HomeMy WebLinkAbout2008-085 Council Resolution• • Council Member Stoltz introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 08 -85 RESOLUTION APPROVING CHANGE ORDER NO. 15 LAKE DRIVE /I35W IMPROVEMENT PROJECT WHEREAS, pursuant to the resolution of the City Council adopted May 14, 2007, the City awarded the construction contract for the Lake Drive /I -35W Improvement Project to Lunda Construction Company, and WHEREAS, at Traffic System "B" it was discovered during installation of the Davit D40- 9 light pole on signal base pole # 1 the clearance conflicts with the overhead Xcel Energy power lines that run parallel along the west side of CSAH 23. This conflict also exists on Signal System "C" signal base pole lights 1 and 6; and WHEREAS, the project engineer has determined for safe clearance with the overhead Xcel Energy power lines that the three Davit D40 -9 light poles be replaced with three Davit D30 -9 light poles, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1. Council Member introduced the following resolution and moved its adoption: Mn/DOT TP- 2460 - 0112 -92) SHEET 1 OF 2 SHEETS State of Minnesota - Department of Transportation CHANGE ORDER # 15 State Project No.: 0280 -55 Contract No. Z07502 contractor: Lunda Construction Co. Address: 15601 Clayton Avenue S. Rosemount, MN 55068 Location: In Lino Lakes on CSAH 23 (Lake Dr.) From 1000 ft. south of Town Center Parkway to Apollo Dr. In accordance with the terms of this Contract, you are hereby authorized and instructed to perform the Work as altered by the following provisions. At Traffic Signal System `B" it has been discovered during the installation of the Davit D40 -9 light pole on signal base pole # 1 the clearance conflicts with the overhead Excel power lines that runs parallel along the west side of C.S.A.H. 23. After further review, at Traffic Signal System "C" signal base pole lights for 1 and 6 also conflict with the overhead power lines. The Project Engineer has determined for safe clearance with the overhead Excel power lines that the three Davit D40 -9 light poles described above shall be replaced with three Davit D30 -9 light poles. To continue with the Contractors installation the Anoka County Highway Depai tuient has two Davit D30 -9 light poles in their inventory that the project can use providing that they are replaced once the additional Davit D30 -9 are delivered to the project. Illkhe Contractor shall be made whole for the labor provided to remove the Davit D40 -9 light pole at signal base pole #1 and install the Davit D30 -9 for Traffic Signal System `B ". This Work Order directs the Contractor to furnish all equipment, materials and labor necessary for all labor to purchase any& install a total of three Davit D30 -9 light poles required for Traffic Signal System "B & C ". The contractor shall deliver two Davit D30 -9 light poles to the Anoka County Highway Department and three Davit D40j -9 light poles as per plan shall be delivered to a sight to be determined by the Project Engineer. All work will be performed in accordance with the pertinent portions of the Special Provisions, Mn/DOT Standard Specifications, Mn/DOT Standard Plates and as directed by the Engineer. Payment to the Contractor for this work will be via Mn/DOT 1904 Force Account as shown below in the Estimate of Cost. Distribution: S.P. 0280 -55 Group No. 1 ESTIMATE OF COST Description Amount Force Account $10,000.00 ESTIMATED COST OF THIS WORK ORDER $10,000.00 •Distribution: S.P. 0280 -55 Group 01 — 100% STAFF ORIGINATOR: CITY COUNCIL MEETING DATE: TOPIC: AGENDA ITEM 6D Michael Grochala August 11, 2008 Resolution No. 08 -85, Approving Change Order No.15, Lake Drive /35W Improvement Project VOTE REQUIRED: 3/5 Vote Required BACKGROUND: On May 14, 2007 the City Council awarded the Lake Drive /I -35W Improvement Project to Lunda Construction Company in the amount of $7,531,701.71. The Lake Drive /35W ramp signal systems were planned to include 40 foot street light poles on each signal base in accordance with Anoka County requirements. However, during installation it was discovered that the relocated Xcel Energy power lines did not provide adequate clearance from the light poles. In order to provide safe clearance • three 30 foot light poles were substituted. To continue with the installation Anoka County provided 30 foot poles from their inventory provided that the items are replaced. Change Order No. 15 directs the contractor to provide the replacement poles and deliver to Anoka County. The total cost of the change order is $10,000. Staff is working with Mn /DOT and Anoka County to arrange for their acquisition of the remaining 40 foot poles no longer needed for the project.
