RESOLUTION NO. 08 -132
RESOLUTION ACCEPTING PERMANENT EASEMENTS FOR DRAINAGE AND
UTILITY PURPOSES ON LOT 4, BLOCK 2 OF PHEASANT HILLS PRESERVE 5111
ADDTIION. (1414 SHERMAN LAKE ROAD).
WHEREAS, the City has administravely approved the adjustment of the south lot line;
and
WHEREAS, the City requires five feet of drainage and utility easement along the side
property line of each platted lot; and
WHEREAS, a condition of approval of the Minor Subdivision required that the property
owner grant drainage and utility easement to fulfill the five foot requirement; and
WHEREAS, James and Dawn Helvig, the respective property owners, have provided
the City with said easements.
1111 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA:
1. That the easement shown in Exhibit A is hereby accepted by the City of Lino Lakes
and the City Clerk is authorized to execute the easements on behalf of the City.

Adopted by the Lino Lakes City Council this 24th day of November, 2008.
The motion for the adoption of the foregoing resolution was duly seconded by Council
Member Stoltz and upon vote being taken thereon, the following voted in favor
thereof:
Gallup, Stoltz, O'Donnell, Reinert, Bergeson
The following voted against same:
none
Whereupon said resolution was declared duly passed and adopted.

TOPIC: Accepting Drainage and Utility Easement
1414 Sherman Lake Road
BACKGROUND
ANALYSIS
Staff recently approved a minor subdivision to adjust the lot lines of 1412 and 1414 Sherman
Lake Road (Lot 4 Block 2 and Lot 5 Block 2 Pheasant Hills Preserve 5th Addition). This was
requested to correct an issue created by a fence built over a property line. A condition of the
administrative approval required an additional easement be granted to provide five feet on either
side of the new property line. As a result, the applicants have submitted the attached easement
document.
RECOMMENDATION
Staff is recommending approval of Resolution Number 08 -132, accepting a drainage and utility
easement on the property addressed as 1414 Sherman Lake Road.

Minnesota.
Description of Easement:
An easement for drainage and utility purposes over, under and across the herein
before described property, lying 5.00 feet on each side of the following described
line:
Commencing at the most southerly corner of said Lot 4; thence North 58
degrees 29 minutes 26 seconds West 175.77 feet along the southwesterly line of
said Lot 4 to the most westerly corner of said Lot 4 and the point of beginning
for the line to be described; thence South 62 degrees 47 minutes 54 seconds
East 57.31 feet; thence South 59 degrees 45 minutes 25 seconds East 119.67
feet to a point on the southeasterly line of said Lot 4 being 7.02 feet from said
most southerly corner of Lot 4 and said line there terminating.
Except that portion thereof dedicated as drainage and utility
