowner's Association and has paid dues for two years ($11,400). The dues, together with interest from the endowment fund establishes an available fund balance of $22,849 for 2007 and 2008. As part of Foxborough Development approvals, a Restoration and Management Plan was required that laid out typical work schedules for the conservation areas. Each year, the Homeowner's Association must hire an ecologist to make recommendations concerning the management of the Foxburough Conservation Areas relative to the plan and monies available. Proposed work plans submitted to the City by the Homeowner's Association that are the product of the ecologist's analysis, are reviewed by the Environmental Board. The Environmental Board then makes a recommendation to the • City Council concerning the annual work plan. A similar process is followed to review completed work for approving the transfer of money from the Foxborough Stewardship fund to the Homeowner's Association to pay for the completed work. Attachment 1 is the report dated February 21St, 2008 completed by Jason Husveth of Critical Connections. Mr. Husveth is the ecologist hired by the Association (Royal Oaks Realty) to make management recommendations. Recommendations are for the work completed in 2007 and the proposed work plan for 2008. The City of Lino Lakes Environmental Board reviewed the report from Critical Connections and the Foxburough Homeowners Association (presently Royal Oaks Realty) at the March 26th Environmental Board meeting. The Environmental Board made recommendation that the proposed work schedule be approved and Stewardship funds released upon completion of proposed tasks. Resolution 08 -39 approves releasing $4,770 for work completed in 2007. It also approves the work plan for 2008. RECOMMENDATION 1. Approve adoption of Resolution No. 08 -39, approving the 2007/ 2008 work plan for Foxborough conservation areas, and the release of $4,700.00 from the stewardship fund for work done in 2007. 2. These tasks are consistent with the Foxborough Restoration and Management Plan, developed by CCES in August 2005. The proposed restoration and management tasks will be implemented during the 2008 growing season, and will rely on available funding within the Foxborough Conservation Fund. The following proposed tasks, timelines, costs, and priorities constitute the planned scope of work for 2008 within Foxborough's conservation outlots. Task 1 (prescribed burn) was previously implemented in April 2007, and is included in this scope of work. 2007 Restoration and Management Tasks (Completed): Task 1: Prescribed Burn of Conservation Outlots. A prescribed burn was planned and implemented by Critical Connections Ecological Services in cooperation with Marty Asleson, City of Lino Lakes Natural Resources Specialist. The burn was implemented on April 25, 2007 within approximately 75% of the conservation outlot acreage within the Foxborough conservation development. Accessible wetland and upland habitats were burned successfully. In addition, an adult female Blanding's Turtle was discovered during the prescribed burn, and was re- released after the burn was completed. CCES submitted and invoice for this completed work to the City of Lino Lakes on February 19, 2008 in the amount of $4,770. CCES will develop specifications and order native seed mixes for inter - seeding into wetland and upland areas needing additional native seed and plant material. Priority areas to be targeted for re- seeding and inter - seeding in 2008 are bare soil areas within stormwater management wetlands and along the edges of established trails. All species will be native and appropriate to the existing and prescribed native habitats being seeding. Seed will be ordered in March and seeding in late March or April. Task 2 Timeline: March through April 2008 Task 2 Costs: $1,500 Seed $3,000 Labor Task 3: Management of Invasive Species. Invasive species occurring within the conservation outlots will be inspected, managed, and treated with appropriate herbicides during the 2008 growing season. Buckthorn seedlings and re- sprouts will be chemically treated with Roundup (Glyphosate) herbicide. Reed canary grass will be treated with a grass - specific herbicide (Sethoxydim) in species diverse areas, or Rodeo (Glyphosate) herbicide in areas with over 90% reed canary grass cover. Invasive cattails, such as narrow leaved cattail and hybrid cattail, will be treated with Rodeo (Glyphosate) herbicide. Invasive species management and herbicide treatments will be prioritized to areas that were burned in 2007, to follow up on this management approach, and will then be implemented in other areas as the budget financial resources allow. Task 3 Timeline: Task 3 Costs: April through October 2008 $1,200 Herbicide $8,500 Labor Task 4: Removal of Damaged Oak Tree. A damaged oak tree within the northeast corner of the Foxborough site will be removed. This tree is located within the conservation area, and is immediately adjacent to the trail. The tree was damaged by wind storms two years ago, and its substantial side -limbs have fallen onto the trail in last year. The tree presents a safety liability and could result in further damage to the adjacent City -owned trail, if left untreated. CCES will fall and remove the tree during the winter months, to reduce the possibility of damage to the trail and ground vegetation (while the ground is frozen).
