Council Member Gallup introduced the following resolution and moved its adoption:
CITY OF LINO LAKES
RESOLUTION NO. 11 -11
RESOLUTION APPROVING A SUMMARY OF
ORDINANCE NO. 02 -11 FOR PUBLICATION
WHEREAS, the City Council has approved the first and second reading of Ordinance
No. 02 -11, amending the Zoning Ordinance sections regarding Open Air Markets,
Transient Merchants, and Community Gardens; and
WHEREAS, Ordinance No. 02 -11 is lengthy and MN Statute 412.191 provides for a city
to publish a summary of an ordinance, and
WHEREAS, the City Council determines that the summary clearly informs the public of
the intent and effect of the ordinance, and
I WHEREAS, the publication in the official newspaper will include a notice that a full
printed copy of the ordinance is available at City Hall.

NOW, THEREFORE BE IT RESOLVED THAT the City Council approves the summary
in Attachment A for publication according to state law and the City Charter.
Passed by the Lino Lakes City Council this 24th day of January 2011.

The motion for the adoption of the foregoing resolution was duly seconded by Council
Member Roeser and upon vote being taken thereon, the following voted in favor
thereof:
Gallup, Roeser, Rafferty, O'Donnell, Reinert

Whereupon said resolution was declared duly passed and adopted.

Summary of Ordinance 02 -11 for publication
purposes
BACKGROUND
The City Council approved the first reading of this ordinance on January 10, 2011, and
the second reading of the ordinance is on this agenda as item 6.A.i.
Since the ordinance is lengthy, and publication in the newspaper is required, the city
may adopt a resolution that summarizes the ordinance for publication purposes.
RECOMMENDATION
Staff recommends adoption of Resolution Number 11 -11, to summarize Ordinance
Number 02 -11 for publication purposes.

COUNTY OF ANOKA
SUMMARY OF ORDINANCE NO. 02 -11
AN ORDINANCE amending the Zoning Ordinance sections regulating Transient
Merchants, Open Air Markets, and Community Gardens
The purpose of amending these sections of the Zoning Ordinance is to clarify the
temporary outdoor sales of items and the use of land for the purpose of community
gardens.
Section 1.Subdivision 2.B of the Zoning Ordinance will include definitions for the
terms 'Open Air Market', 'Transient Merchant', and `Community Garden'.
Section 5, Section 6, Section 7, Section 8, and Section 9 of the Zoning
Ordinance will be modified to include the uses `Transient Merchant', 'Open Air
Markets', and `Community Gardens' within certain zoning districts and under
certain conditions.
Passed by the Lino Lakes City Council on January 24th, 2011.
