RESOLUTION NO. 08 -121
RESOLUTION APPROVING CHANGE ORDER NO. 14
LAKE DRIVE /I35W IMPROVEMENT PROJECT
WHEREAS, pursuant to the resolution of the City Council adopted May 14, 2007, the City
awarded the construction contract for the Lake Drive /I -35W Improvement Project to Lunda
Construction Company, and
WHEREAS, drainage improvements for the project included pipe jacking of a storm sewer line
underneath I -35W, and
WHEREAS, it has been determined that the use of a 42" casing would not leave an adequate
separation with the 35W roadway section and it was therefore necessary for the contractor to
use a smaller casing and different pipe materials, and
WHEREAS, this change required the contractor to reset their pipe jacking equipment so that
the proper grades could be established. As a result the contractor has identified costs
associated with the initial installation of the 42" casing.
• NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO
LAKES, MINNESOTA:
1. Change Order No.14, in the amount of $10,591.14, is hereby approved.

BACKGROUND:
On May 14, 2007 the City Council awarded the Lake Drive /I -35W Improvement Project to
Lunda Construction Company. The construction contract currently is $7,868,432. Construction
is substantially complete. Remaining items include minor maintenance and work associated
with the following change orders.
Chance Order No. 14. Drainage improvements for the project included pipe jacking of a storm
sewer line underneath 35W. While starting to jack the casing necessary for the work it was
determined that the use of a 42" casing would not leave an adequate separation with the 35W
roadway section. It was therefore necessary for the contractor to use a smaller casing and
different pipe materials. This change required the contractor to reset their pipe jacking
equipment so that the proper grades could be established. As a result the contractor has
identified costs associated with the initial installation of the 42" casing. The net amount of the
change order is $10,591.14.
Change Order No. 16. Upon reviewing the construction plans it was discovered that additional
grading items under Bridge No. 02817 were necessary for construction. This change order
directs the contractor to perform all grading work to complete the improvements. The total
amount of the change order is $25,370.55.
Funding for unanticipated construction expenses was included within the project budget. The
revised total contract amount, including CO 14 and CO 16, will be $7,904,393.89. The total
roadway and bridge construction budget is $8,073,307.
RECOMMENDATION:
Staff is recommending approval of Resolution No. 08 -121 and No. 08 -122.

In accordance with the terms of this Contract, you are hereby authorized and instructed to perform the Work as altered by the following provisions.
While starting to jack the casing necessary for the work identified in Change Order #7,it was determined that
the use of a 42" casing would come into conflict with the 35W pavement. It was therefore necessary for the
Contractor to use a smaller casing and different pipe materials. This change required the Contractor to reset
their pipe jacking equipment so that the proper grades can be established. As a result the Contractor has
claimed that there are costs associated with the initial installation of the 42" casing before the conflict was
discovered that are not addressed under the pipe jacking work on Change Order #7. The Engineer has reviewed
these claims and determined that some of the claims asserted are valid.
This Change Order provides settlement of all claims for the work involved with initially installing the 42"
casing. By signing this Change Order the Contractor also acknowledges that the remaining work required to
install the 36" casing and pipe will be performed as agreed in the previously issued Change Order #7.
*he Contractor will not make claim of any kind or character whatsoever for any other costs or expenses that he
may have incurred or that may be hereafter incurred in performing the work and furnishing the materials
required by this Change Order.
Payment to the Contractor will be at the lump sum negotiated price as full and final settlement of the claims
detailed above, as shown below in the Estimate of Cost. In addition, upon review of the steel casing, knuckle
and steering sensor, a credit will be applied to this Change Order at the negotiated prices shown below in the
Estimate of Prices if it is deemed that the materials can be salvaged by the Contractor.
