Council Member o, Donne l lintroduced the following resolution and moved its adoption:
CITY OF LINO LAKES
RESOLUTION NO. 08 -109
RESOLUTION APPROVING AN EXTENSION OF TIME ON THE PLANNED UNIT
DEVELOPMENT — DEVELOPMENT STAGE PLAN FOR THE PRESERVE.
WHEREAS, review and approvals of plats are governed by state statutes and City
ordinances, and
WHEREAS, the final plat for The Preserve was approved with Resolution 06 -137 by the
City Council on August 28, 2006, and
WHERAS, the city's Subdivision and Platting Ordinance requires a final plan be
submitted within one year of approval, and
WHEREAS, a request has been submitted to the City to extend the time allowed for
submittal of a final plan upon approval by the City Council, and
WHEREAS, the Planned Unit Development — Development Stage Plan for The
Preserve is still in compliance with City requirements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lino Lakes
hereby approves an extension to the submittal time of the final plan for The Preserve,
subject to the following conditions:
1. A complete final plan application for The Preserve must be submitted by April
30, 2009; unless an additional extension is granted by the City Council.
2. All conditions of approval for Resolution No. 06 -137 will continue to apply to
the site.

The Preserve Extension of Time
• Planned Unit Development — Development Stage Plan
VOTE REQUIRED: Simple Majority
BACKGROUND
On August 28, 2006 the City Council adopted Resolution No. 06 -137, approving the Planned
Unit Development - Development Stage Plan for a residential subdivision/conservation
development on the south end of Pheasant Run, approximately 1,300 feet south of Birch Street.
A Planned Unit Development — Development Stage Plan must be followed by the first phase's
PUD -Final Plan application within 12 months, and the applicant has not been able to meet this
deadline. For record keeping purposes, staff is recommending April 31, 2009 as the new
deadline for submittal of the final plan.
The development's escrow account for the PUD - Development Stage Plan was converted to a
long term escrow account with the grading only development agreement approved by the City
Council in 2007. A full final plan application will be required when the developer is ready to
proceed, which will include an escrow deposit per the city's fee schedule.
RECOMMENDATION
Staff is recommending adoption of Resolution No. 08 -106 approving an extension of the Planned
Unit Development — Development Stage Plan approval, subject to the following conditions:
1. The complete final plan application for The Preserve must be submitted by April 31,
2009.
2. All conditions of approval for Resolution No. 06 -137 will continue to apply to the site.
