Council Member Rafferty introduced the following resolution and moved its adoption:
CITY OF LINO LAKES
RESOLUTION NO. 11 -12
RESOLUTION APPROVING A SUMMARY OF
ORDINANCE NO. 03 -11 FOR PUBLICATION
WHEREAS, the City Council has approved the first and second reading of Ordinance
No. 03 -11, amending the Zoning Ordinance sections regarding Motor Vehicle Sales
Lots; and
WHEREAS, Ordinance No. 03 -11 is lengthy and MN Statute 412.191 provides for a city
to publish a summary of an ordinance, and
WHEREAS, the City Council determines that the summary clearly informs the public of
the intent and effect of the ordinance, and
• WHEREAS, the publication in the official newspaper will include a notice that a full
printed copy of the ordinance is available at City Hall.

NOW, THEREFORE BE IT RESOLVED THAT the City Council approves the summary
in Attachment A for publication according to state law and the City Charter.

Member Roeser and upon vote being taken thereon, the following voted in favor
thereof:

The following voted against same:

Whereupon said resolution was declared duly passed and adopted.

SUMMARY OF ORDINANCE NO. 03 -11
AN ORDINANCE amending the Zoning Ordinance sections regulating Motor
Vehicle Sales Lots
The purpose of amending these sections of the Zoning Ordinance is to clarify the sale of
motor vehicles within the city.
Section 1.Subdivision 2.B of the Zoning Ordinance will be modified to add a
definition for `Motor Vehicles Sales Lots' and to remove the term `Outdoor Sales
Lots'.
Section 3.Subdivision 5.F of the Zoning Ordinance will be modified to include
parking standards for `Motor Vehicle Sales Lots'.
Section 7.Subdivision 3.H.9 of the Zoning Ordinance will be modified to update
the `Motor Vehicle Sales Lots' section of the conditional use permit requirements.
Passed by the Lino Lakes City Council on January 24th, 2011.

BACKGROUND
The City Council approved the first reading of this ordinance on January 10, 2011, and
the second reading of the ordinance is on this agenda as item 6.B.
Since the ordinance is lengthy, and publication in the newspaper is required, the city
may adopt a resolution that summarizes the ordinance for publication purposes.
RECOMMENDATION
Staff recommends adoption of Resolution Number 11 -12, to summarize Ordinance
Number 03 -11 for publication purposes.
