Council Member Reinert introduced the following resolution and moved its adoption:
CITY OF LINO LAKES
RESOLUTION NO. 08 -143
RESOLUTION APPROVING A SUMMARY OF
ORDINANCE NO. 15 -08 FOR PUBLICATION
WHEREAS, the City Council has approved the first and second reading of Ordinance
No. 15 -08, amending the City Code, Section 207.08, to include updated language
required by the Minnesota Bureau of Criminal Apprehension relative to background
checks; and
WHEREAS, Ordinance No. 15 -08 is lengthy and MN Statute 412.191 provides for a city
to publish a summary of an ordinance, and
WHEREAS, the City Council determines that the summary clearly informs the public of
the intent and effect of the ordinance, and
WHEREAS, the publication in the official newspaper will include a notice that a full
printed copy of the ordinance is available at City Hall.
NOW, THEREFORE BE IT RESOLVED THAT the City Council approves the summary
• in Attachment A for publication according to state law and the City Charter.

Member Stoltz and upon vote being taken thereon, the following voted in favor
thereof:

Whereupon said resolution was declared duly passed and adopted.

SUMMARY OF ORDINANCE NO. 15 -08
AN ORDINANCE amending the City Code, Section 207.08, relating to background
checks
The purpose of amending Section 207.08 is to update the city's regulations relating to
the procedure for criminal background checks for city employment and city licenses to
conform to the requirements of the Bureau of Criminal Apprehension (BCA). The
section is amended to change the word "authorized" to "required" as it relates to the
Lino Lakes Police Department's authority to do background checks. The ordinance
also adds language that allows the city's hiring authority to conclude that a background
investigation may not be needed in some cases.
Passed by the Lino Lakes City Council on December 8, 2008.
