HomeMy WebLinkAbout2008-065 Council ResolutionCouncil Member Reinert introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 08 -65 RESOLUTION APPROVING A SUMMARY OF ORDINANCE NO. 09 -08 FOR PUBLICATION WHEREAS, the City Council has approved the first and second reading of Ordinance No. 09 -08, amending the City Code, Section 304 to include Administration and Regulation of Public Right -Of -Way; and WHEREAS, Ordinance No. 09 -08 is lengthy and MN Statute 412.191 provides for a city to publish a summary of an ordinance, and WHEREAS, the City Council determines that the summary clearly informs the public of the intent and effect of the ordinance, and WHEREAS, the publication in the official newspaper will include a notice that a full printed copy of the ordinance is available at City Hall. NOW, THEREFORE BE IT RESOLVED THAT the City Council approves the summary in Attachment A for publication according to state law and the City Charter. Resolution No. 08 -65, Approving Summary of Ordinance No. 09 -08 for Publication VOTE REQUIRED: Simple Majority BACKGROUND: On June 9, 2008 the City Council approved the first reading of Ordinance 09 -08, Amending the City Code, Section 304 to include Administration and Regulation of Public Right -Of -Way. The proposed Right -of -Way Ordinance brings all companies under one uniform set of standards, streamlines the franchising process, and removes questions about the extent of the City's authority over non - franchised utilities such as the telephone companies. Assuming approval of the second reading of Ordinance 09 -08, Section 304 of the City Code will become effective 30 days after publication. OPTIONS: 1. Approve Second Reading of Ordinance 09 -08, Amending The City Code, Section 304 to include Administration and Regulation of Public Right -Of -Way. 2. Return to staff. RECOMMENDATION: Staff is recommending approval of Ordinance No. 09 -08, Amending the City Code, Section 304 to include Administration and Regulation of Public Right -Of -Way and Resolution No. 08 -65, Approving Summary of Ordinance for Publication.
