CITY OF LINO LAKES
RESOLUTION NO. 08 -108
RESOLUTION APPROVING AN EXTENSION OF TIME ON THE FINAL PLAT
APPROVAL FOR VAUGHANS FIRST ADDITION
WHEREAS, review and approvals of plats are governed by state statutes and City
ordinances, and
WHEREAS, the final plat for Vaughan's First Addition was approved with Resolution 08-
44 by the City Council on April 28, 2008, and
WHERAS, the city's Subdivision and Platting Ordinance requires the final plat be
recorded within 90 days of approval, and
WHEREAS, a request has been submitted to the City to extend the time allowed for
recordation of a final plat upon approval by the City Council, and
WHEREAS, the final plat for Vaughan's First Addition is still in compliance with City
requirements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lino Lakes
hereby approves an extension to the recordation time of the final plat for Vaughan's
First Addition, subject to the following conditions:
1. The Final Plat for Vaughan's First Addition must be recorded by April 30,
2009; unless an additional extension is granted by the City Council.
2. All conditions of approval for Resolution No. 07 -103 will continue to apply to
the site.
3. Updated title commitment documents must be submitted and reviewed prior
to the city signing the final plat mylar.

Vaughan's First Addition
• Final Plat Extension of Time
VOTE REQUIRED: Simple Majority
BACKGROUND
On April 28, 2008 the City Council adopted Resolution No. 08 -44, approving the Final Plat for
Vaughan's First Addition, a one lot residential subdivision on the north end of Ruffed Grouse
Road, approximately 1,300 feet north of Birch Street.
Final Plats are required to be recorded within 90 days, and the applicant did not meet this
deadline. They have requested additional time to record the final plat, and for the purpose of
record keeping and ongoing monitoring of all approvals extended at this time, staff is
recommending the deadline be extended to April 31, 2009.
The escrow account for Vaughan's First Addition has a balance of $45.49 which the city will
continue to hold for eventual conversion to the development agreement. The development
agreement is still valid until the new deadline of April 31, 2009. However, the title commitment
documents that were submitted with the final plat approval are now past valid and new
commitment documents will need to be submitted along with the development agreement and
financial securities prior to receiving a signature on the final plat mylar.
RECOMMENDATION
Staff is recommending adoption of Resolution No. 08 -108 approving an extension of the Final
Plat approval, subject to the following conditions:
1. The Final Plat for Vaughan's First Addition must be recorded by April 31, 2009;
unless an additional extension is granted by the City Council.
2. All conditions of approval for Resolution No. 08 -44 will continue to apply to the site.
3. Updated title commitment documents must be submitted and reviewed prior to the
city signing the final plat mylar.
