CITY OF LINO LAKES
RESOLUTION NO. 08-113
RESOLUTION AUTHORIZING THE CERTIFICATION OF DELINQUENT WEED
ABATEMENT CHARGES TO BE COLLECTED WITH THE 2008 PROPERTY TAXES
PAYABLE IN 2009
WHEREAS, pursuant to City Code Section 904, any weeds or grass growing upon any
lot or parcel of land in the City of Lino Lakes to a greater height than eight
(8 "), or which have gone or about to got to seed are declared to be a
nuisance, and
WHEREAS, certain property owners in noncompliance with such code requirements were
notified and provided the opportunity to comply with such provisions, and
WHEREAS, upon failure of the property owner to comply with the provisions of said
notice, the City Weed Inspector ordered the abatement of such nuisance, in
accordance with the City Code Section 904, and charged the property owner
thereof for expenses incurred by the City, and
WHEREAS, certain properties are delinquent in the payment of such charges, and
WHEREAS, the City Clerk has prepared a list of properties with delinquent charges to be
certified to the Anoka County Auditor for collection with the 2008 property
taxes, payable in 2009, and
WHEREAS, notice of such certification was mailed to affected property owners, and
WHEREAS, the City Council has met to consider the certification of such deliquent
charges.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes, Minnesota
that the Clerk is hereby authorized to certify the deliquent charges attached hereto as
Exhibit "A" to the Anoka County Auditor to be collected with the 2008 property taxes,
payable in 2009 at an interest rate of 8.00% per annum.

The motion for the adoption of the foregoing resolution was duly seconded by Council
Member O'Donnell and upon vote being taken thereon, the following voted in favor
thereof:
Gallup, O'Donnell, Reinert, Stoltz, Bergeson
The following voted against same:
none
Whereupon said resolution was declared duly passed and adopted.

TOPIC Consider Resolution 08 -113 Authorizing the Certification of
Delinquent Weed Abatement Charges to be collection with
2008 Property Taxes Payable in 2009

BACKGROUND
Simple Majority (3/5)
Staff is bringing before the City Council delinquent weed abatement charges for certification
to the County Auditor for collection with the following year property taxes. Affected property
owners received certified, registered mailed notice of this proceeding and have been
allowed ample time to pay the delinquent charges.
Staff recommends that the City Council adopt Resolution 08 -113 authorizing the
certification of delinquent weed abatement charges to be collected with 2008 property taxes
payable in 2009 at an interest rate of 8% per annum.
OPTIONS
1) Adopt Resolution No. 08 -113.
2) Return to staff for further review.
3) Do not adopt Resolution No. 08 -113.
