CITY OF LINO LAKES
RESOLUTION NO. 08 -95
ACCEPTING CONVEYANCE OF CERTAIN REAL PROPERTY FROM
THE STATE OF MINNESOTA
PARCEL 15, CITY OF LINO LAKES R/W PLAT NO. 1
WHEREAS, the City, in 1992, authorized the acquisition of certain real property for the
purpose of constructing public street and utility improvements; and
WHEREAS, the City acquired a permanent easement over property owned by the State
of Minnesota legally described to wit:
Parcel 15, City of Lino Lakes R/W Plat No. 15
; and
WHEREAS, it has been determined that it is in the best interests of the State of
Minnesota and the City of Lino Lakes for the State to convey its interest to said parcel
to the City.
• NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA:

1. That the City hereby accepts the conveyance of Parcel 15 City of Lino Lakes R/W
Plat No. 15 from the State of Minnesota.

Consideration of Resolution No. 08 -95, Accepting
Land Conveyance, Parcel 15 ROW Plat No. 1, State
of Minnesota.
VOTE REQUIRED: Simple Majority
BACKGROUND:
In 1992 the City Council authorized the acquisition of property for the purpose of
constructing Apollo Drive through what is now the Apollo Business Park. City Right -of-
Way Plat No. 1 identified the parcels to be acquired. Parcel 15 of the plat is owned by
the State of Minnesota and is part of the Lino Lakes Correctional Facility property. In
1993 the City acquired a permanent easement for street and utility purposes over
parcel 15. The permanent easement includes a triangular area that lies south of the
physical roadway improvements.
In January of 2008 both the City and State were notified by the property owner at 400
Apollo Drive that their northeastern driveway access was located on State property
encumbered by the City's easement. Since there was no easement or agreement of
any kind for the driveway, the attorney for the owner contacted the State to resolve the
issue.
After reviewing the issue it has been determined that it is in the best interest of the
State of Minnesota and the City of Lino Lakes for the State to quit claim its interest to
the land described as Parcel 15, City of Lino lakes R/W Plat No. 1 to the City.
Following this conveyance the land would become public right -of -way and the driveway
issue would be resolved.
RECOMMENDATION:
Staff recommends approval of Resolution No. 08 -95.
