HomeMy WebLinkAbout2008-082 Council Resolutionevv .kL 'L AA o Cs/1I fv Council MemberGallup introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 08 -82 APPROVING STATEMENT OF CONCURRENCE Vadnais Lake Area Water Management Organization /Rice Creek Watershed District Boundary Adjustment WHEREAS, a watershed is defined under Minnesota Statues section 103205 as a drainage area having boundaries which are substantially coterminous with those of an aggregation of contiguous minor watershed units possessing similar drainage patterns and which cross the borders of two or more local government units; and WHEREAS, The VLAWMO is established and authorized under Minnesota Statutes 103D and is a watershed management organization as defined under Minnesota Statutes section 103B.205; and WHEREAS, On May 13, 2008 the Board of Directors of the VLAWMO voted unanimously to amend the boundary of the VLAWMO district with the Rice Creek Watershed District using the process described in M.S. 103B.215; and • WHEREAS, pursuant to M.S. 103B.215, a Statement of Concurrence from the affected municipality is required; and • WHEREAS, the City has reviewed the proposed boundary adjustments and finds that said adjustments achieve a more accurate alignment between the hydrologic and legal boundaries for the two watershed management organizations. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1. This was determined using a combination of topographic information, available storm sewer and drainage plan information from area developments and municipal files and field cheeks. State Statute Chapter 103B.215 provides a procedure for updating watershed boundaries. Over the last year VLAWMO has been working with municipal staff and the other watersheds to come to a consensus on the updated boundary. The proposed boundary adjustments are based on hydrologic information (topography, storm sewer maps, etc.) and assigning split parcels to one watershed or the other. Following the review VLAWMO is requesting the following changes for Lino Lakes: 1. Transfer of 19.31 acres in the City, currently within VLAWMO to the Rice Creek Watershed District. 2. Transfer of 65.61 acres in the City, currently within RCWD to VLAWMO. The affected area is currently comprised of the following land uses: Land Use Acres % of Area Single Family Residential 44.5 52.4 Agricultural 30.33 35.7 Tax Forfeit 10.09 11.9 Totals 84.92 100 City staff has reviewed the proposed changes and find that they are consistent with the hydrologic boundary based on our review of topographic information and storm sewer and drainage information.
