Council Member o ' Donnel lintroduced the following resolution and moved its adoption:
CITY OF LINO LAKES
RESOLUTION NO. 08 -106
RESOLUTION APPROVING AN EXTENSION OF TIME ON THE CONDITIONAL USE
PERMIT FOR PLANNED UNIT DEVELOPMENT AND THE PLANNED UNIT
DEVELOPMENT — DEVELOPMENT STAGE PLAN FOR MOON MARSH.
WHEREAS, review and approvals of plats are governed by state statutes and City
ordinances, and
WHEREAS, the Conditional Use Permit for Planned Unit Development, and the Planned
Unit Development — Development Stage Plan for Moon Marsh were approved with
Resolution 07 -142 by the City Council on September 10, 2007, and
WHERAS, the city's Subdivision and Platting Ordinance requires the final plan be
submitted within one year of approval, and
ID WHEREAS, a request has been submitted to the City to extend the time allowed for
submittal of a final plan upon approval by the City Council, and
WHEREAS, the Conditional Use Permit for Planned Unit Development, and the Planned
Unit Development — Development Stage Plan for Moon Marsh are still in compliance
with City requirements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lino Lakes
hereby approves an extension to the submittal time of the final plan for Moon Marsh,
subject to the following conditions:
1. The escrow account for the Planned Unit Development — Development Stage
Plan must be paid in full.
2. The complete final plan application for Moon Marsh must be submitted by
April30, 2009.
3. All conditions of approval for Resolution No. 07 -142 will continue to apply to the
site.

Moon Marsh Extension of Time

• Planned Unit Development — Development Stage Plan
VOTE REQUIRED: Simple Majority
BACKGROUND
On September 10, 2007 the City Council adopted Resolution No. 07 -142, approving the
Conditional Use Permit for Planned Unit Development, and Development Stage Plan for a 4 lot
rural residential subdivision on the east side of East Rondeau Lake Road, about 7,000 feet north
of Main Street.
A Planned Unit Development — Development Stage Plan must be followed by the first phase's
PUD -Final Plan application within 12 months, and the applicant has not been able to meet this
deadline. For tracking purposes, staff is recommending all plats be extended to April 31, 2009.
The development's escrow account has a negative balance of $6,404.25. The developer has been
informed of this deficit, and this balance must be paid in full prior to the final plan being
submitted. A full final plan application will be required when the developer is ready to proceed,
which will include an escrow deposit per the city's fee schedule.
RECOMMENDATION
Staff is recommending adoption of Resolution No. 08 -106 approving an extension of the Planned
Unit Development — Development Stage Plan approval, subject to the following conditions:
1. The escrow account for the Planned Unit Development — Development Stage Plan
must be paid in full.
2. The complete final plan application for Moon Marsh must be submitted by April 31,
2009.
3. All conditions of approval for Resolution No. 07 -142 will continue to apply to the site.
